Helwig, City Manager, and Dolonna Mecum, City Clerk, be and are hereby authorized and directed to execute an agreement on behalf of the City' of Elgin with Elgin Bethesda Church of God in Christ for the enforcement and regulation of parking in designated fire lanes, a copy of which is attached hereto and made a part hereof by reference. s/ Kevin Kelly Kevin Kelly, Mayor Presented: March 13, 1996 Adopted: March 13, 1996 Omnibus Vote: Yeas 7 Nays 0 Attest: s/ Dolonna Mecum Dolonna Mecum, City Clerk it r AGREEMENT PURSUANT TO SECTION 11-209 . 1 OF THE ILLINOIS MOTOR VEHICLE CODE WHEREAS, the City of Elgin has authority to regulate traffic and parking on semipublic streets within designated fire lanes; and WHEREAS, the Elgin Bethesda Church of God in Christ is the governing body for the operation and maintenance of certain common area, including the private streets and designated fire lanes contained within its Property located within the corporate limits of the City of Elgin, most specifically those designated fire lanes as delineated on the attached Exhibit A; and WHEREAS, the Elgin Bethesda Church of God in Christ has authority pursuant to its Declaration to regulate the use and operation of parking areas; and is desirous of having the City of Elgin enforce and regulate the parking of vehicles in designated fire lanes, and further desires to enter into such a contract for such purposes . WITNESSETH: That for and in consideration of the mutual promises and covenants herein contained and by authority of the applicable Illinois statutes, Elgin Bethesda Church of God in Christ, owner and operator of the aforementioned Property, and the City of Elgin, agree as follows : 1) That fire lanes are hereby established within those portions of the Elgin Bethesda Church of God in Christ Property as shown on Exhibit A attached hereto and made a part of this agreement. 2 ) That Elgin Bethesda Church of God in Christ shall erect, install, and maintain appropriate signs designating such fire lanes and reading "No Parking Fire Lane" with the warning "Tow Zone" attached. In the alternative, the Elgin Bethesda Church of God in Christ agrees to pay all costs incurred by the City of Elgin in purchasing, erecting, and maintaining any parking regulation signs necessary, required, or desirable to be placed on the property in connection with designated fire lanes . 3) That the Elgin Bethesda Church of God in Christ shall cause that portion of its property designated as fire lanes to be painted with bright yellow lines and the words "Fire Lane No Parking" and shall cause said paint to be maintained in a clear and readable condition. 4 ) That the presence of any vehicle, including motorcycles, either standing or parking in such a manner as to block or obstruct a fire lane is prohibited. 5) That the City of Elgin shall cause vehicles violating the fire lane regulations to be removed and stored pending payment by the owner of the costs in connection with said removal and storage. E1in IE. 1_,(ff, Agenda Item No. L.... 1(!1.11;-,ii 9 February 6, 1996 TO: Mayor and Members of the City Council FROM: Richard Helwig, City Manager SUBJECT: Request for Fire Lane Designation PURPOSE The purpose of this memorandum is to provide the Mayor and City Council with background information concerning a request by Reverend James Marks for the designation of a fire lane in a certain location at the Elgin Bethesda Church of God in Christ at 454 Hickory Street. 111 BACKGROUND A request has been received from Reverend James Marks to have a selected area of the Elgin Bethesda Church of God in Christ property designated as a fire lane. The church has experienced problems with vehicles parking in the circular drive located immediately in front of the main entrance to the building, making ingress and egress of emer- gency equipment difficult if not impossible at times . Designation of the fire lane and a signed agreement between the City and the church will enable the City to enforce on- street parking regulations on the private street located on the church property. Maps indicating the proposed location and proposed agreement are attached for your reference. The Police and Fire Departments have reviewed the proposed location of the fire lane at the church property and find the designation to be satisfactory. FINANCIAL IMPACT The church will be responsible for all costs associated with of items re lative to the purchase, erection and maintenance the fire lane designation. LEGAL IMPACT None. RECOMMENDATION Staff recommends that the proposed fire lane be so designated and that staff be directed to prepare a resolution authoriz- ing the execution of the proposed enforcement agreement .
