AN ORDINANCE
AMENDING SECTION 19.50.090 OF TITLE 19 OF THE ELGIN MUNICIPAL CODE,
ENTITLED "SPECIAL STREET GRAPHICS"
(Mural Amendment)
WHEREAS, a written application has been made to amend Section 19.50.090 of Title 19
of the Elgin Municipal Code, entitled "Special Street Graphics" to allow murals in the CF
Community Facility District and the NB Neighborhood Business District; and
WHEREAS,the Planning and Zoning Commission conducted a public hearing concerning
said application on February 2, 2026, following due notice including by publication; and
WHEREAS, the Community Development Department and the Planning and Zoning
Commission have submitted their Findings of Fact concerning said application; and
WHEREAS, the Community Development Department and the Planning and Zoning
Commission recommend approval of said application, subject to the conditions articulated below;
and
WHEREAS, the City Council of the City of Elgin, Illinois, has reviewed the findings and
recommendations of the Community Development Department and the Planning and Zoning
Commission; and
WHEREAS,the City of Elgin is a home rule unit and as a home rule unit may exercise any
power and perform any function pertaining to its government and affairs; and
WHEREAS,zoning, including but not limited to,regulations in the city's zoning ordinance
relating to land use, pertain to the government and affairs of the city.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ELGIN, ILLINOIS:
Section 1. That the City Council of the City of Elgin hereby adopts the Findings of
Fact, dated February 2, 2026, and the recommendations made by the Community Development
Department and the Planning and Zoning Commission, a copy of which is attached hereto and
made a part hereof by reference as Exhibit A.
Section 2. That subsection M.1 of Section 19.50.090, entitled "Mural," of the Elgin
Municipal Code, as amended, be and is hereby amended in its entirety to read as follows:
"1. Murals shall be allowed only in the CF Community Facility District,NB Neighborhood
Business District, AB Area Business District, CC 1 Center City District, CC2 Center City
District, and well as like planned development districts."

Section 3. That all ordinances or parts of ordinances in conflict with the provisions of
this ordinance be and are hereby repealed to the extent of any such conflict.
Section 4. That this ordinance shall be in full force and effect upon its passage and
publication in the manner provided by law.

OF THE COMMUNITY DEVELOPMENT DEPARTMENT AND
THE PLANNING & ZONING COMMISSION
CITY OF ELGIN, IL
OVERVIEW
Provided herein are the written findings and recommendation of the Community Development
Department and the Planning & Zoning Commission regarding Petition 01-26, an application by
the Development Administrator of the City of Elgin,as Applicant, to amend Title 19"Zoning"of
the Elgin Municipal Code to allow murals in the CF Community Facility District, the NB
Neighborhood Business District. and the like planned development districts(Section 19.50.090).

TEXT AMENDMENT SUMMARY
Staff is advancing and recommending an amendment to the text of the zoning ordinance that would
allow murals in the NB Neighborhood Business and CF Community Facility zoning districts.
Exhibit B attached to this staff report shows the proposed new language to the zoning ordinance
in redline and the language to be deleted from the zoning ordinance in strikeout.
The City most recently amended the mural regulations on December 17,2025,adding the AB Area
Business District as a zoning district in which murals are allowed.Ecker Center on Larkin Avenue
intends to put a mural on the front of their building this Spring as a key part of their"Strength in
the Community"initiative,celebrating 70 years of service to the Elgin community.
During the presentation of that text amendment to City Council,it was suggested that the American
Legion Post 57 at 820 N.Liberty Street has long wanted to put a mural on the Chester Avenue side
of their building, facing the property formerly occupied by Simpson Electric. The American
Legion is zoned NB District.
The purpose of the NB zoning district is to provide for commercial areas that supply daily
convenience commodities and services to a neighborhood population. Besides in and around the
American Legion,other nodes of NB-zoned properties can be found along Dundee Avenue, Villa
Street, Larkin Avenue, and McLean Boulevard, and at intersections surrounded by established
neighborhoods like National Street (Walnut Avenue) and State Street, W. Chicago and Sheridan
Streets,and Walnut and Wilcox Avenues.
Also, since that presentation, it was discovered that the graphic at the Wildwood Commons
building at the Association for Individual Development(AID)campus on State Street was painted
directly on the building when it was supposed to have been painted onto panels which would then
be attached to the exterior wall of the building. This distinction, while not readily apparent to a
passersby,changes the zoning classification of the graphic from a wall graphic(as approved in the
planned development)to a mural (not currently allowed in the CF district).
The AID campus is along the east side of State Street, south of US Route 20 and the State of
Illinois Secretary of State Driver's License Facility. Wildwood Commons is the northern-most
building. Wildwood Trace, the southern-most building, also has a graphic, but that graphic was
painted on to panels which were then attached to the building. This amendment would bring the
Wildwood Commons mural into compliance with the zoning ordinance.

Land zoned CF Community Facility typically includes governmental buildings, parks and
recreational facilities, schools,religious institutions,and transportation services to the community
on a for-profit or on a not-for-profit basis.
Like in December, no other provisions of city mural regulations would be changed by this
amendment. Murals cannot cover major architectural features, such as doors,exits,and windows,
and murals cannot include more than three percent text.
STANDARDS FOR TEXT AMENDMENTS
For consideration by the Planning and Zoning Commission, the Community Development

Department offers that the proposed text amendments comply with the following purposes and
intent of the Zoning Ordinance(§ 19.05.300):
❑ Promoting the public health, safety,comfort,morals,convenience,and general welfare;
❑ Conserving the taxable value of land and structures throughout the city; and
❑ Dividing the entire city into districts, and restricting and regulating therein the location,
construction, reconstruction, alteration, and use of land and structures, whether for
residence,community facility,business, industrial,or other specified uses.
O Establishing standards to which buildings or structures therein shall conform.
The Community Development Department also offers that the proposed text amendment complies
with the following goals and objectives of the Comprehensive Plan:
O Identify opportunities to enhance Elgin's competitiveness for business and employment
investment, including evaluating the current regulatory environment.
❑ Work with other public agencies,neighboring townships,and municipalities,and the local
school districts, and universities to maintain high-quality community sites, facilities, and
infrastructure for residence and the business community, constructing, renovating, and
relocating facilities when necessary inappropriate, and developing them as a source of
community pride.
❑ Identify opportunities for partnerships between the City, school district, faith-based
institutions, non-profit organizations, and private providers to continue the availability of
important community services offered in the Elgin community, with attention to senior
citizens, youth, disadvantage populations, the unemployed, and the homeless, while
maintaining positive and mutually beneficial relationships with each partner organization.
RECOMMENDATION
The Community Development Department and the Planning& Zoning Commission recommend
approval of Petition 01-26.
The vote of the Planning &Zoning Commission on the motion to recommend approval was five
(5)yes,zero(0)no,and zero(0)abstentions. Two members were absent.
