RESOLUTION
AUTHORIZING EXECUTION OF A GRANT AGREEMENT WITH THE
CHILDREN' S THEATRE OF ELGIN
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS, that Robert O. Malm, Interim City Manager, be and is
hereby authorized and directed to execute a Grant Agreement on
behalf of the City of Elgin with the Children ' s Theater of
Elgin for a $5 , 000 grant pursuant to the Cultural Arts
Commission Arts and Culture Grants Program, a copy of which is
attached hereto and made a part hereof by reference.

SUBJECT: Cultural Arts Commission Special
Project Granting Program ( 1998)
PURPOSE
The purpose of this memorandum is to provide the Mayor and
members of the City Council with information to consider
awarding the 1998 Arts Grants as recommended by the Cultural
Arts Commission.
BACKGROUND
The Cultural Arts Commission has been granting funds to local
arts groups for special projects for the last five years . The
purpose of the program is to broaden public access to the
arts, and to encourage organizations and individuals to be
more creative in artistic endeavors . This program is partial-
ly funded by a $5, 000 grant from the Illinois Arts Council .
Four organizations met the Commission' s criteria for funding.
The Commission proposes that the following grants be awarded:
ARTS ORGANIZATIONS
CHILDREN' S THEATRE OF ELGIN $5, 000 . 00
(For youth musical)
ELGIN CHILDREN' S CHORUS 3, 000 . 00
(For Voices workshop for 6th grade students )
ELGIN CHORAL UNION 5, 000 . 00
(Production of Dvorak' s "Requiem" )
ELGIN SYMPHONY ORCHESTRA 4, 750 . 00
(orchestra training for eight schools)
TOTAL: $17 , 750 . 00
COMMUNITY GROUPS/INTERESTED PERSONS CONTACTED
The Cultural Arts Commission, along with Tom Flanigan, Rise
Jones, and Lori Davy, served as the review panel.

FINANCIAL IMPACT
The City of Elgin funding would total $17 , 750 . Pending final
approval of the 1998 budget, sufficient dollars will be
available within the 1998 Cultural Arts Commission budget,
account number 010-1902-709-8010, to fund these grant awards .
LEGAL IMPACT
None .
ALTERNATIVES
None.
RECOMMENDATION
The recommendation is to award these grants as presented.

It is my pleasure to inform you that the Illinois Arts Council has
awarded you a grant of $5,000 from State funds for arts development
support, contingent on return of documents outlined below as soon as
possible but no later than January 1 , 1998. All documents must be
signed by Robert Maim as designated Authorizing Official . Failure to
meet this deadline will result in unconditional forfeiture of these
funds.
Organizations which receive an IAC grant are required to notify by
etter their state representative, senator and the Office of the
overnor as to the grant amount and the project it helps support.
COPIES OF THESE LETTERS MUST BE RETURNED WITH THE OTHER PAYMENT
DOCUMENTS DESCRIBED IN THE ENCLOSED MEMO.
Illinois Arts Council asks to be informed of any activity relating to
this proposal . Grantees should credit Illinois Arts Council in all
promotional material and public notices in the following manner:
"This program is partially supported by a grant from the Illinois
Arts Council , a state agency. " This recognition is essential to
educating audiences on the importance of public support for the arts.

ARTS AND CULTURE GRANTS PROGRAM
GRANT AGREEMENT
The City of Elgin and Children' s Theatre of Elgin agree as follows :
1 . The City of Elgin agrees to make a $5, 000 grant for a youth
musical , with Children' s Theatre of Elgin acting as fiscal agent,
for the following program:
For a youth musical provided by the Children' s Theatre of
Elgin $5, 000
2 . All monies granted for this program will be expended by GRANTEE
between January 1 , 1998 and December 31, 1998 . All monies awarded
must be expended.
3 . Grant monies will not be paid out more than 30 days prior to
start of the program. No funds will be paid to GRANTEE until the
City of Elgin has received the signed Grant Agreement.
4 . GRANTEE agrees that all funds received for this program will be
expended only for the program as described above. In the event
GRANTEE changes the program without the prior consent of the City
of Elgin; all grant funds shall be refunded to that City.
5 . GRANTEE agrees the credit will be given to the City of Elgin
and the Elgin Cultural Arts Commission on all public notices,
publicity, printed programs , public media and other applicable
materials . GRANTEE also agrees to supply the City of Elgin with
copies of the above-mentioned publicity.
6 . GRANTEE agrees to submit a Financial and Evaluation Report to
the City of Elgin on forms provided; within two weeks after the
termination of the program period.
7 . GRANTEE agrees upon request to make available to the City of
Elgin financial records for the year in which a grant was received
from that Council . The City of Elgin will be allowed to access to
financial documents that pertain to information stated in the
previously approved application for funding.
8 . GRANTEE agrees that no monies from this grant will be used for
any purchase of permanent equipment, capital improvements or con-
struction, or payment of previous year' s deficit.
9 . GRANTEE agrees that no person shall, on the grounds of race,
color, religion, national origin, sex, handicap, sexual preference,
participation in, be denied benefits of, or be otherwise subjected
to discrimination under any activity including employment, support-
ed in whole or in part by funds provided under this grant.
10 . GRANTEE does hereby agree agree to indemnify, save harmless ,
and defend the City of Elgin, its agents, servants and employees,
and each of them against and hold it and them harmless from any and
all lawsuits , claims , demands, liabilities, losses, and expenses
including, but not limited to, participants and spectators, or any
death at any time resulting from injury or any damage to any specta-
tors , or any death at any time resulting from injury or any damage
to any property which may arise or which may be alleged to have
arisen out of , or in connection with, the program as described in
Paragraph 1 and referred to in Paragraph 8 .
