RESOLUTION
AUTHORIZING EXECUTION OF A SECOND AMENDMENT TO
ANNEXATION AGREEMENT WITH ZALE 721 , INC. AND
AMERICAN NATIONAL BANK AND TRUST COMPANY OF CHICAGO
(Meijer, Inc . , 801 S . Randall Road)
WHEREAS, the owners of certain property commonly known as
801 S. Randall Road have proposed that the annexation agreement
between the owners and the City of Elgin concerning said
property be amended; and
WHEREAS, after due notice as required by law, a public
hearing on said proposal was held by the corporate authorities
of the City of Elgin; and
WHEREAS, the proposed Second Amendment to Annexation
Agreement with Zale 721 , Inc . and American National Bank and
Trust Company of Chicago is in the best interests of the City
of Elgin.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF ELG1N, ILLINOIS, that Kevin Kelly, Mayor, and Dolonna
Mecum, City Clerk, be and are hereby authorized and directed to
execute, on behalf of the City of Elgin, the Second Amendment
to Annexation Agreement with Zale 721, Inc. and American
National Bank and Trust Company of Chicago, a copy of which is
attached hereto.

NOTICE OF PUBLIC HEARING
TO AMEND ANNEXATION AGREEMENT
ELGIN CITY COUNCIL
ELGIN, ILLINOIS
On Wednesday, February 24 , 1999 , at 7 : 30 p .m. , a public hearing
will be held by the Corporate Authorities of the City of Elgin,
in the Elgin City Hall Council Chambers, 150 Dexter Court,
Elgin, Illinois, for the purpose of considering and hearing
testimony as to a proposed Second Amendment to an Annexation
Agreement by and between the City of Elgin, Illinois, and Zale
721, Inc . , an Illinois corporation and American National Bank
and Trust Company of Chicago, as Trustee under a Trust
Agreement dated September 29 , 1989 and known as Trust No .
109526-04 , the beneficiary of which is Randall Road Development
Corp. , an Illinois corporation. The proposed Second Amendment
to the Annexation Agreement modifies the original agreement and
the first amendment with respect to certain design and
development issues by deleting reference to a preliminary plan
for a commercial planned development in Woodbridge North
Subdivision.
The territory which is subject to the proposed Second Amendment
to the Annexation Agreement consists of approximately 50 acres
and is located east of Randall Road, between Bowes Road and
College Green Drive in Elgin Township, and is located within
Woodbridge North Subdivision, which is legally described as
follows :
THE WEST HALF OF THE SOUTHWEST QUARTER OF THE SOUTHEAST
QUARTER OF THE SOUTHWEST QUARTER OF SECTION 21 ; ALSO THE
EAST HALF OF THE NORTHWEST QUARTER OF SECTION 28 , TOWNSHIP
41 NORTH, RANGE 8 EAST OF THE THIRD PRINCIPAL MERIDIAN,
TOGETHER WITH ALL THAT PART OF RANDALL ROAD LYING EAST OF
THE WEST LINE THEREOF AS PER DEDICATION RECORDED DECEMBER
14, 1954 AS DOCUMENT NO. 1036816, (EXCEPT THAT PART THEREOF
PREVIOUSLY ANNEXED) IN THE CITY OF ELGIN, ELGIN TOWNSHIP,
KANE COUNTY, ILLINOIS .
A copy of the proposed Second Amendment to the Annexation
Agreement is on file with the City Clerk. You are further
notified that said proposed Second Amendment to the Annexation
Agreement may be changed, altered, modified, amended or revised
in its entirety after the public hearing.
All interested parties are invited to attend the public hearing
and will be given an opportunity to be heard.
