RESOLUTION
AUTHORIZING THE VACATING OF THE HOFFMAN RESUBDIVISION
TO FACILITATE THE FILING OF A TECHNICALLY AMENDED FINAL PLAT
OF THE HOFFMAN RESUBDIVISION
WHEREAS, the City Council of the City of Elgin approved
the final plat for the Hoffman Resubdivision on 8 October 1997
by Resolution No. 97-252; and
WHEREAS, the final plat for the Hoffman Resubdivision was
recorded in the Office of the Recorder of Deeds of Cook County
on 27 October. 1997 as Document No. 97805199; and
WHEREAS, the final plat for the Hoffman Resubdivision
contemplates roadway access to a state highway, to wit,
Illinois Route 19; and
WHEREAS, the final plat for the Hoffman Resubdivision
inadvertently omitted the requisite certification of approval
from the Illinois Department of Transportation with respect to
roadway access to a state highway required by Section 2 of the
Plat Act ( 765 ILCS 205/0 . 01 et seq. ) ; and
WHEREAS, the final plat for the Hoffman Resubdivision
dedicated to the Illinois Department of Transportation, rather
than conveyed to the Department with an attendant Plat of
Highway, as the Department required, a 279-foot by 15-foot
strip of land bordering Illinois Route 19 ; and
WHEREAS, the owner of the real property described in the
final plat for the Hoffman Resubdivision is seeking to correct
the technical deficiencies in the final plat; and
WHEREAS, the deficiencies the real property owner is
seeking to correct in the final plat for the Hoffman
Resubdivision will not result in any substantive change to the
resubdivision' s boundary lines, identification system for all
lots, blocks or buildings, or any other final plat requirements
set forth in Section 18 . 20 . 020 of the Elgin Municipal Code, as
previously approved by the City Council of the City of Elgin by
Resolution No. 97-252 .
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF ELGIN, ILLINOIS :
Section 1 . The Mayor of the City of Elgin is hereby
authorized to declare and vacate the subdivision known as the
Hoffman Resubdivision, recorded on 28 October 1997 as Document
No. 97805199 in the Office of the Recorded of Deeds of Cook
County, Illinois , and to execute any certificates or other
documentation attesting to the same.
Section 2 . The Mayor of the City of Elgin is hereby
authorized to execute the corrected final plat for the Hoffman
Resubdivision incorporating the certification of approval from
the Illinois Department of Transportation with respect to
roadway access to a state highway required by Section 2 of the
Plat Act ( 765 ILCS 205/0 . 01 et seq. ) and the conveyance of a
279- foot by 15-foot strip of land bordering Illinois Route 19
to the Illinois Department of Transportation with attendant
Plat of Highway.
Section 3 . That a certified copy of this resolution
together with certificate vacating the Hoffman Resubdivision,
recorded on 28 October 1997 as Document No. 97805199 in the
Office of the Recorded of Deeds of Cook County, Illinois, be
filed with the Office of the Recorder of Deeds of Cook County,
Illinois .
