HomeMy WebLinkAbout97-302 Resolution No. 97-302 RESOLUTION AUTHORIZING EXECUTION OF AN AGREEMENT TO CLOSE MUSEUM TO THE PUBLIC BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, that Robert O. Malm, Interim City Manager, and Dolonna Mecum, City Clerk, be and are hereby authorized and directed to execute an Agreement to Close Museum to the Public on behalf of the City of Elgin with the Elgin Area Historical Society, a copy of which is attached hereto and made a part hereof by reference. s/ Kevin Kelly Kevin Kelly, Mayor Presented: December 17 , 1997 Adopted: December 17 , 1997 Omnibus Vote: Yeas 7 Nays 0 At.test : s/ Do1onna Mecum 1)olonna Mecum, City Clerk AGREEMENT TO CLOSE MUSEUM TO THE PUBLIC WHEREAS, the CITY OF ELGIN, a municipal corporation, hereinafter called "Lessor" , and the ELGIN AREA HISTORICAL SOCIETY, a not-for-profit corporation, hereinafter called "Lessee" , have entered into a written agreement for the lease of certain property commonly known as the "Old Main" ; and WHEREAS, said agreement requires the Lessee to cause the museum to be open to the general public not less than twenty (20) hours per week; and WHEREAS, it is necessary and desirable to close the museum to the public for a period of two (2) months for the purpose of planning and developing new and improved displays . NOW, THEREFORE, it is hereby agreed by and between Lessor and Lessee that notwithstanding the requirements of the existing lease agreement, the museum may be closed to the public during the months of January and February, 1998. Malm, Interim City Manager SUBJECT: Historical Society Museum Request to Close for January and February of 1998 PURPOSE The purpose of this memorandum is to provide the Mayor and members of City Council with a request from the Elgin Area Historic Society Board of Directors to close the Historic Society Museum for January and February of 1998 to allow for new display development and improvement of existing displays . BACKGROUND The Elgin Area Historic Society currently operates a museum at the Old Main building located on Park Street under the terms of a 1993 lease agreement with the City of Elgin (see attached) . The lease agreement requires that the museum be open to the general public a minimum 20 hours per week. Attached is a November 10 request from Elgin Area Historic Society Board President Rachel Campbell requesting that the museum be closed during January and February of 1998 to allow for new display development and improvement of existing displays . The Corporation Counsel has reviewed this request and stated that an amendment by City Council to the agreement will be necessary in order to accommodate the request to close the museum. RECOMMENDATION It recommended that the City Council request staff to draft an amendment to the existing lease to accommodate closing of the museum for January and February, 1998 . Cu Dear Mr. Malm: .6.d 1 At their last meeting, the Elgin Area Historical Society Board of Directors voted to close the Historical Society Museum for the months of January and February, 1998. The rationale for this action is based on several considerations. We have begun a process of planning and developing new displays that will better tell Elgin's story. The process is a long and involved one that includes research and evaluation of the plan and of society's artifacts. This long term project will take several years to complete. By closing the museum for this two month period, we can direct our attention and energies to this project and begin our work to improve the museum's displays. During this time the museum will be available to groups who desire a tour of the facility. We believe it would be of great benefit to the Historical Society Museum, as well as for our potential visitors, to close the Museum so we can devote the necessary time it will take to carry out these plans. Because we have a contract with the city of Elgin we want to inform you of L/ our plans and, at the same time, ask that the city concur with these plans. Jentsch, Corporation Counsel SUBJECT: Historical Society Museum The agreement between the City and the Elgin Historical Society, a copy of which is attached, includes the following: "L. To cause the museum to be open to the general public not less than twenty (20) hours per week. Lessee shall have the right to establish reasonable admission fees to the museum. " Therefore it appears that in order to close for a period of two months, the agreement must be amended. Such an amendment would require action by the mayor and ouncil . emik EWJ nr Attachment r
