RESOLUTION
AUTHORIZING EXECUTION OF AMENDMENT NO. 1 TO AN AGREEMENT WITH
CRAWFORD, MURPHY & TILLY, INC . FOR THE MCLEAN BOULEVARD PROJECT
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS, that Richard B. Helwig, City Manager, and Dolonna
Mecum, City Clerk, be and are hereby authorized and directed
to execute Amendment No . 1 to an Agreement on behalf of the
City of Elgin with Crawford, Murphy & Tilly, Inc . for the
McLean Boulevard - 1996 Rehabilitation Project, a copy of
which is attached hereto and made a part hereof by reference .

ENGINEERING SERVICES AGREEMENT AMENDMENT NO. 1
This Amendment No. 1 entered into this //A1-- day of , 1996, by and between
the City of Elgin, an Illinois Municipal Corporation (herein fter eferred to as "CITY") and
Crawford, Murphy & Tilly, Inc., Consulting Engineers, (hereinafter referred to as
"ENGINEER"), shall modify that Agreement dated February 29, 1996, whereby the ENGINEER
was engaged by CITY to perform certain professional services in connection with the preparation
of plans, specifications, estimates of cost, and construction related engineering services for the:
McLean Boulevard - 1996 Rehabilitation Project; Larkin Avenue to Kaskaskia Avenue
(hereinafter referred to as "PROJECT").
Whereas the payment to the ENGINEER for construction engineering related services was not
included in the Agreement, and,
Whereas the CITY desires to include the payments to the ENGINEER under paragraph IV C of
the Agreement in connection with the construction administration, construction observation and
quality control of the construction phase of the PROJECT.
In response to these additional services, certain revisions must be made to the Agreement. In
compliance, therefore, the terms and conditions of the agreement are modified as specifically
set out below. All other parts of the Agreement remain unchanged.
SECTION IV of the AGREEMENT is hereby amended to replace paragraph C. and add
paragraph D, E and F.
C. Inclusive of paragraph IV A, IV B and IV E, this agreement shall be in the total amount
not to exceed $82,146.00.
D. For services provided in connection with the construction administration, construction
observation, and quality control of the construction phase of the PROJECT, the ENGINEER
shall be reimbursed in accordance with the Schedule of Hourly Charges, dated January 1996,
included as Attachment C of the original agreement, with the total fee not to exceed $51,098.00
regardless of the actual cost incurred by the ENGINEER unless substantial modification to the
scope of work are authorized by the CITY through a change order or amendment.

E. The compensation set forth in Paragraph C above does not include any engineering
service after the original construction contract completion date for the PROJECT. In the even'
the CITY approves and authorizes an extension of time for the Contractor to complete th=
construction work, the compensation for engineering services set forth in Paragraph C shall b=
increased for the additional services required for the ENGINEER. In the event the Contracto
does not complete the construction work within the contract completion time including an
extensions thereof granted by the CITY, the CITY shall pay the ENGINEER extra compensatio
at the ENGINEERS' hourly rates until the PROJECT construction work has been accepted b
the CITY.
F. The compensation set forth in Paragraph C does not include any engineering service
regarding warranty work by the Contractor after the PROJECT, or parts thereof, has bee
accepted for operational use by the CITY. In the event that warranty work is required of th=
Contractor, the CITY shall pay the ENGINEER extra compensation at the ENGINEERS' hourl
rates to assist the CITY in enforcing the Contractor's guaranty to repair or replace defectiv=
work within the warranty time stated in the Construction Contract Documents for th-
PROJECT.
Attachment A, Scope of Services of the original contract will be supplemented by the followin
tasks which correspond to the attached estimate of levels of effort and associated cost worksheet:
Construction Phase
1. Schedule preconstruction conference.
2. Attend and facilitate preconstruction conference.
3. Coordinate schedule with contractor
4. Perform initial construction layout (Subsequent layout, if necessary, will be th=
contractor's responsibility).
5. Full time resident engineer duties per the City requirements of Constructio
Services including:
a. Inspection Daily Reports
b. Weekly Reports
c. Monthly Progress Reports
d. Construction Observation
e. Quantity and Material Record
f. Preparation of Partial Pay Estimates

