The CITY does hereby engage the CONSULTANT, and the CONSULTANT hereby agrees to furnish certain professional Phase I and Phase II engineering services, described in Section 2. The services include the preparation of a Modified Categorical Exclusion Project Development Report for the 2.9 km of proposed bike trail in the City of Elgin, Illinois, hereinafter referred to as the "PROJECT". The services will be provided based upon the following terms and conditions: 1. INCORPORATION BY REFERENCE The 1990 Standard Agreement Provisions for Consultant Services of the Illinois Department of Transportation, hereinafter referred to as the "STANDARD PROVISIONS", are incorporated and made part of this AGREEMENT except as deleted or amended hereafter (References to the STANDARD PROVISIONS are shown in parentheses). 1.1 (SP 1) Definitions, as they pertain to the PROJECT, shall be set forth in Section 1 of the STANDARD PROVISIONS, amended to add the following: 1.1.1 IDOT -Department of Transportation, State of Illinois. 1.1.2 Chief of Environmental Science - The Chief of Environmental Science of MOT f:\admin\marktng\elgin\rte20\agreemnt.wp5 - 1 - 1.1.3 Director - shall be construed to mean the Park Development Coordinator, City of Elgin, Parks and Recreation Department. 1.1.4 Environmental Statement - A written statement containing an assessment of the anticipated significant, beneficial and detrimental effects which the PROJECT may have upon the human environment. 1.1.5 Categorical Exclusion - A written document in support of a determination that, should the proposed highway section improvement be constructed, the action will not induce significant, foreseeable alterations in land use, planned growth, development patterns, traffic volumes, travel patterns, or natural or cultural resources. 1.1.6 Section 4(f)Land-Any land from a public park, recreation area, wildlife and water fowl refuge or historic site which a transportation plan or project proposes to use. 1.1.7 Environmental Assessment-Any action that is not classified as a Categorical Exclusion and for which the environmental studies and early coordination indicate that the proposed action will not have a significant impact on the quality of the human environment. 1.1.8 Combined Report-Report that contains both the corridor location studies and the design location studies. A combined report is prepared for projects in which only the existing corridor is feasible. 1.2 (SP 1.17) Wherever the word DEPARTMENT is used, it shall be construed to mean the CITY, except that in the STANDARD PROVISIONS,the word DEPARTMENT shall also include IDOT in Subsections 2.12, 2.24, 2.31, 2.32 and Section 6, in its entirety. 1.3 (SP 2.41) The CONSULTANT shall invoice the CITY in a format acceptable to the CITY. \admin\mazktng\elgin\rte20\agreemnt.wp5 - 2 - 2. SCOPE OF WORK- PHASE 1 The CONSULTANT will perform or be responsible for the performance of the services outlined below. The PROJECT is anticipated to be a Categorical Exclusion Type II Action. Phase I Engineering will involve the preparation of a Modified Project Development Report (PDR). The CONSULTANT will perform or be responsible for the performance of the services outlined below. The engineering studies will be performed in accordance with IDOT's Bureau of Local Roads requirements for Local Agency Federal Aid Projects. a) Early Coordination: - Attend one (1) kick-off meeting with the CITY. b) Data Collection and Review: - Prepare a project and environmental photolog, conduct a site reconnaissance and determine existing land use. - Obtain existing utility atlases. - Obtain site/roadway plans. c) Field Survey: - Perform complete ground survey to locate topographic features, trees, and utilities. Cross Sections will be taken at 100m intervals. The ground survey work will be performed in accordance with Section 6.21 of the STANDARD PROVISIONS, except that State Plane Coordinates will not be established. The survey work will not be performed at the soccer field area but instead will be supplied by the CITY. f:\admin\marktng\elgin\rte20\agreemnt.wp5 - 3 - d) Preliminary Design Studies: - Determine the design criteria such as path width, minimum roadway separation, grade, etc. - Prepare the 1:500 base sheets with a double plan-profile format. - Prepare the cross section sheets with the sections being plotted at 100 m intervals. - Design the horizontal alignment based on the AASHTO design criteria. - Design the vertical geometry of the proposed path. - Perform a cross section analysis plotting the proposed improvement and determining the construction limits. - Draft the proposed improvement on the plan-profile and cross section sheets. - Determine