HomeMy WebLinkAboutS-749 Ordinance No. S-749 AN ORDINANCE DESIGNATING AN AREA IN EXCESS OF TWO ACRES WITHIN THE CORPORATE LIMITS OF THE CITY OF ELGIN, ILLINOIS, AS AN INTEGRATED PROJECT AREA FOR REHABILITATION OR REDE- VELOPMENT PURSUANT TO SECTION 11-11-1 OF DIVISION 11 OF ARTICLE 11 OF THE ILLINOIS MUNICIPAL CODE (CHAPTER 24, SECTION 11-11-1, ILLINOIS REVISED STATUTES, 1963); AUTHORIZING AND DIRECTING THE CITY MANAGER AND DI- RECTOR OF THE DEPARTMENT OF URBAN RENEWAL TO NE- GOTIATE ON BEHALF OF THE CITY OF ELGIN FOR THE PUR- CHASE OF THE REAL ESTATE INCLUDED WITHIN SAID AREA; AND AUTHORIZING AND DIRECTING THE ATTORNEYS FOR THE CITY OF ELGIN TO INSTITUTE PROCEEDINGS IN ANY COURT OF COMPETENT JURISDICTION TO ACQUIRE TITLE TO AND POSSES- SION OF THE REAL ESTATE WITHIN SAID PROJECT AREA FOR THE CITY OF ELGIN IN ACCORDANCE WITH THE EMINENT DO- MAIN LAWS OF THE STATE OF ILLINOIS. WHEREAS, it has heretofore been deemed advisable, necessary and in the public interest of the City of Elgin that the said City, pursuant to the provisions of Section 11-11-1 of Division 11 of Article 11 of the Illinois Municipal Code (Chapter 24, Section 11-11-1 Illinois Revised Statutes, 1963), acquire by purchase, condemnation, or otherwise, certain improved and unimproved real property within the corporate limits, the acquisition of which is necessary and appropriate for the rehabilitation and redevelopment of blighted or slum areas;remove or demolish substandard or other buildings and structures from the property so acquired; hold or use any of such property for public uses; and sell, lease, exchange such property as is not required for the public purposes of the municipality, and WHEREAS, it has heretofore been determined by the Council and is hereby redetermined that certain land within the central area of the City of Elgin, consisting of more than two acres and bounded as follows, to-wit: That part of the City of Elgin, Illinois, located within the Northeast one quarter of Section 14, Township 41 North, Range 8 East of the Third Principal Meridian, described as follows, to-wit: Beginning at the intersection of the East bank of the Fox River and the North right of way line of Kimball Street for a point of beginning; thence Easterly along the north right of way line of Kimball Street to the East right of way line of North Grove Avenue; thence Southerly along the East right of way line of North Grove Avenue to the North right of way line of North Street; thence Easterly along the North right of way line of North Street, to the East right of way line of Douglas Avenue; thence Southerly along the East right of way line of Douglas Avenue to the South right of way line of Fast Highland Avenue; thence Westerly along the South right, ofway•.iine of.East Highland Avenue, to the East bank of the Fox River, thence Northerly and Westerly along said Easterly bank of the Fox River to the place of beginning, situated in the City of Elgin, County of Kane, State of Illinois. is a "blighted or slum area" where buildings by reason of dilapidation, overcrowding, faulty arrangement or .design, lack of ventilation, light or sanitation facilities in combination of thesefaet�ors,are a'detriment to public safety, health and morals, and are in need of rehabilitation or redevelopment. WHEREAS, the said integrated proect fo,r,rehabilitation and re- development is known as "City of Elgin, Illinois, Central`Area Redevelop- ment Project, " (Urban Renewal Project Ill. : No. R-44). NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, KANE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: Section 1. That it is hereby found and determined that certain land within the central area of the City of Elgin, consisting of more than two acres and bounded as follows, to-wit: That part of the City of Elgin, Illinois, located within the Northeast one quarter of Section 14, Township 41 North, Range 8 East of the Third Principal Meridian, described as follows, to-wit: Beginning at the intersection of the East bank of the Fox River and the North right of way line of Kimball Street for a point of beginning; thence Easterly along the North right of way line of Kimball Street to the East right of way line of North Grove Avenue; thence Southerly along the East right of way line of North Grove Avenue to the North right of way line of North Street; thence Easterly along the North right of way line of North Street, to the East right of way line of Douglas Avenue; thence Southerly along the East right of way line of Douglas Avenue to the South right of way line of East Highland Avenue; thence Westerly along the South right of way line of East Highland Avenue to the East bank of the Fox River; thence Northerly and Westerly along said Easterly bank of the Fox River to the place of beginning, ' situated in the City of Elgin, County of Kane, State of Illinois. I ^y, is a "blighted or slum area" where buildings by reason of dilapidation, over- crowding, faulty arrangement or design; lack of ventilation, light or sanita- tion facilities, or any combination of these factors are a detriment to public safety, health or morals and are in need of rehabilitation and.redevelopment; and that said area is hereby designated as an integrated project for rehabili- tation or redevelopment. Section 2. That said integrated project for rehabilitation and rede- velopment is known and described, as "City :of Elgin, Illinois, Central Area Redevelopment Project", (Urban Renewal Project I1.1. No. R-44). Section 3. It is hereby found and determined that it is necessary and desirable that the City of Elgin; acquire by purchase, condemnation or otherwise the improved or unimproved real property described in Section 1 preceding, the acquisition of which.is.necessary or appropriate for the rehabilitation or redevelopment of any blighted or slum areas; remove or demolish substandard or other buildings and structures from the property so acquired; hold or use any of such property, for public uses; and sell, lease, or exchange such property as is not required for public purposes of the municipality. Section 4.'. That the City Manager and Director of the Department of Urban Renewal be, and they are hereby, authorized, empowered and directed to negotiate for and in behalf of the City of Elgin with the owner, or owners, of the herein above described real property for the purchase thereof by the said City of Elgin for said integrated project for rehabilitation or redevelop- ment. Section 5. In the event that the said City Manager and Director of Urban Renewal are unable to agree with, the owners of said property, upon the compensation to be paid therefore, then title to and possession of the various parcels of real estate, consisting of the said real property de- scribed in Section 1 of this Ordinance shall be acquired by the City of Elgin, and the attorneys for the City of Elgin are hereby authorized, em- powered and directed to institute proceedings in any Court of competent jurisdiction to acquire title to or in possession of said property for said City of Elgin, in accordance with the eminent domain laws of the State of Illinois. C • Section 5. That this Ordinance shall be in full force and effect from and after its passage as provided by law and shall be published in pamphlet form by authority of the City Council. Clyde L.
