BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, - •ILLINOIS, that pursuant to Elgin Municipal Code Section 5 .02 . 020B( 6 ) the City Council hereby finds that an exception to the requirements of the procurement ordinance is necessary and in the best interest of the city; and BE IT FURTHER RESOLVED that Robert O. Malm, Interim City Manager, and Dolonna Mecum, City Clerk, be and are hereby authorized and directed to execute Amendment No. 2 to an Agreement on behalf of the City of Elgin with Crawford, Murphy & Tilly, Inc . for engineering services for the central business district roadway lighting and sidewalk rehabilitation project, a copy of which is attached hereto and made a part hereof by reference. s/ Kevin Kelly Kevin Kelly, Mayor Presented: May 14 , 1997 Adopted: May 14 , 1997 Omnibus Vote: Yeas 7 Nays 0 Attest: s/ Dolonna Mecum Dolonna Mecum, City Clerk r CITY OF ELGIN,ILLINOIS CENTRAL BUSINESS DISTRICT ROADWAY LIGHTING AND SIDEWALK REHABILITATION PROJECT ENGINEERING SERVICES AGREEMENT AMENDMENT NO. 2 This Amendment No. 1 entered into this /- 1/l_ day of`lk ldL , 1997, by and between the City of Elgin, an Illinois Municipal Corporation(hereinafter referred to a "CITY"), and Crawford, Murphy & Tilly,Inc.,Consulting Engineers,(herein after referred to as"ENGINEER"),shall modify that Agreement dated February 29, 1996,whereby the ENGINEER was engaged by CITY to perform certain professional services in connection with the preparation of plans, specifications, estimates of cost, and construction related engineering services for the Central Business District - Roadway Lighting and Sidewalk Rehabilitation Project(hereinafter referred to as"PROJECT"). Whereas the CITY desires to include the payments to the ENGINEER under paragraph IV C of the Agreement in connection with preparation of plans, specifications and estimate of cost for the rehabilitation of the roadway lighting and sidewalks along Highland Avenue between State Street and Center Street and replace the lighting on Spring Street between Highland Avenue and East Chicago Street as part of the Project. In response to these additional services,certain revisions must be made to the Agreement. In compliance, therefore,the terms and conditions of the agreement are modified as specifically set out below. All other parts of the Agreement remain unchanged. SECTION IV of the AGREEMENT is hereby amended to replace paragraph C.and add paragraph G and H. C. Inclusive of paragraph IV A,IV B,IV D, IV E,and IV F,this agreement shall be in the total amount not to exceed $208,000.00. G. For services provided in connection with the preparation of plans, specifications and estimate of cost for the rehabilitation of the roadway lighting and sidewalks along Highland Avenue between State Street and Center Street,and replace the lighting on Spring Street between Highland Avenue and East Chicago Street, The ENGINEER shall be reimbursed in accordance with the Schedule of Hourly Charges, dated January 1997, included as Attachment D, with the total fee not to exceed $60,000.00 regardless of the actual cost incurred by the ENGINEER unless substantial modification to the scope of work are authorized by the CITY through a change order or amendment. H. Attachment A, Scope of Services of the contract will be supplemented by the following tasks which correspond to the attached estimate of levels of effort and associated cost worksheet labeled Attachment D: 1. The project limits have been revised to include the preparation of plans, specification and cost estimate to rehabilitate the roadway lighting and sidewalks along Highland Avenue between State Street and Center Street,and replace the lighting on Spring Street between Highland Avenue and East Chicago Street. 