HomeMy WebLinkAboutS-736 Ordinance No. S-736 AN ORDINANCE ANNEXING CERTAIN TERRITORIES IN SOUTH WASHINGTON HEIGHTS ADDITION AND PART OF SECTION 22, TOWNSHIP 41 NORTH, RANGE 8 EAST OF THE THIRD PRINCIPAL MERIDIAN, ELGIN TOWNSHIP, KANE COUNTY, ILLINOIS, TO THE CITY OF ELGIN, ILLINOIS. WHEREAS, Chapter 24, Section 7-1-I3 Illinois Revised Statutes for 1963, provides that any unincorporated territory containing sixty (60) acres or less which is wholly bounded by any municipality may be annexed to such municipality by the passage of an ordinance to that effect, and WHEREAS, the territory and lands hereinafter described contain less than sixty (60) acres in arealare not within the corporate limits of any municipality, and are wholly bounded by the existing corporate limits of the City of.Elgin, and WHEREAS, in the considered opinion of the City Council it is to the best interest of the general public that such territory and lands be annexed to the City of Elgin, Illinois, and WHEREAS, a portion of such territory is presently zoned for com® r mercial uses under the Zoning Ordinance of Kane County, Illinois, and in the opinion of the Council such territory, if annexed to the City of Elgin, should be zoned in a classification under the Elgin Zoning Ordinance, which will continue to permit the same or similar uses as are presently permis= Bible under the Kane County Zoning Ordinance, so as to conform with the present zoning of said property within the County. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ELGIN, ILLINOIS. Section 1. That the territories and lands described as follows, to-wit: Part of Section 22, Township 41 North, Range 8 East of the Third Principal Meridian, described as follows: Be- ginning at the intersection of the East line of the Southwest quarter of the Northeast quarter of said Section 22 with the Southerly right of way line of Federal Aid Route 6; thence Westerly along said Southerly right of way line, a distance of 825. 03 feet to an angle in said Southerly right of way line; thence Westerly along said Southerly right of way line, a distance of 305. 33 feet to an angle in said Southerly right of way line; thence Northwesterly along said Southerly right of way line, a distance of 224. 8 feet; thence Southwesterly along a line that forms an angle of 44 degrees 36 minutes to the left with the prolongation of the last described course, • a distance of 28. 28 feet to the Easterly line of McLean Boulevard; thence Westerly a distance of 125 feet more or less to the Westerly line of McLean Boulevard; thence Northwesterly along a line that forms an angle of 134 de- grees 30 minutes from Southwest to Northwest with the Westerly line of McLean Boulevard, a distance of 42. 43 feet to the Southerly right of way line of Federal Aid Route 6; thence Northwesterly along said Southerly right of way line, which forms an angle of 45 degrees 00 minutes to the left with the prolongation of the last described course, a distance of 562. 35 feet to an angle in said Southerly right of way line; thence Northwesterly along said Southerly right of way line, a distance of 525. 55 feet to an angle in said Southerly right of way line; thence Northwesterly along said Southerly right of way line, a distance of 5.35. 0 feet to a point on a line that is 1048. 66 feet North of and parallel with the South line of the Northwest quarter of said Section 22; thence Easterly along said parallel line, a distance of 1625 feet more or less to the East line of McLean Boulevard; thence Northerly along said East line to the South line of Lillian Street; thence Easterly along said South line, along said South line extended, and along said South line, to the Northwest corner of Lot 1 in Block 60 of South Washington Heights, being a subdivision of part of Section 22. as afore- said; thence Southerly along the West line of said Lot 1 to the Southwest corner thereof; thence Easterly along the South line of said Lot 1 to the Southeast corner thergof; thence Northerly along the East line of said Lot 1 to the Northeast corner thereof; thence Easterly along the,South- erly line of Lillian Street extended and along said Southerly line to the West line of South Melrose Avenue; thence Southerly along said West line to the Northeast corner of Lot 3 in Block 61 of South W-as-hington Heights as aforesaid; thence Westerly along the North line of said Lot 3 to the Northwest corner thereof; thence Southerly along the West line of said Lot 3 to the Southwest corner thereof; thence Easterly along the South line of said Lot 3 to the Southeast corner thereof; thence Southerly along the West line of South Melrose Avenue and along said West line extended to the Southerly line of South.Street; thence Southwesterly along said Southerly line, a distance of 672 feet more or less to the Northerly right of way line of Federal Aid Route 6; thence Southeasterly along said Northerly right of way line, a distance of 366. 5 feet to an angle in said Northerly right of way line; thence Southeasterly along said Northerly right of way line, a distance of 498. 49 feet; thence Northerly parallel with the East line of the South 4111) west quarter of the Northeast quarter of said Section 22, a distance of 82. 0 feet; thence Easterly at right angles to the last described course, a distance of 110. 0 feet to the East line of the Southwest quarter of the North- east quarter of said Section 22; thence Southerly along said East line, being at right angles to the last de- scribed course, a distance of 270. 38 feet to the place of beginning. ALSO: Lots 10, 11 and 12 in Block 56, in South Washington Heights, a subdivision of part of Section 22 as aforesaid. ALSO: Lots 1, 11 and 13 through 24 in Block 58 and that part of 'the South half of Meyer Street lying Northerly of and adjacent to said Lots 1 and 24 in South Washington Heights, a subdivision of part of Section 22 as aforesaid. All the above being situated in Kane County, Illinois. containing less than sixty (60) acres in area, not being within the corporate limits of any municipality and of being wholly bounded by the existing corp- orate limits of the City of Elgin, Illinois be and they are hereby annexed to and made a part of the City of Elgin, Illinois. Section 2. That the above described territory and lands be and they are hereby included within the corporate boundaries of the City of Elgin, Illinois. Section 3. (a) That Lots 13, 14, 15, 16, 17, 18, 19, and 20 in Block 58 and that portion of Lot 17 being annexed to the City of Elgin and Lots 26, 27 and 28 in Block 59 of South Washington Heights Addition to Elgin Township, Kane County, Illinois; and also that portion of the territory described in Section 1 preceding lying North of Federal Aid Route 6 and West of McLean Boule- vard be and they are hereby included in the B-3 Service Business District as set forth in the Elgin Zoning Ordinance (Chapter 21 of the City Code of Elgin, Illinois). (b) That the remainder of the territories and lands being annexed to the City of Elgin,hereinabove described in Section 1,be and they are hereby included in the R-2 Single Family Residence District as set forth in the Elgin Zoning Ordinance (Chapter 21 of the City Code of Elgin, Illinois). Section 4. That a certified copy of this ordinance, together with an accurate map of said annexed territory, be filed with the Recorder of Deeds of Kane County, Illinois. Section 5. That this ordinance shall be in full force and effect upon its passage as provided by law and shall be published in pamphlet form by authority of the City Council. Clyde L.
