AN ORDINANCE
PROVIDING FOR THE CONSTRUCTION OF A PRIVATE SANITARY SEWER
LINE IN CLIFTON AVENUE AND OTHER STREETS AND AVENUES IN THE
CITY OF ELGIN, BY SCHOOL DISTRICT NO. 46, AND FOR THE APPOR -
TIONING OF THE COST THEREOF AMONG THOSE PROPERTY OWNERS
WHO MAY ELECT TO HOOK ON AND UTILIZE SUCH FACILITIES IN THE
FUTURE
WHEREAS, School District No. 46, Kane, Cook and DuPage Counties,
Illinois, has acquired certain real estate within the corporate limits of the
City of Elgin, legally described as follow, to-wit:
Block 5: Lots 1 , 2, 17, 18, 19, 20, 21, 22, 23, 24, 25,
26, 27 and that part of Lot 3 lying East of the extended

Subdivision of part of the East half of Section 15, Town-

Meicidian, iii the City of Elgin, Kane County, Illinois,
for the purpose of erecting and maintaining a grade school at said location,
and
WHEREAS, in constructing such school it is necessary and proper
that adequate facilities be provided for said site, and
WHEREAS, School District No. 46 desires at this time, in conjunc-
tion with the construction of said school building, to provide adequate se-
wage facilities by extending a private sanitary sewer line to connect with
a public sanitary sewer trunk line within the City of Elgin to serve said
site, all at School District No. 46's expense, and in constructing said se-
wer line have agreed to construct it of a size and depth large enough to
serve the entire proposed "Northwest Sewer District", should sanitary
sewers ever be extended within said district, but before doing so desires
to be protected in the following respects:
1. Have other owners of real estate who might hook on to said
extended facilities in the future, share the cost thereof.
2. Prevent eventual overloading of such extended facilities,
and
WHEREAS, the City of Elgin is willing to have School District
No. 46 proceed with the construction of said sanitary sewer line at their
own expense and is further willing to protect School District No. 46 as
set forth above.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ELGIN, ILLINOIS:
Section 1. That School District No. 46 shall cause the construc-
tion of a 10-inch sanitary sewer line from the intersection of Highland

Avenue and Clifton Avenue in the City of Elgin, to an existing sewer line on
McLean Boulevard, approximately 370 feet North of its intersection with
Oakley AVS7. Paid sewage disposal line shall be constructed in the public
streets of t . C .:; of Elgin, in accordance with plans and specifications ap-
proved by the City of Elgin.
Se,ayion 2. That the additional cost of the increased size and depth
of the sanitary sewer being constructed by School District No. 46 has been
fairly pro-rated over the entire proposed "Northwest Sewer District" and
detailed plans and specifications have been filed in the office of the City
Clerk of Elgin, Illinois, and the administrative offices of School District
No. 46 showing the over all plans and specifications for the extension of
sewer lines throughout the entire proposed district. The increase in cost
amounts to $1.05 per front foot pro-rated among those parcels which may
be benefited by the increased size and depth of the sewer constructed by
School District No. 46.
Section 3. That those properties actually having frontage on the
sewer line extension being constructed at this time by School District
No. 46 may hook on and connect to such extended facility only if any such
owners desiring to hook on and utilize such facilities shall first pay to the
City of Elgin for School District No. 46 their fair and proportionate cost
of such extended sanitary sewer line which has been determined to be
$13. 55 per front foot (including the $1.05 per front foot set forth in Sec-
tion 2 above).
Section 4. Those lots which may directly connect on. the facilities
being constructed by School District No. 46 as described in Section 3
above and the cost to each, if it so connects, is as follows:

Section 5. The lots in the proposed "Northwest Sewer District"
which do not actually front on the portion of the sewer being presently
constructed by School District No. 46 but which will benefit from the in-
creased size as set forth in Section 3 above and the cost to each in the
event that it does ultimately hook on and connect to the sewer presently
being constructed by School District No. 46 is as follows:

The cost to any partial lots will be based on $1 . 05 per front foot,
Section 6, That prior to the issuing of a permit to the owners of any
of the lots or portions thereof described in Sections 4 and 5 above to hook
on and connect the sewer line being construc ted by School District No, 46
either directly as described in Sections 3 and 4, or indirectly as described
in Sections 2 and 5; the city shall require any such owner to first pay di
rectly to the City of Elgin for the benefit of School District No. 46 the
pro-rata share of the cost of the sewer line being constructed by School
District No. 46 assessed against such property in the amount shown in
Sections 4 and 5 above. All such sums shall be collected by the City of
Elgin and periodically and within 90 days act ounted for and paid over to
School District No, 46
Section 7. That subsequent to the completion of the said sewer line
by School District No. 46 and after it has been inspec ted and approved by
the City of Elgin, the City of Elgin shall assume and accept the respon
sibility of maintaining and keeping the said sewer line in a reasonable
state of repair in the same manner that the City of Elgin maintains and
repairs other sanitary sewer lines constructed in the public streets of the
City of Elgin.
Section 3. That said extended sewer line shall never be used as a
combination storm and sanitary sewer, but shall be used only as a sani
tary sewer.
Section 9. That the Mayor of the City of Elgin be and he hereby is
authorized and instructed for and on behalf of the City, to exec ute an agree
merit with School District No, 46, Kane, Cook and DuPage Counties, Ill -
inois, a body politic and corporate, providing that in the event that the said
School District No, 46 extends the sanitary sewer facilities above described,
the City shall make provisions to have other owners who might benefit
from such extended facilities in the future share the cost thereof as pro-
vided in this ordinance.
Section 10. That this ordinance shall be in full force and effect upon its
passage as provided by law, and shall be published in pamphlet form by authority of
the City Council.
