RESOLUTION
ACCEPTING A GRANT OF LANDSCAPE EASEMENT
(Elgin Corrugated Box Company)
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS, that it hereby accepts a Grant of Landscape Easement
for the property legally described as follows :
Of a 15 . 00 foot wide landscape easement over
part of Lots 33 through 38, inclusive, described as
follows : The northeasterly 15 . 00 feet of Lot 33,
the northerly 15 . 00 feet of Lots 34 through 36,
inclusive, and the northeasterly 15 . 00 feet of Lots
37 and 38, all being in Fox Bluff Corporate Center,
being a subdivision of part of Section 27 , Township
41 North, Range 8 East of the Third Principal
Meridian. Being situated in the City of Elgin, Kane
County, Illinois .
BE IT FURTHER RESOLVED that the City Clerk is hereby
authorized and directed to cause the Grant of Landscape
Easement to be recorded in the office of the Recorder of Deeds
of Kane County, Illinois .

GRANT OF LANDSCAPE EASEMENT
This indenture, made and entered into this 9th day
of October , 1996, by and between ELGIN CORRUGATED BOX
COMPANY, an Illinois corporation (hereinafter referred to as
"Grantor" ) , CITY OF ELGIN, an Illinois municipal corporation
(hereinafter referred to as the "City" ) and the FOX BLUFF
CORPORATE CENTER PROPERTY OWNERS ASSOCIATION, an Illinois
corporation (hereinafter referred to as the "Association" ) .
WITNESSETH:
That for and in consideration of the sum of Ten
Dollars ($10 . 00) , in hand paid, and other good and valuable
consideration, the receipt and sufficiency of which is hereby
acknowledged, Grantor does hereby grant and convey to the City
and the Association a permanent easement for the construction
and maintenance of a berm and landscaping in, upon and over
the fifteen ( 15) foot wide portion of Lots 33 through 38 of
the Fox Bluff Corporate Center, legally described and shown on
the plat of easement attached hereto and made a part hereof by
this reference as Exhibit A.
This grant of easement is executed, delivered and
granted upon the following conditions:
1. The Grantor shall not erect any permanent
structure on the permanent easement described herein.
2 . The City shall be responsible the initial
construction and placement of any berm and landscaping on the

easement premises . The City agrees to indemnify the Grantor
and the Association for any damages or claims arising directly
as a result of the City' s work within the easement premises
during the installation of the berm and landscaping materials .
3. The Association shall be responsible for all
maintenance of the berm and landscaping subsequent to the
initial installation thereof by the City. The Association
agrees to indemnify the Grantor and the City for any damages
or claims arising directly as a result of the Association' s
maintenance of the berm or landscaping within the easement
premises .
The terms and conditions of this permanent easement
shall be binding upon the Grantor, the City and the
Association and upon their heirs, executors, successors and
assigns . ,

SUBJECT: Landscape Easement on Property
Owned by Elgin Corrugated Box Company
PURPOSE
The purpose of this memorandum is to present information to
the Mayor and members of the City Council regarding accep-
tance of a landscape easement from Elgin Corrugated Box
Company.
BACKGROUND
The real estate agreement between Elgin Corrugated Box Compa-
ny and the City of Elgin provided for the installation of
landscaping along the northerly boundary of the Elgin Corru-
gated Box Company. When the plans and specifications for the
extension of Crispin Drive were developed, it was determined
that an appropriate landscape area could not be developed
without obtaining an easement from Elgin Corrugated Box
Company or incurring a great expense associated with the
relocation of the Crispin Drive right-of-way. Elgin Corrugat-
ed Box Company has agreed to grant a 15-foot easement along
the northern boundary of its property. Maintenance of the
landscape easement will be the responsibility of the Property
Owners Association.
COMMUNITY GROUPS/INTERESTED PERSONS CONTACTED
This matter was reviewed and recommended for approval by the
Fox Bluff Corporate Center Property Owners Association at its
August 29 board meeting.
FINANCIAL IMPACT
There is no charge for the easement.
LEGAL IMPACT
A resolution accepting the proposed easement is required.

ALTERNATIVES
Provide for the landscaping within the available right-of-way.
RECOMMENDATION
Authorize the execution of the landscape easement between
Elgin Corrugated Box Company and the City of Elgin and the
Fox Bluff Corporate Center Property Owners Association.
