HomeMy WebLinkAboutS-752 Ordinance No. S-752 AN ORDINANCE VACATING A PORTION OF A PUBLIC ALLEY SITUATED IN LOTS 1 AND 2 IN BLOCK 21 OF J. T. GIFFORD'S PLAT OF ELGIN' AND CONNECTED TO AND FORMING A PART OF THE NORTHERLY END OF RIVERSIDE AVENUE IN THE CITY OF ELGIN, KANE COUNTY, ILLINOIS WHEREAS, the Easterly portion of a certain public alley platted and lying in Lots 1 and 2 in Block 21 of J. T. Gifford's Plat of Elgin, Kane County, Illinois is not presently being utilized for public alley purposes; said portion of the alley hereinafter described being abutted on three sides by property owned and improved by the First National Bank of Elgin, and WHEREAS, it is not in the public interest that the City continue to maintain, repair, and regulate said portion of the public alley, and WHEREAS, the public interests will be subserved by the vacation of the following described portion of said public alley, to-wit: That part of Lot 102 of B. W. Raymond's Subdivision of Lots 1, 3, 4, and 5 in Block 21 of J. T. Gifford's Plat of Elgin and that part of Lot B of County Clerk's Subdivision of Lot 2 in Block 21 of J. T. Gifford's Plat of Elgin lying Easterly of the Westerly line extended Southeasterly of Lot 1 of McOsker's Subdivision of Lots 7, 8, 9, 10 and 102 of said B. W. Raymond's Subdivision and lying Westerly of a line that is 38.45 feet Southwesterly of and parallel with the Westerly line and the Westerly line extended Southeasterly of Lot 4 of said B. W. Raymond's Subdivision and lying Northerly of the Northerly line of Lot D of said County Clerk's Subdivision and lying Southerly of the Southerly line of Lot 10 of said B. W. Raymond's Subdivision in the City of Elgin, Kane County, Illinois. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That the following described portion of a certain public alley, as platted and located in Lots 1 and 2 in Block 21 of J. T. Gifford's Plat of Elgin, in the City of Elgin, Kane County, Illinois, to-wit: That part of Lot 102 of B. W. Raymond's Subdivision of Lots 1, 3, 4 and 5 in Block 21 of J. T. Girrord's Plat of Elgin and that Part of Lot b of County Clerk's Subdivision of Lot 2, Block 21 of J. T. Gifford's Plat of Elgin lying Easterly of the Westerlyline extended Southeasterly of Lot 1 of McOsker's Subdivision of Lots 7, 8, 9, 10 and 102 of said B. W. Raymond's Subdivision and lying Westerly of a line that is 38.45 feet Southwesterly of and parallel with the Westerly line and the Westerly line extended Southeasterly of Lot 4 of said B. W. Raymonds Subdivision and lying Northerly of the Northerly line of Lot D of said County Clerk's Subdivision and lying Southerly of the Southerly line of Lot 10 of B. W. Raymond's Subdivision in the City of Elgin, Kane County, Illinois be and the same hereby is vacated for public alley and street purposes. Section 2. That a certified copy of this ordinance, together with a plat of the portion of said public alley vacated be filed with the Recorder of Deeds of Kane County, Illinois. Section 3. That this ordinance shall be effective from and after its passage as provided by law, and shall be published in pamphlet form by authority of the City Council. Clyde L.
