HomeMy WebLinkAbout98-79 Resolution No. 98-79 RESOLUTION AUTHORIZING CITY COMMITMENT FOR THE FINANCIAL PARTICIPATION IN SIGNALS AT SHALES PARKWAY AND ILLINOIS ROUTE 58 WHEREAS, the City of Elgin, hereinafter referred to as City, located in the counties of Kane and Cook, State of Illinois, desires to accommodate left turn lanes for Shales Parkway in 1998 on Illinois Route 58 which comes under the jurisdiction and control of the Department of Transportation of the State of Illinois hereinafter referred to as Department; and WHEREAS, by law, the construction of a left turn lane on Illinois Route 58 requires a permit from the Department; and WHEREAS, the Department requires a resolution stating the City' s commitment for future intersection improvements prior to issuance of a permit; and WHEREAS, the City has awarded the construction contract which includes the left turn lane on Illinois Route 58 and therefore requires the Department' s permit by April 15, 1998 . NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1 . That the City commits to the Department to prepare a Traffic Impact Study following the completion of Shales Parkway and upon written request of the Department. Section 2 . That upon the completion of the Traffic Impact Study, the City shall submit same to the Department upon which the Department shall determine what geometric changes or signalization are warranted. Section 3 . That based on the Department' s determination, the City shall prepare plans for the improvement of the intersection and submit said plans to the Department for approval . Section 4 . That upon the Department' s approval, the City shall budget the funds to implement improvements . BE IT FURTHER RESOLVED that the commitments made by the City of Elgin shall remain valid only if the Department has issued a permit by April 15, 1998 . • /2gg*/*IL:„.
