Whereas, the Agreement Provisions include the material testing services under paragraph 1j. of the Agreement and construction observation services under paragraph 1.k. of the Agreement, and Whereas, the Agreement Provisions provide for the inclusion of fees for the performance of material testing services and construction observation services by an amendment to the Agreement under paragraph 10 of the Agreement. Therefore, it is necessary to expand the upper limit of compensation to be paid under the contract to cover the additional services. Whereas, the adjusted upper limit of compensation will exceed the amended contract value by not more than $120.785.00; and Now, therefore, the parties hereto do mutually agree to amend the contract as follows: Page 1 of 3 . . . The total amount payable for services provided as stated in paragraph 1.k. of this AGREEMENT shall not exceed $105'485.00 for 105 calendar days of engineering services provided under this AGREEMENT. The date of the first calendar day for this AGREEMENT shall be the date services are first requested by the LA. In the event SECTION construction is suspended as recorded on the "Report of Starting and Completion Date," the calendar days for this AGREEMENT will also be suspended for a like amount of time. In the event the engineering services are not completed upon expiration of the stated calendar days and remaining funds are not sufficient to complete the SECTION, adjustments in total compensation to the ENGINEER shall be determined through negotiation between the parties of this AGREEMENT and concurred in by the STATE. 12. The "Construction Engineering Negotiation Meeting" attachment will be considered an integral part of this amended AGREEMENT. Save as to these provisions, all other terms and conditions of said contract are to remain in full force and effect. Helwig, City Manager SUBJECT: Motorola Access Roadway Amendment No. 3 with Hampton, Lenzini and Renwick, Inc. PURPOSE The purpose of the memorandum is to provide the Mayor and members of the City Council with information to consider amending an agreement with Hampton, Lenzini and Renwick, Inc. t (HLR) for the construction related engineering services associated with the construction of the Motorola Access Roadway in the amount of $120,785 . 00. BACKGROUND On January 24, 1996, the City Council authorized an agreement with HLR for the preparation of plans, specifications, and estimates for the Motorola access roadway. On April 24 , 1996, , the City Council authorized Amendment No. 1 (property plats along IL Route 72) to the above agreement. On July 10, 1996, the City Council authorized Amendment No. 2 (revised plats due to changes to roadway alignment) . Copies of the City Council memorandum and agreements are attached as Exhibit A. On October'. 21, 1996, bids will be opened for the Motorola access road project. Amendment No. 3 with HLR will increase the fee of the original agreement to add construction engineering-related services to monitor this project. Such services are detailed in Amendment No. 3, and generally include: coordination of the work, on-site full time inspection, review of the work, rejection of defective work, testing of materials, monitoring of the work schedule, conducting weekly progress meetings, record keeping, payment reviews, change order reviews, etc. COMMUNITY GROUPS/INTERESTED PERSONS CONTACTED None. Motorola Access Roadway Amendment No. 3 October 15, 1996 Page 2 FINANCIAL IMPACT The City has budgeted $1. 9 million for the purchase of rights-of-way ($950,000) and construction ($950,000) of the Motorola access roadway from the 1996 bond issue under Account 396-1000-795. 93-80, Project No. 339554 . Amendment No. 3 in the not-to-exceed amount of $120,785 .00 will bring the total of this agreement to the not-to-exceed amount of $224 ,295.00 . A copy of the Amendment No. 3 is attached as Exhibit B.
