RESOLUTION
AUTHORIZING EXECUTION OF AMENDMENT NO. 1 TO AN AGREEMENT
WITH HAMPTON, LENZINI AND RENWICK, INC .
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS, that Kevin Kelly, Mayor, and Dolonna Mecum, City
Clerk, be and are hereby authorized and directed to execute
Amendment No. 1 to an Agreement on behalf of the City of Elgin
with Hampton, Lenzini and Renwick, Inc. for the Liberty Street
rehabilitation project, a copy of which is attached hereto and
made a part hereof by reference.

AMENDMENT NO. 1
WHEREAS, the City of Elgin heretofore entered into an agreement dated November 7,
1997 with Hampton, Lenzini and Renwick, Inc.; and
WHEREAS, the City of Elgin requests the scope of services required under this
engineering agreement be expanded to cover the following:

NOW, THEREFORE, the parties hereto do mutually agree that the upper limit of
compensation for services required under paragraphs 1j and 1k shall not exceed the following
for 112 calendar days of service:
HLR cost $127,000.00
TSC cost 32,624.50
5% service charge 1,631.22
TOTAL $161,255.72
Save as to these provisions, all other terms and conditions of said contract are to remain
in full force and effect.

SUBJECT: Amendment No. 1 to an Agreement with
Hampton, Lenzini and Renwick (HLR)
Liberty Street (IL Route 25) Rehabilitation
PURPOSE
The purpose of the memorandum is to provide the Mayor and
members of the City Council with information to consider
Amendment No. 1 to an agreement with HLR which will add the
fee for construction-related engineering and inspection
services to the Liberty Street Rehabilitation Project .
BACKGROUND
At its meeting of October 15, 1997, the City Council author-
ized an agreement with HLR for the preparation of plans,
specifications, estimates and bidding services for the Liberty
Street (IL Route 25) Rehabilitation Project . This agreement,
based on MFT policy, stated that HLR will be paid 4 percent of
the awarded contract cost for design engineering.
Amendment No. 1 will add construction services to the agree-
ment with HLR. Because the State will be funding the costs for
the Liberty Street Project, HLR' s proposed fee is unnegotiated
and is based upon MFT policies . The construction engineering
(inspection) costs will be paid to HLR based upon actual time
and expense . Staff has met with IDOT regarding this amendment
and the agency concurs with the selection of HLR. A copy of
amendment No. 1 is attached as Exhibit A.
The award of a contract for the construction of the Liberty
Street improvements is included on the City Council agenda
under separate cover.

The Liberty Street Rehabilitation Project will be funded
entirely with State funds . The estimated design engineering
fee was $80, 000 . Under MFT policy, HLR' s fee will be based on
4 percent of the $2, 116 , 442 . 66 awarded contract amount, or
$84 , 657 . 71 . The construction engineering fee will be based
upon actual time and expense and is estimated to be $161 ,255.72.
The City will be reimbursed by IDOT for the design engineering
phase of the project . IDOT will pay HLR direct for the
construction engineering portion of the project .

RECOMMENDATION
It is recommended that City Council approve Amendment No. 1 to
tew the contract with HLR and authorize staff to execute the
necessary documents .