the right-of-way and easement requirements along the length of the project. e) Preliminary Soils Investigation - Walk the length of the project and perform a field reconnaissance. - In areas where potential unstable subgrade is observed, a tile probe or a static cone penetrometer may be used to determine approximately how soft and deep the unsuitable layer may be and record the findings. - Write a brief report summarizing observations and findings. f) Hydraulic and Drainage Studies: - Identifying and reviewing the existing drainage patterns. - Determine locations of drainage crossings. g) Environmental Issues Review - Perform Tree identification of impacted trees - Perform site walk-through - Review the preferred plan and document anticipated impacts regarding: c. 5 - 4 - f:\adaun\nazktng\elgm\rte20\agreemn wp • Traffic noise • Air quality • Construction Noise • Socio-economic changes • Archaeological/Historical/Cultural Resources • Affects on adjacent land use • Ecology • Hazardous Waste • Storage Tanks - Preparation of a 4(f) statement will not be required. h) Quantity& Cost Estimate: - Perform preliminary quantity take-offs. - Prepare a preliminary construction cost estimate. i) Pre-final Report: - Prepare text for pre-final modified project report. - Prepare report exhibits • Location Map • Vicinity Map • Proposed Typical Sections • Proposed Alignmen on Plan-Profile Sheets j) Final Report: - Revise the text. - Revise the exhibits. - Revise the quantities and cost estimate. f:\admin\marktng\elgin\rte20\agreemnt.wp5 - 5 - k) Coordination Meetings: - Attend one review meeting with the Client. - Attend one FHWA/IDOT Coordination Meeting. 1) Administration - Project planning, cost control, scheduling, invoicing, budgeting, agency coordination and correspondence. 2.1 SCOPE OF WORK- PHASE II a) Preparation of contract plans, specifications, and estimates, including complete bike trail plan and profiles, typical sections, cross sections, miscellaneous details and all other work required to complete the project. Plans will be prepared in Metric Units only. b) Sections 3, 4, 5 and 7 of the STANDARD PROVISIONS are deleted. The design and preparation of contract plans for the PROJECT shall be done as set forth in Section 6 of the STANDARD PROVISIONS amended as follows. c) (S P 6.1) The Bureau Chief responsible for review of contract plan work is the Parks Development Coordinator for the City of Elgin Parks and Recreation Department. d) (S P 6.21) Delete. e) (S P 6.22 a& b) Delete. The CONSULTANT will not be required to tie the centerline to existing horizontal control or to establish State Plane Coordinate Values. This work will not be required for the PROJECT. i) (S P 6.30) Delete. Plans shall be arranged and numbered in accordance with Section 8-001.02 of the Design Manual. Plans will be prepared in Metric Units only. The CONSULTANT will enter unit prices and accumulate costs. m) (S P 6.47) Delete. n) (S P 6.48) Delete. f:\admin\nazktng\elgin\rte20\agreemnt.wp5 - 7 - o) (S P 6.49) Delete. 2.1 The CONSULTANT shall exclusively furnish to the CITY, all reports, data or other information prepared, obtained or assembled by him under this AGREEMENT, unless otherwise directed by the CITY. 3. The CITY will be responsible for the following items: 3.1 Furnish all presently available survey data and information including standard details and standard specifications adopted by the CITY and other available data, useful to the work being done by the CONSULTANT. 4. PROJECT SCHEDULE The CONSULTANT shall commence work on Phase I within five (5) calendar days after the date of Authority to Proceed. The work will be completed and according to the schedule presented on Exhibit E, subject to the variability of time requirements for agency reviews that is beyond the control of the CONSULTANT and the CITY. For purposes of Section 5.2, the PROJECT completion date for Phase I Engineering is January 1998, and Phase II Engineering is March 1998 for a contract letting of May 1998. 