AN ORDINANCE
ANNEXING CERTAIN TERRITORIES IN SECTION 15, TOWNSHIP 41 NORTH,
RANGE 8 EAST OF THE THIRD PRINCIPAL MERIDIAN, ELGIN TOWNSHIP,
KANE COUNTY, ILLINOIS, TO THE CITY OF ELGIN, ILLINOIS.
WHEREAS, Chapter 24, Section 7-1-13, Illinois Revised Statues for
1963,. provides that any unincorporated territory containing sixty (60) acres
or less, which is wholly bounded by any municipality, may be annexed to
such municipality by the passage of an ordinance to that effect, and
WHEREAS, the territory and lands hereinafter described contain less
than sixty (60) acres in area, are not within the corporate limits of any muni-
cipality, and are wholly bounded by the existing corporate limits of the City
of Elgin, and
WHEREAS, in the considered opinion of the City Council it is to the
best interest of the general public that such territory and lands be annexed
to the City of Elgin, Illinois.
WHEREAS, a portion of said territories with two hundred (200) feet
of frontage on Larkin Avenue and a depth of one hundred sixty seven (167)
feet, more fully described hereafter, is presently zoned under the Zoning
Ordinance of Kane County, Illinois, in a business classification which per-
mits the use thereof for an automobile service station and automobile
laundry or '!car wash", and
WHEREAS, the owner of said real estate has indicated to the Council
that he has acquired said property for such use or uses under the Kane
County Zoning Ordinance and it is the opinion of the Council that said prop-
erty, if annexed to the. City of. Elgin, be zoned in a classification under the
Elgin Zoning Ordinance, which will continue to permit the same or similar
uses on said tract, so as to conform with the present zoning of said property
within the County.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF ELGIN, ILLINOIS:
Section 1. That the territory and lands described as follows, to=wit:
Of parts of Section 15, Township 41 North, Range 8
East of the Third Principal Meridian, described as
follows: Beginning at a point on the North and South
center line of said Section 15 that is 8. 25 chains
North of the North line of Larkin Avenue; thence West
at right angles to said quarter section line, 826. 32
feet; thence Southerly, parallel with the North and

South center line of said Section 15, a distance of
502. 40 feet; thence Westerly parallel with the East
and West center line of said Section 15, a distance
of 457. 9 feet to the Easterly line of. Cyrus Larkin
lands; thence Southerly along said Easterly line, a
distance of 388. 52 feet to the center line of Larkin
Avenue; thence Northeasterly along said center line,
a distance of 937. 12 feet to the Westerly line ex-
tended Southerly of Ka-Wa-Ee Gardens, being a
subdivision of part of Section 15, Township and Range
aforesaid; thence Northerly along said Westerly line
extended and along said Westerly line, a distance of
338. 30 feet to the Northwest corner of said Ka=Wa.Ee
Gardens; thence Easterly along the North line of said
Ka-Wa-Ee Gardens, a distance of 224. 06 feet to a jog
in said North line; thence Southerly along said jog, a
distance of 70. 0 feet; thence -Easterly along said North-.
erly tine, a distance of 140. 0 feet to the North and
South center line of said Section 15; thence Southerly
along said North and South center line, a distance of
178. 52 feet to the center line of Larkin Avenue; thence
Northeasterly along said center line to the North and
South center line extended Southerly of. Block 8 of
Theo. F. Swan's Subdivision, being a subdivision of
part of Section 15, Township and Range aforesaid;
thence Northerly along the North and South center
line of said Block 8 to a point on the East line of Lot
9 in said Block 8, that is 20. 97 feet North of (measured
along said East line) the Southeast corner of said Lot 9;
thence Westerly, parallel with the South line of said Lot
9 and parallel with said South line extended Westerly, to
the North and South center line of said Section 15; thence
Northerly along said North and South center line to a
point on a line extended Westerly that is 30. 97 feet North
of and parallel with the South line of Lot 8 in Block 8 of
said Theo. F. Swan's Subdivision; thence Easterly along
said parallel line extended and along said parallel line to
the North and South center line of said Block 8; thence
Northerly along said North and South center line to a
point on the West line of Lot 24 in said Block 8 that is
6. 0 feet North of (measured along said West line) the
Southwest corner of said Lot 24; thence Easterly parallel
with the South line of said Lot 24 to the East line of said
Block 8; thence Northerly along the East line of said Block
8 to a point on the -East line of Lot 26 in said Block 8 that
is 5. 97 feet North of (measured along said East line) the
Southeast corner of said Lot 26; thence Westerly parallel 415
with the South line of said Lot 26 to the North and South
center line of said Block 8; thence Northerly along said
North and South center line to a point on the East line of
Lot 2 in said Block 8 that is 15. 97 feet North of (measured
along said East line) the Southeast corner of said Lot 2,
thence Westerly parallel with the South line of said Lot 2
and parallel with said South line extended Westerly, to
the North and South center line of said Section 15; thence
Southerly along said North and South center line to the
place of beginning. Being situated in Kane County, Illinois.
containing less than sixty (60) acres in area, not being within the corporate
limits of any municipality, and being wholly bounded by the existing corporate
limits of the City of Elgin, Illinois, be and they are hereby annexed to and
made a part of the City of Elgin.
Section 2. That the above described territory and lands be and they
are hereby included within the corporate boundaries of the City of Elgin.
Section 3.
(a) That that portion of the above described territories being
annexed to the City of Elgin, described as follows, to-wit:
Commencing at the intersection of the Easterly
line of Cyrus Larkin's lands, with the Northerly
line of Larkin Avenue; thence Northeasterly along
the Northerly line of Larkin Avenue, a distance of
121. 0 feet for the place of beginning; thence North-
westerly at right angles to said Northerly line, a
distance of 167. 0 feet; thence Northeasterly para-
llel with the Northerly line of Larkin Avenue, a
distance of 200. 0 feet; thence Southeasterly at
right angles to the last described course, a dis-
tance of 167. 0 feet to the Northerly line of Larkin
Avenue; thence Southwesterly along said Northerly
line, a distance of 200. 0 feet to the place of
beginning.
be and it hereby is included in the B-4 General Service District,
as set forth in the Elgin Zoning Ordinance (Chapter 21 of the City
Code of Elgin, Illinois), with a Special Use granted thereon for
the operation and maintenance of an automobile laundry .
(b) That the balance of said territories be and they are hereby
included in the R-2 Single Family Residence District as set
forth in the Elgin Zoning Ordinance (Chapter 21 of the City
Code of Elgin, Illinois. )

Section 4. That a certified copy of this ordinance together with
an accurate map of said annexed territory be filed with the Recorder of
Deeds of Kane County, Illinois.
Section 5. That this ordinance shall be in full force and effect
upon its passage as provided by law. It shall be published in pamphlet
form by authority of the City Council.
