HomeMy WebLinkAbout96-227 Resolution No. 96-227 RESOLUTION AUTHORIZING EXECUTION OF AMENDMENT NO. 1 TO AN AGREEMENT WITH HAMPTON, LENZINI AND RENWICK, INC. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, that Kevin Kelly, Mayor, and Dolonna Mecum, City Clerk, be and are hereby authorized and directed to execute Amendment No. 1 to an Agreement on behalf of the City of Elgin with Hampton, Lenzini and Renwick, Inc. for the preparation of plats required to secure rights-of-way for the Route 72 access roadway project, a copy of which is attached hereto and made a part hereof by reference. s/ Kevin Kelly Kevin Kelly, Mayor Presented: July 24, 1996 Adopted: July 24 , 1996 Omnibus Vote: Yeas 6 Nays 0 Attest : s/ Dolonna Mecum Dolonna Mecum, City Clerk ^ ~ AGREEMENT Route: Motorola Access Road Right-of-Way Plats Original Contract Value: $8'845.00 Adjusted Contract Value: $17'590.00 AMENDMENT NO. 1 Whereas, the City of Elgin heretofore entered into a contract dated February 19, 1996' with Hampton, Lenzini and Renwick, Inc; and Whereas, due to changes in the proposed road alignment to meet request by owners of property to be crossed by the road; and Whereas, the foregoing changes were not anticipated and were not provided for in the original agreement; and Therefore, it is necessary to expand the upper limit of compensation to be paid under the contract to cover preparation of new plats and legal descriptions caused by the changes. Whereas, the adjusted upper limit of compensation will exceed the amended contract value by not more than $7'745.00; and Now, therefore, the parties hereto do mutually agree as follows: On page 2, change the not-to-exceed value in paragraph |V.A. from "nine thousand eight hundred forty-five ($9.845.0O)^ 10 "seventeen thousand five hundred ninety ($17,590.00)." Helwig, City Manager SUBJECT: Route 72 Access Roadway: Agreement for Preparation of Plats for Rights-of-Way Acquisition-Amendment No. 1 PURPOSE The purpose of the memorandum is to provide the Mayor and members of the City Council with information to consider r amending an agreement with Hampton, Lenzini & Renwick, Inc . (HLR) for the preparation of property plats required to secure rights-of-way for the Motorola Access Roadway project in the amount of $7, 745 . BACKGROUND On February 14, 1996, City Council authorized an Agreement with HLR for the preparation of property plats necessary for the construction of the Motorola Access Roadway. When the original agreement was approved on February 14 , 1996 , the proposed roadway was to follow an alignment along the western property line of three properties ( See Exhibit A) for the original and revised alignments . Negotiations for the acquisition of the rights-of-way for the subject roadway resulted with the revised location. HLR has completed the plats for the original alignment. Amendment No . 1 adds additional staff hours to prepare plats for the revised alignment . COMMUNITY GROUPS/INTERESTED PERSONS CONTACTED None. • • Route 72 Access Roadway July 2 , 1996 tom- Page 2 FINANCIAL IMPACT The City has $1 . 9 million budgeted for the purchase of rights-of-way ( $950, 000) and construction of the Motorola Access Roadway from the 1996 bond issue under Account No. 396-1000-795 . 93-80, Project No. 339554 . Amendment No. 1 in the not-to-exceed amount of $7 ,745 will bring the total agreement to the not-to-exceed amount of $17 , 590. A copy of Amendment No. 1 is attached as Exhibit B. LEGAL IMPACT None. ALTERNATIVES None . RECOMMENDATION It is recommended that City Council authorize the Mayor to execute Amendment No. 1 with HLR in the amount not-to-exceed $7 , 745 bringing the total agreement amount to $17 , 590 .
