FOR ABOVE GROUND STORAGE TANKS WHEREAS, the City of Elgin has heretofore entered into a contract with Metro Environmental Contractors, Inc. for the installation of above ground storage tank systems; and WHEREAS, it is necessary and desirable to modify the terms of the contract as is described in Change Order No. 1, attached hereto. SCOPE: Installation of three (3) aboveground storage tank systems at three (3) locations within the City of Elgin. Tanks are 1,000 gallon capacity, compartmentized into two (2) 500 gallon tanks. Project includes the installation of a concrete pad, protective barriers, electrical hook-ups and all associated labor, materials and permits. REASON FOR CHANGE: Metro Environmental was awarded the original contract in July 1998. At that time, sufficient funds were not available to fund the three (3)tanks proposed by this change order. Therefore, this change order increases the original contract quantity of AST's by three(3). In addition to the increased quantities, this change order proposes an increase of $500.00 per tank system. Metro Environmental has experienced an increase in material costs due to price increases by the manufacturer since the original bid was submitted in June 1998. The original bid for project was $27,737.00 per tank system, for a total cost of$83,211.00. As a result of the increase in costs to Metro Environmental, the revised unit bid price is $28,237.00, for a total revised project cost of$84,711.00. This change order is in the best interest of the city and authorized by law. Parker, City Manager SUBJECT: Aboveground Storage Tanks PURPOSE The purpose of this memorandum is to provide the Mayor and members of the City Council with information to consider Change Order No. 1 to the "Above Ground Storage Tank" contract with Metro Environmental BACKGROUND The Illinois Environmental Protection Agency and the Office of the Illinois State Fire Marshal deadlines for upgrading underground storage tank (UST) systems was December 22 , 1998 . All noncompliant tanks as of that date were required to be removed or taken out of service . In June 1998 the City Council awarded the low bidder, Metro Environmental Contractors, Inc . a contract for the the removal of UST' s at Wing Park, Lords Park, Spartan Meadows, and Bluff City Cemetery. Included in that bid package (Category #2, Items #1 and #3) was the installation of replacement above- ground storage tanks (ASTs) at Wing and Lords Parks . The bid summary spread sheet of July 1998 is enclosed for your refer- ence. It was anticipated that 1, 000 gallon capacity AST systems would be installed at Spartan Meadows, the Sports Complex and Bluff City Cemetery as part of that bid package (Category #2 , Items #2, #4 , and #5, Alternate B) . However, bids exceeded budgeted funds, and AST installations at these three sites had to be deferred to 1999 . As a result of the UST systems being removed, these three sites no longer have on-site storage of fuel for off-road equipment . It is critical to routine operations that an adequate supply of fuel be available for these sites by early spring. It takes approximately 90 days from the date of order to have an AST system installed and functional . • * Aboveground Storage Tanks February 3 , 1999 Page 2 Metro Environmental has agreed to hold its previous bid pricing for the three additional AST systems, plus an addi- tional $500 . 00 per tank as a result of price increases from the tank manufacturer. The attached change order summarizes the costs associated with the installation of three additional ASTs . COMMUNITY GROUPS/INTERESTED PERSONS CONTACTED Parks Department INANCIAL IMPACT The 1999 budget contains funding for installation of the three above-ground storage tanks in account number 275-0000-791 . 92-46 , project number 379501 ($90, 000) . Suffi- cient funds are available within this account to fund the recommended award of $84 , 711 . LEGAL IMPACT This proposed change order requires an exception to the procurement ordinance pursuant to Elgin Municipal Code Section 5 . 02 . 020B (6) . ALTERNATIVES 1) Approve the change order to the Metro Environmental contract for the installation of the three additional aboveground storage tank systems in the amount of $84 , 711 ($28, 237 per AST) . 2) Solicit bids for the installation of three aboveground storage tanks . RECOMMENDATION It is recommended that the City Council approve Change Order No. 1 with Metro Environmental in the amount of $84 , 711 and direct staff to prepare the necessary resolution.