g. Preparation of Extra Work and Change Orders, as necessary
h. Facilitate Final Inspection
I. Facilitate Weekly Progress/Coordination Meetings
j. Material Testing
k. Review Shop Drawings
6. Record Drawing Surveys/Submit Record Drawings/Project Close-out
7. Plan Preparation of Permanent Traffic Signals and Roadway Lighting at McLean
Boulevard/Highland Avenue Intersection
a. Prepare preliminary plans, (2 sheets) specifications, and cost estimate for
the Traffic Signals and Roadway Lighting
b. Review plans with City personnel
c. Prepare final plans, (2 sheets) specifications, and cost estimate for the
Traffic Signals and Roadway Lighting
d. Submit load letter to Commonwealth Edison
All other provisions of the AGREEMENT shall remain in full force and effect.

IN WITNESS WHEREOF, the undersigned have placed their hands and seals upon and executed
this Agreement in triplicate as though each copy hereof was an original and that there are no
other oral agreements that have not been reduced to writing in this statement.

CONSTRUCTION SERVICES
•
i . Liaison and Contract Control
Act as the CITY' s representative with duties .
responsibilities and limitations of authority as assigned
in the Construction Contract Documents, and advise and
confer with CITY officials during construction and issue
the CITY' S authorized instructions to the Contractor.
Assist the Contractor in understanding the intent of the
Construction Contract Documents . Serve as the City' s
liaison with other local agencies such as utilit '
companies, businesses , CITY ' S on-site representative, etc .
2 . On-Site Review of Work
Conduct continuous and full-time on-site observations ot
the work in progress to determine that the PROJECT iS
Proceeding in accordance with the Construction Contract
Documents and that completed work will conform to the
requirements of the Construction Contract Documents . •
Instruct Contractor to correct any work believed to be
unsatisfactory, faulty or defective, not conforming to the
requirements of the Construction Contract Documents, or
does not meet the requirements of any inspections, tests
or approval required to be made and report same to the
CITY; and advise CITY of action taken or if any special
testing or inspection will be required .
Verify that tests are conducted as required by the
Construction Contract Documents and in the presence of the
required personnel, and that Contractors maintain and
submit adequate records thereof; observe, record, and
report to the CITY appropriate details relative to the test
procedures .
Perform or cause to have performed as applicable, all
required field tests such as concrete tests, soil
compaction tests and . ensure such tests are made alls
specified. Analyze the results of all field and laboratory
tests to determine the suitability compliance with the
requirements of the Construction Contract Documents .
Accompany visiting inspectors representing public or other
agencies having jurisdiction over the project, record the
outcome of these inspections and report to the CITY.
Stake-out construction lines and grades and assist the
Contractor with interpretation of the Drawings and

3 . Contractor Succestions and Recuests
Consider and evaluate suggestions and requests fo
modifications in drawings and specifications which may be
submitted by the Contractor and make recommendations to the
CITY with any time or cost implications for final decision. 11
4 . Shop Drawincs
Develop shop drawing submittal requirements and assist
Contractor in development of submittal schedules . Review
and monitor compliance with submittal schedules .
Review and approve shop drawings and samples, the resultS
of tests and inspections and other data which anV
Contractor is required to submit, but only for conformance
with the design concept of the project and compliance with
the information given in the Construction Contract
Documents . Such review shall not be construed as relieving
the Contractor of the responsibility to meet requirements
of the Construction Contract Documents . Determine the
acceptability of substitute materials and equipment
proposed by the Contractor; and receive and review ( for
general content as required by . the specifications)
maintenance and operating instructions, guarantees, bondS
and certificates of inspection which are to be assembled by
the Contractor(s) in accordance with the Construction
Contract Documents .
Record and maintain a shop drawing submittal and approval
log and notify the Contractor whenever submittals are
lacking or untimely.
5 . Schedules
Prepare a final Primavera type construction schedule with
the participation of the Contractor and obtain the
Contractor's approval of , the construction schedule. 311,
schedule of shop drawing Submissions, and schedule of
values shall also be prepared by the Contractor and
approved by the engineer.