5. PRIME COMPENSATION 5.1 Subject to an Upper Limit of Compensation of$34,453.00, the CONSULTANT shall receive as full payment for completing the Phase I and II work required of him under this AGREEMENT; reimbursement of his eligible actual costs in accordance with Section 2.45 of the STANDARD PROVISIONS, plus a Fixed Amount of$4,060.00. The Upper Limit of Compensation and Fixed Amount are a result of the attached Exhibit D, Cost Estimate of Consultant's Services for Phase I and for Phase II. The retainage provisions contained in Section 2.42 of the STANDARD PROVISIONS shall not apply to Direct Non-Salary Costs. The attached Exhibits A, B, and C are to be used as set forth in Section 2.42 of the STANDARD PROVISIONS. Invoices shall be prepared in accordance with Section 2.41. f:\admin\marktng\elgin\rte20\agreemnt.wp5 - 8 - 5.2 The Prime Compensation may be increased or decreased by subsequent agreement between the contractual and approving parties if there is a major change in the scope, character or complexity of the Work. Prime Compensation and Specific Rates for Extra Work may be adjusted in accordance with Section 2.21 of the STANDARD PROVISIONS, if the duration of the work in any phase extends more than six months beyond the date of completion stated in Section 4 of this AGREEMENT, due to no fault of the CONSULTANT. 5.3 In all instances where the CITY shall request specific services of the CONSULTANT, the CONSULTANT shall indicate to the CITY whether or not the work shall be considered Extra Work. When requested by the CITY, the CONSULTANT shall prepare and submit a cost estimate for such Extra Work. In the event the CONSULTANT, upon written order from the CITY, is required to perform Extra Work, he shall, in addition to the Prime Compensation, receive payment for such Extra Work on the following basis: Subject to a pre-agreed Upper Limit of Compensation for each item of Extra Work, the CONSULTANT shall be paid at the specified hourly rate of pay for each class of employee as listed in Exhibit "A" for the actual time the CONSULTANT directly utilizes each such employee on the Extra Work, plus the CONSULTANT's payroll burden and overhead costs as listed in Exhibits B and C, plus actual expenses for transportation, subsistence, and electronic computer service incidental to the Extra Work. Any other expenses incurred incidental to the Extra Work shall be considered to be overhead costs. 5.4 The CONSULTANT certifies that he/she and his/her principals have not been barred from signing this agreement as a result of violation of section 33 E-3 and 33 E-4 of the Criminal Code of 1961 (Chapter 38 of the Illinois Revised Statutes). f:\admin\marktng\elgin\rte20\agreemnt.wp5 - 9 - In consideration of these premises,the parties hereto agree as set forth in these pages and numbered 1 through inclusive. Malm, Interim City Manager SUBJECT: Approval of Contract with Dames and Moore, Inc. for Engineering Services for C.M.A.Q. U.S. 20 Bike Path PURPOSE The purpose of this memorandum is to provide the Mayor and members of the City Council with information to considdr awarding a contract to Dames and Moore for engineering services for the design of the Bike Path at the Sports Complex to the east property line of Elgin Community College. BACKGROUND On June 8, 1994, the City Council authorized an application to the Illinois Department of Transportation (I . D.O.T. ) for construction of a bike path from the Elgin Sports Complex soccer fields to Elgin Community College . This section of bike path is Phase I of a three phase project to link with a future bike path connecting the Fox River Trail east to the proposed Otter Creek Trail west. The purpose of the bike path is to provide recreational opportunities, add an additional feature for users of the Sports Complex, and to improve the infrastructure for alternative means of transportation. The City was notified on October 16, 1995 of the approved grant and funds were available in 1996, However, with other major construction at the Sports Complex proceeding, the bike path work is appropriate at this time. Since C.M.A.Q. (Congestion, Mitigation and Air Quality Pro- gram) funds are being allocated through I .D.O.T. for this project by way of Federal Highway Funds, the format for the contract is based on I .D.O.T. requirements . Fifteen engineering firms were invited to submit proposals . Two firms submitted proposals (Hampton, Lenzini, and Renwick and Dames and Moore) and were interviewed by staff. Dames and Moore was selected using I .D.O.T. Federal-Aid Procedures for Local Highway Improvements procedures to select the best qualified firm. The selected firm' s price was negotiated in consultation with I .D.O.T. and Dames and Moore. V Dames and Moore/C.M.A.Q. August 21, 1997 Page 2 COMMUNITY GROUPS/INTERESTED PERSONS CONTACTED Elgin Community College VAL FINANCIAL IMPACT The grant is an 80/20 matching funds program. The Federal match will be $161, 552 and the City match equals $40, 388 for a project total of $201, 940. The C.M.A.Q. program requires the participating agency to hire the engineering firm and pay the fee up front. Eighty percent of the fee is then reimbursed by the C.M.A.Q. Program. All other expenses will be paid initially by the C.M.A.Q. program and the City will be billed for our 20% share. Dames and Moore fee is $34, 453 .
