RESOLUTION
AUTHORIZING EXECUTION OF LOCAL LAW ENFORCEMENT
BLOCK GRANT PROGRAM AGREEMENT WITH
CENTRO DE INFORMACION Y PROGRESO
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS, that Joyce A. Parker, City Manager, and Dolonna
Mecum, City Clerk, be and are hereby authorized and directed to
execute a Local Law Enforcement Block Grant Program Agreement
on behalf of the City of Elgin with Centro de Informacion y
Progreso for the Hispanic Intervention Program, a copy of which
is attached hereto and made a part hereof by reference.

AGREEMENT
LOCAL LAW ENFORCEMENT BLOCK GRANT PROGRAM
CENTRO DE INFORMACION Y PROGRESO
THIS AGREEMENT is made and entered into this /o7/f day of
July, 1998, by and between the CENTRO DE INFORMACION Y PROGRESO
OF ELGIN, an Illinois not-for-profit corporation, (hereinafter
referred to as "Subrecipient" ) and the CITY OF ELGIN, Illinois,
a municipal corporation (hereinafter referred to as "Grantee" ) .
WHEREAS, Grantee has applied for and received funds from
the United Stated Government pursuant to HR 728 Local Government
Law Enforcement Block Grant Act of 1995, (hereinafter referred
to as "Grant Funds" ) and
WHEREAS, the parties hereto have each determined it to be
in their best interests to enter into this agreement to
facilitate the utilization of such funds .
WHEREAS, Subrecipient provides services which contribute
to the reduction of crime and the improvement of public safety.
NOW, THEREFORE, in consideration of the mutual promises
and covenants contained herein, the sufficiency of which is
hereby acknowledged, the parties hereto hereby agree as
follows :
1 . Subrecipient will establish a program to control
crime among Spanish-speaking youth in cooperation with Grantee,

law enforcement personnel, and the courts hereinafter referred
to as "Program" ( letters of support are attached) .
2 . The program for at-risk families and youth shall be
offered in Spanish and shall contain at least the following
three phases .
Phase I
Referral by the police and courts
Evaluation of the family
Presentation of the program to the family
Phase II
Five week intensive services to the client/family
Week 1 . Evaluation of the family--individually and together
Referral to other Centro services : employment,
counseling, education and other assistance (e.g. ,
basic needs) .
Week 2 . Lesson on communication
Youth and parents separately
Youth and parents together--where are you heading?
Assuming responsibility.
Week 3 . Movie
How youth begin gang activity and results
Talk by former gang member and parent
Week 4 . Abuse--substance, physical, sexual
Effects of abuse on children
Breaking the cycle
Week 5 . Behavior management and youth
Friendships and their effects
Choosing and finding good friends .
Phase III
Three months of meetings with the family
Six bi-weekly lessons

a) Self-esteem--the lack of it, results, developing
self-esteem
b) Stress and its effects--stress factors, resolving
problems that lead to stressful situations, violence, substance
abuse (e.g. , overcrowding, unemployment marital problems.4

c) Analyzing misbehavior--molding the -sa-e without
breaking the spirit of the child
d) Analyzing children--different types (e.g. , compliant,
defiant, strong-willed)
e) Gangs--reasons youth join and results of gang
activities
Youths shall be evaluated and, if they continue in
gang activities, shall be taught methods/ways of stopping gang
involvement, of leaving the gang
f) Progress evaluation--at the end of the three months,
the family shall be evaluated and a letter sent to the court

3 . The process for referral and service/procedures shall L..
as follows :
a) The police receive a call involving a youth who has
committed a crime.
b) The youth appears before a judge or is referred to
Grantee or Grantee' s designee.
c) The judge or Grantee refers the client to
Subrecipient for five weeks of intensive services .
d) At the end of five weeks, the family and youth may
decide if they (a) wish to continue services at Centro or (b)

return to the court for review. Families and youths may return
to the court sooner if they discontinue services .
e) If the family decides to continue services, they
shall still be required to return to the judge/court after
three months and six months for review.
f) On a monthly basis, Centro shall send a letter to the
court (with a copy to Grantee or Grantee' s designee) noting the
progress that the youth and family are making. Subrecipient
shall comply with any lawful court requests, including, but not
limited to providing a progress report or addendum at any time.
g) Lack of attendance or disruption of the program by
the family shall result in dismissal from the program and a
letter to the court informing the court of the decision.
h) Subrecipient shall respond to any call from the
police/court/referral source within 24 hours .
i) The program shall be for the youth and his/her
family. The family as a unit shall receive individual and
group counseling.
j ) If the family decides to continue services, the
parents may attend Subrecipient' s monthly support group for as
long as they wish to attend. The youth shall be offered
part-time jobs, sports, activities, or educational
opportunities as may be available and appropriate.
k) Upon completion of the program, Subrecipient shall
send a report to the police/court/referral source.
4 . Grantee shall provide Subrecipient with Grant Funds
in an amount to be determined in the sole discretion of City
following the receipt of equipment bids .

5 . Funding provided to Subrecipient pursuant to this
agreement shall not exceed $30,000, and shall be used by
Subrecipient for a bilingual, bicultural counselor/service
coordinator/instructor, associated payroll taxes and benefits,
instructional supplies, mileage, and allocated management and
general expenses . Grantee shall provide payment upon the
submission or original bills with support documentation for the
services described herein.
6 . Subrecipient shall provide Grantee with reports not
less than once every three months, which reports shall contain,
but not be limited to, a specific accounting of all funds
expended pursuant to this agreement, and such other information
as may be required by Grantee at Grantee' s sole discretion.
7 . The terms of this agreement shall be severable. In
the event any of the terms or conditions of this agreement are
deemed to be void or otherwise unenforceable for any reason,
the remainder of this agreement shall remain in full force and
effect.
8 . This agreement shall be subject to and governed by
the laws of the State of Illinois . Venue for the resolution of
any disputes or the enforcement of any rights arising out of or
in connection with this agreement shall be in the Circuit Court
of Kane County, Illinois, unless jurisdiction shall be
exclusively federal as required by law.
9 . Subrecipient warrants that it shall conform to all
requirements of law, including but not limited to any and all
applicable federal or state statutes and regulations . In the
event Subrecipient fails to conform to such regulations and

statutes, Subrecipient shall refund all payments made to
Subrecipient by Grantee upon 30 days written notice. Such
refund shall not constitute or be construed as a waiver of any
rights otherwise available to Grantee by law.
10 . Subrecipient shall hold harmless and indemnify
Grantee from and against any and all suits, claims for damages,
causes of action, and any and all other liability, including
but not limited to reasonable attorney' s fees, arising out of
or resulting from Subrecipient' s negligent performance of this
agreement or failure to conform to any requirement of law or
regulation applicable to the subject matter of this agreement
or payment of funds associated therewith.
11 . This agreement shall not be construed as creating a
joint venture, partnership, employment or other agency
relationship between the parties hereto.
12 . This agreement shall terminate on ,
19 , upon 30 days written notice by Grantee, or upon
operation of law as may be mandated by federal or state law or
regulation.
