HomeMy WebLinkAboutS-759 Ordinance No. S-759 AN ORDINANCE AUTHORIZING THE PURCHASE OF CERTAIN REAL PROPERTY WHEREAS, the City Council has determined that it is necessary and proper and to the interests of the public's health, safety and convenience that a street or roadway be constructed along the Easterly bank of the Fox River, connecting the Highland Avenue and Chicago Street Bridges, and WHEREAS, the acquisition of additional real property is necessary to provide a right of way for such street or roadway, and WHEREAS, it is the considered opinion of this Council that the pre- mises hereinafter described be acquired for such purpose at a price not to exceed Eleven Thousand Nine Hundred Dollars ($11, 900. 00). NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That the City of Elgin purchase from The First Federal Savings and Loan Association of Elgin, an association organized under the laws of the United States of America, located in the City of Elgin, Illinois, for the sum of Eleven Thousand Nine Hundred Dollars ($11, 900. 00) the follow- ing described interest in real estate, to-wit: All the land, property, and space at and above a horizontal plane 732..0 feet above Elgin City Datum, bounded as follows: That part of Lots 3 and 4 in Block 20 of the Original Town of Elgin, on the East side of the Fox River, described as follows: Commencing at the point of Intersection of the Northerly line of East Chicago Street and the Westerly line of Lot 8 of the Assessor's Subdivision of Lot 6 of said Block 20; thence West- erly along said Northerly line of East Chicago Street a distance of 44. 0 feet to an angle in said Northerly line; thence Southwest- erly along said Northerly line of East Chicago Street a distance of 7. 62 feet; thence Northwesterly along a line that forms an angle of 84 degrees 49 minutes to the right. with the prolongation of the last described course a distance of 136. 76 feet to a point in the Southerly line of the First Federal Savings and Loan Association property for a point of beginning; thence continuing Northwesterly along the last described course a distance of 93. 81 feet to a point in the Southerly line of East Highland Avenue said point being 163. 4 feet Southwesterly of the intersection of the Easterly extension of said Southerly line and the Northerly extension of the Westerly line of North Grove Avenue; thence Southwesterly along said Southerly line of East Highland Avenue a distance of 61. 35 feet more or less to its intersection with the Easterly shore line of the Fox River; thence Southeasterly along said Easterly shore line a distance of 96 feet more or less to its intersection with the Southerly line of the First Federal Savings and Loan Association property; being also the Northerly line of the Elgin National Bank property; thence Northeasterly along said Southerly line a distance of 64 feet more or less to the place of beginning. Also the express right to enter upon the above described real estate below the said hori- zontal plane for the purpose of erecting, maintaining, re- pairing and inspecting pillars, posts and supporting members of and for any structure erected on or above said horizontal plane by the Grantee hereunder, its successors or assigns. It being the intent of this deed to convey to the City of Elgin certain air rights for the purpose of constructing a bridge like structure to be used as a public street or roadway, said property being situated in the City of Elgin, County of Kane and State of Illinois. Section 2. That the City Treasurer be and he hereby is authorized and directed to issue a voucher, payable to the First Federal Savings and Loan Association of Elgin, in the sum of Eleven Thousand Nine Hundred Dollars ($11, 900. 00), provided a good and sufficient Warranty Deed, con- veying title to said premises to the City of Elgin is delivered prior to pay- ment. Section 3. That this ordinance shall be effective from and after its passage as provided by law and shall be published in pamphlet form by authority of the City Council. Clyde L.
