Cogley 61/ City of Elgin 141:1\p 150 Dexter Court Elgin, IL 60120-5555 1 {999 K0860 1 9 GRANT OF EASEMENT This Grant of Easement made and entered into this 1st day of September, 1999 by WISPARK CORPORATION, a Wisconsin corporation(hereinafter referred to as the "Grantor"). WHEREAS, the Grantor is the owner of a tract of real property located in the City of Elgin,Kane County, Illinois; and WHEREAS, the predecessor of the Grantor and the City of Elgin had previously entered into an easement agreement dated May 20, 1997, and recorded as Document Number 97 K 035300; and WHEREAS, said easement agreement expired pursuant to its own terms and concurrently herewith the City of Elgin has executed and delivered to the Grantor a release evidencing the termination of such easement agreement; and WHEREAS, in order to accommodate the remaining storm sewer facility extending from the adjacent Galvin Drive the Grantor wishes to grant and the City wishes to accept an easement for such purposes. NOW, THEREFORE, for and in consideration of Ten Dollars ($10.00) in hand paid, and for other good and valuable consideration,the receipt and sufficiency of which is hereby acknowledged: 1. The Grantor,being the owner of the property referenced herein, does hereby grant to the City of Elgin, an Illinois municipal corporation, a non-exclusive easement to install, construct, operate, maintain, locate,repair or remove a storm sewer pipe in that parcel of land located on the property of the Grantor, and legally described and depicted on Exhibit A attached hereto and made a part hereof by this reference (hereinafter referred to as the "Easement Premises"). 2. That following the exercise by the City of any easement rights granted herein, the City shall promptly repair and restore the Easement Premises to the same condition as existed immediately prior to the exercise of such rights as is reasonably practicable and shall leave the Easement Premises and the surrounding premises free from debris. 3. That the Grantor and its successors shall not erect any permanent structures on the Easement Premises or otherwise undertake any activities which unreasonably interfere with the City's use of the Easement Premises. 4.
