RESOLUTION
AUTHORIZING EXECUTION OF A GRANT OF EASEMENT
TO SCHOOL DISTRICT U-46 FOR A STORM SEWER
(Valley Creek School)
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS, that Kevin Kelly, Mayor, and Dolonna Mecum, City
Clerk, be and are hereby authorized and directed to execute a
Grant of Easement on behalf of the City of Elgin with School
District U-46 for a storm sewer for the property legally
described in the Grant of Easement, a copy of which is attached
hereto and made a part hereof by reference.
BE IT FURTHER RESOLVED that the City Clerk is hereby
authorized and directed to cause the Grant of Easement to be
recorded in the office of the Recorder of Deeds of Kane County,
Illinois .

RELEASE OF A STORM SEWER
EASEMENT BY THE CITY OF ELGIN
The City of Elgin in Kane County, Illinois, for and in consideration of$10.00 in hand paid
and other good and valuable consideration, which is hereby acknowledged, hereby grants and
releases to School District U-46 of Elgin,Illinois the storm sewer easement described as follows over
a tract of land situated in the County of Kane and State of Illinois:
A 15 foot wide storm sewer easement over a part of the Southeast Quarter of
Section 10, Township 41 North, Range 8 East of the Third Principal Meridian the
center line of said Easement described as follows: commencing at the intersection
of the west line of said Southeast Quarter with the center line of Wing Street,
extended Westerly; thence Southeasterly, along said Westerly extension and center
line of Wing Street, a distance 457.88 feet for the point of beginning of the center
line of said 15 foot Easement; thence Northerly, along a line that forms a clockwise
angle of 75 degrees 53 minutes 00 second with the last described course, a distance
159.72 feet; thence Northwesterly along a line that forms a clockwise angle of 146
`1J degrees 21 minutes 18 seconds with the last described course, a distance of 394.70;
c') thence Northwesterly along a line that forms a clockwise angle 172 degrees 00
minute 00 second with the last described course, a distance of 253 feet more or less
to the center line of Tylar Creek for the terminus of said center line of said 15 foot
wide easement. Being situated in the City of Elgin, Kane County Illinois.
A Plat Releasing a Storm Sewer Easement dated June 9, 1997 is hereby attached and
incorporated into this Release of a Storm Sewer Easement.

Removal of the existing storm sewer in the easement being released shall be undertaken and
completed by School District U-46 of Elgin, Illinois. Constuction of a replacement storm sewer in
a new location shall be undertaken and completed by School District U-46 of Elgin, Illinois.

The City of Elgin releases to School District U-46 the easement described above, it being
the intention of the parties to terminate such easement and vest ownership of the above-described
property in School District U-46.