2. Malm, Interim City Manager SUBJECT: Central Business District Street Lights and Sidewalk Agreement for Engineering Services on Highland Avenue PURPOSE The purpose of the memorandum is to provide the Mayor and members of the City Council with information to consider Amendment #2 to an agreement with Crawford, Murphy and Tilly, Inc. , for the preparation of plans, specifications and cost estimates for expanding the CBD Lighting project to Highland Avenue. BACKGROUND The engineering of the Central Business District Highland Avenue Lighting Project is included with the 1997 Capital Improvement Program. The project limits include Highland Avenue from Illinois Route 31 to Center Street and Spring Street from Chicago Street to Highland Avenue as shown on Exhibit A. The project will include the installation of approximately 40 ornamental street lights and removal and replacement of sidewalk. Construction is anticipated during 1998 . There are 10 known sidewalk vaults within the project limits . Sidewalk vaults will be filled whenever feasible. The engineer and the City, with the cooperation of Debbie Nier and the New Century Partnership for Elgin (NCPE) , will work with each property owner to be sure inconvenience is minimized and an efficient work schedule can be realized. The subject Amendment #2 to the agreement is for engineering services only. Construction inspection services will be negotiated with the engineer when the construction plans are completed. The proposed agreement will be amended to include construction service-related fees and presented to the City Council concurrently with the contract award for actual construction. The proposed Amendment #2 is attached as Exhibit B. CMT' s original Agreement and Amendment #1 are included as Exhibit C. CBD Street Lights and Sidewalk Agreement April 16 , 1997 Page 2 As noted in Exhibit C, the Engineering cost for Chicago Street was $86 ,422 . The original agreement covered approximately 2, 500 feet of street including Chicago Street, N. Grove Avenue, Douglas Avenue and DuPage Court. At $86 ,422 , the cost per foot is $34 . 60 per foot. The cost of Amendment #2, as explained further in the financial impact, is $60, 000 . Amendment #2 covers approximately 2,000 feet of street including the aforementioned streets . At $60,000, the cost per foot of Amendment #2 is $30 per foot. The procurement ordinance allows an existing contract to be expanded instead of again seeking competitive proposals . A finding by two-thirds vote of City Council is necessary if the City Council chooses to proceed with this option. The finding must explain why the exception is in the best interest of the City. The proposed amendment with CMT is a superior option to requesting proposals from other Engineering firms for the following reasons : 1) CMT now has extensive background dealing within the City' s problems in downtown Elgin including vaults , old utilities, lack of parking and heavy traffic . 2 ) CMT has established a relationship with the New Century Partnership for Elgin. 3) The proposal system would delay the completion of the engineering until the 1st quarter of 1998 . This would make construction budgeting difficult. 4 ) CMT provided Engineering services for the Chicago St. CBD Lighting project. COMMUNITY GROUPS/INTERESTED PERSONS CONTACTED New Century Partnership of Elgin. DIFINANCIAL IMPACT Amendment #2 is in the amount of $60,000 . Adequate funds exists to cover this amendment. The City budgeted $180, 000 from the Riverboat Lease Fund (276-0000-791 . 93-80 project #334001) for the CBD Lighting project. Of this $180, 000 budget, $120, 000 was committed to the construction of street lights and sidewalk replacement on Douglas Avenue and the remaining, $60,000 was to be utilized for engineering design of the Highland Avenue portion of the project. If authorized, Amendment #2 would increase the engineering service agreement with CMT by a not- to-exceed amount of $60, 000 bringing the total amount to $208, 000 . Malm, Interim City Manager SUBJECT: Central Business District (CBD) Street Light and Sidewalk Project Acceptance and Change Order No. 1 PURPOSE The purpose of this memorandum is to provide the Mayor and members of the City Council with information to consider acceptance of the subject street lighting and sidewalk im- provement project . BACKGROUND The CBD lighting and sidewalk improvements are included in the 1996 budget in the amount of $724, 000 . 00 . The City Council awarded the project to A-Lamp Concrete on October 9, 1996 in the amount of $736, 855 . 00 . A sketch showing the limits of the project is included as Attachment A. The project included the removal and replacement of the existing street lights and deteriorated sidewalk. Twenty-nine sidewalk vaults located within the project limits were closed. Twenty-two thousand square feet of sidewalk was replaced. The final pay estimate and Change Order No. 1 are included as Attachment B. COMMUNITY GROUPS/INTERESTED PERSONS CONTACTED None .
