HomeMy WebLinkAboutS-735 Ordinance No. S-735 AN ORDINANCE ANNEXING CERTAIN TERRITORIES IN THE SOUTH HALF OF SECTION 2, TOWNSHIP 41 NORTH, RANGE 8 EAST OF THE THIRD PRINCIPAL ME RIDIAN IN ELGIN TOWNSHIP, KANE COUNTY, ILLINOIS, TO THE CITY OF ELGIN, ILLINOIS. WHEREAS, a petition signed by all of the owners of record and electors residing on the land hereinafter described has been filed with the City Clerk, and WHEREAS, said petition requests the annexation of such territories to the City of Elgin and contains statements therein under oath that all of the owners of record and electors residing on such lands have joined in such petition. WHEREAS, said territories are not within the corporate limits of any municipality and are contiguous to the City of Elgin, Illinois, and WHEREAS, such property is presently zoned under the Zoning Ordinance of Kane_ County, Illinois under a classification which permits the use thereof for colleges and universities and uses, accessory and incidental thereto, which use is presently in existance thereon and the petition requests that such territories, if attached to the City of Elgin, be zoned R-2 Single Family Residence District under the Elgin Zoning Ordinance with a special use granted to operate and maintain a college and university thereon, so that the petitioner can continue such use and so as to conform with the present zoning within the County. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That the territories and lands described as follows, to-wit: That part of the South half of Section 2, Township 41 North, Range 8 East of the Third Principal Meridian, described as follows: Commencing at the intersection of the old center line of S. B. I. Route 22 with the South line of said Section 2; thence Easterly along the South line of said Section 2, a distance of 119. 50 feet to the Easterly line of S. B. I. Route 22 (F. A. Route 23) by Document No. 848175 for the place of beginning; thence Northeasterly along said Easterly line being along a curve to the right having a radius of 2610. 89 feet (the chord of said curve forms an angle of 69 de= grees 47 minutes to the left with the prolongation of the last described course) a distance of 205. 5 feet; thence Northeasterly along said Easterly line, being tangent to the last described curve, a distance of 316. 89 feet; thence Northeasterly along said Easterly line, being along a curve to the left having a radius of 4986. 15 feet, .a distance of 383. 0 feet to the Southerly line of lands owned by M. Paul Gonns en and Goldie E. Gonnsen, husband and wife, in part of the South half of said Section 2; thence.South 65 degrees 59 minutes East along the Southerly line of said Gonnsen lands, a distance of 77. 79 feet; thence South 40 degrees 09 minutes East along the Southerly line of said Gonna en lands, a distance of 303. 8 feet; thence South 84 degrees 49 minutes East along the Southerly line of said Gonnsen lands, a distance of 397. 7 feet; thence South 58 degrees 40 minutes East along the Southerly line of said Gonnsen lands and along the Southerly line of lands formerly owned by M. Paul Gonnsen and Goldie E. Gonnsen, husband and wife, a distance of 1043. 88 feet to the South line of said Section 2; thence Westerly along said South line a distance of 1875. 60 feet to the place of beginning. EXCEPT a par- cel of land condemned by the State of Illinois and filed in the County Court of Kane County on October 11, 1958 in Case No. 31495. ALSO that part of.Section 2 and that part of Section 11, Township 41 North, Range 8 East of 411) the Third Principal Meridian, described as follows: Commencing at the intersection of the old center line of S. Paul Gonnsen and Goldie E. Gonnsen, husband and wife, a distance of 1019. 88 feet to the.South line of said Section 2; thence Easterly along said South line a distance of 144. 0 feet to the Westerly shore line of the Fox River; thence Northeasterly along said Westerly shore line, a distance of 289 feet more or less to a point on a line that is 345. 0 feet Northeasterly of (measured at right angles thereto) and parallel with the Southerly line of lands formerly owned by M. Paul Gonnsen and Goldie E. Gonnsen, as aforesaid; thence North 58 degrees 40 minutes West a.igng said parallel line and along said parallel line extended, a distance of 12.26. 34 feet; thence North- westerly along a line that forms an angle of 52 degrees 23 minutes to the right with the prolongation of the last described course, a distance of 27. 78 feet to a point on a line that is 173. 59 feet Southeasterly of (measured at right angles thereto) and parallel with the 'South line of C Lot 9 in Riverside Manor Unit No. 1, being a subdivi- sion of part of said Section 2; thence Southwesterly along said parallel line a distance of 243. 33 feet to a point on the Westerly line extended Southeasterly of said Lot 9 in Riverside Manor Unit No. 1, that is 175. 0 feet Southeasterly of (measured along said Westerly line) the Southwest corner of said Lot 9; thence Southeasterly along said Westerly line extended Southeasterly, a distance of 308. 33 feet to the place of beginning. ALSO that part of the Fox River lying Northwesterly of the main channel of said Fox River and adjacent to that part of the above described property bounded by the Westerly shore line of said Fox River. All the above being situated in Elgin Township, Kane County, Illinois. being contiguous to the City of Elgin and not a part of any municipality be and they are hereby annexed to and made a part of the City of Elgin. Section 2. That the boundary lines of the City of Elgin be and they are hereby enlarged and extended to include within the corporate boundaries thereof the above described territories. Section 3. That said territories be and they are hereby included in the R-2 Single Family Residence District as set forth in the Elgin Zoning Ordinance (Chapter 21 of the City Code of Elgin, Illinois, ) with a special 411) use granted thereon for the operation and maintenance of colleges and universities and uses, accessory and incidental thereto. Section 4. That a certified copy of this ordinance, together with an accurate map of said annexed territories be filed with the Recorder of Deeds of Kane County, Illinois. Section 5. That this ordinance shall be in full force and effect from and after its passage as provided by law and shall be published in pamphlet form by authority of the City Council. Clyde L.