Work with the Contractor to maintain a workable updated
Primavera type construction schedule that is maintained and
monitored weekly as construction progresses as required by
the Construction Contract Documents . Report progress and
schedule deviations and corrective measures proposed by the
Contractor to the CITY.

6 . Job Meetings
Conductweekly progress meetings with all parties a
. - required by the Construction Contract Documents to revieW
construction progress, design interpretations and overall
progress . Prepare, maintain, and circulate copies of
minutes thereof. Arrange a schedule of on-site job work
meetings with the General Contractor and Subcontractors tO
review day-to-day requirements and problems. Prepare
maintain, and circulate copies of minutes thereof.
7 . Contract Administration and Records
Handle all day-to-day Contract Administration and
associated correspondence . Maintain at the job site orderlY
files for correspondence, reports of job conferences, shoP
drawings , and samples submissions , reproductions of
original Construction Contract Documents including all
addenda, change orders, field orders , additional drawings
issued subsequent to the execution of the Construction
Contract Documents, progress reports, and other project
related documents .
8 . Reports
Furnish written reports to the CITY on a biweekly basis ot
progress of the work and the Contractor's compliance with
the approved progress schedule and schedule of shoo drawing
submissions .
9 . Contractor Pay Requests
Review the Contractor ' s requests for payments aS
construction work progresses , and advise the CITY of thF
amounts due and payable to the Contractor in accordance
with the terms of the Construction Contract Documents .
10 . Change Orders
•
Perform evaluation of proposed Construction Contract Change
Orders and submit recommendation for approval or denial to
the CITY. Prepare Construction Contract Change Orders when
authorized by the CITY.
11 . Government Policies
'Review the Contractor's compliance with governmental
mandated programs . Compliance with OSHA requirements and
general safety provisions will be reviewed by an
independent safety officer retained by the Contractor 4s
part of the construction work . The safety officer will
visit the job site periodically and will submit written
reports to the CITY, Contractor, and ENGINEER.

12 . Record Drawings
Prepare record drawings which show field measured
dimensions of the completed construction work which the
ENGINEERS consider significant and provide the CITY with
one set of reproducible record drawings and all equipment
. operation and maintenance manuals within ninety (90) days
of the PROJECT completion.

13 . Final Completion
Conduct a final inspection of the PROJECT with the CITY and
the Contractor, and prepare and give to the Contractor a
final punch list. Issue an opinion of satisfactory
completion for acceptance of the PROJECT , by the CITY.
. Process the Contractor' s final request for payment .

SUBJECT: Amendment No. 1 to an Agreement with
Crawford, Murphy and Tilly, Inc.
PURPOSE
The purpose of the memorandum is to provide the Mayor and
members of the City Council with information to consider
Amendment No. 1 to an agreement with Crawford, Murphy and
Tilly, Inc. (CMT) which will add the fee for construction
related engineering and inspection services to the McLean
Boulevard construction project.

BACKGROUND
At its meeting of February 28, 1996 , City Council authorized
an agreement with CMT, for the preparation of plans,
specifications, estimates, bidding and construction
engineering services, for the North McLean Boulevard Roadway
Improvements .
When we entered into the subject agreement with CMT, it was
anticipated that the Engineering staff would be increasing by
one engineer and two engineering inspectors . The proposed
additional staffing would have allowed the Engineering
Division to accomplish the inspection in-house. Because this
staff is not yet in-place, we are turning to CMT to provide
construction inspection services .
An amendment to CMT' s agreement has been prepared and is
included as Attachment A. CMT' s current Agreement and the
Council Memorandum is included as Attachment B for your
information. The construction of the North McLean Boulevard
roadway improvements is on the agenda for award by City
Council on June 26 , 1996 .

FINANCIAL IMPACT
The Amendment No. 1 is in the amount of $51, 098 . 00, and is
based upon a construction period from July 8, 1996 to October
4 , 1996 .
Payment to the engineer will be on an hourly not-to-exceed
basis. A fee calculation schedule is included in Attachment
A.
This Amendment No. 1 will be funded from Account No.
275-0000-791 . 93-80, Project No. 339546 . Obligations to-date
are as follows :
