RESOLUTION
AUTHORIZING EXECUTION OF A CHANGE ORDER NO. 1 WITH IHC CONSTRUCTION
COMPANIES, LLC YEAR 4 LEAD SERVICE LINE REPLACEMENT—CONTRACT B
(Bid No. 25-007)
WHEREAS,the City of Elgin has heretofore entered into a contract with IHC Construction
Companies, LLC for year 4 lead service line replacement—Contract B (Bid No. 25-007); and
WHEREAS,it is necessary and desirable to modify the terms of the contract as is described
in Change Order No. 1 attached hereto.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ELGIN,ILLINOIS,that Richard G. Kozal,City Manager,be and is hereby authorized and directed
to execute Change Order No. 1, a copy of which is attached hereto and made a part hereof by
reference.

CHANGE ORDER No. 1
CONTRACT: Year 4 Lead Service Line Replacement—Contract B (Bid No. 25-007)
SCOPE:The Year 4 Lead Service Line Replacement Program—Contract B project objective is to
replace approximately 321 lead service lines by December 31,2025.This is the existing substantial
completion date. The total original contract amount is $2,999,758.00. This change order would
allow for additional lead service line replacements to be performed under this contract by
extending the substantial completion date to June 1, 2026 and the final completion date to
December 1, 2026.
REASONS FOR CHANGE: After the Contractor completed 321 lead service line replacements,
a balance of $524,955.00 remained on the contract value. Similar to prior lead service line
replacement("LSLR")contracts, the City intends to increase the project scope by 68 lead service
line replacements in order to deplete this balance,thereby utilizing the full Illinois Environmental
Protection Agency ("IEPA") loan value for this contract. An increase in project scope requires a
revised substantial completion date and corresponding revised final completion date. A final
balancing change order will be completed once final construction costs are known.
The circumstances said to necessitate the change in performance were not reasonably foreseeable
at the time the contract was signed; the proposed change is germane to the original contract as
signed; and the change order is in the best interests of the City of Elgin and is authorized by law.
