HomeMy WebLinkAbout95-231 Resolution No. 95-231 RESOLUTION AUTHORIZING EXECUTION OF A PURCHASE OF SERVICE AGREEMENT WITH CENTRO DE INFORMACION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, that Kevin Kelly, Mayor, and Dolonna Mecum, City Clerk, be and are hereby authorized and directed to execute a purchase of service agreement with Centro de Informacion to provide reimbursement for moving expenses for Casa Linda residents on behalf of the City of Elgin, a copy of which is attached hereto and made a part hereof by reference. s/ Kevin Kelly Kevin Kelly, Mayor Presented: November 8, 1995 Adopted: November 8, 1995 Vote: Yeas 6 Nays 0 Attest: s/ Dolonna Mecum Dolonna Mecum, City Clerk t • PURCHASE OF SERVICE AGREEMENT THIS AGREEMENT is made and entered into this 8th day of November, 1995, by and between the City of Elgin, Illinois, an Illinois municipal corporation, (hereinafter referred to as the "City" ) , and Centro De Informacion, an Illinois not-for-profit corporation, (hereinafter referred to as the "Provider" ) . For and in consideration of the mutual promises and covenants contained herein, and other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the parties hereto hereby agree as follows : 1 . That the City shall pay Provider the lump sum amount of Thirty-Two Thousand Dollars ( $32, 000 . 00) for the following program: Contacting all tenants and occupants of the Casa Linda apartment complex with a written notice in English and in Spanish which advises said tenants and occupants of the City of Elgin' s pending acquisition of the Casa Linda property and providing lawful tenants of the property a allowance for moving expenses . 2 . That the Provider shall immediately upon execution of this agreement provide written notifications in English and in Spanish to all tenants and occupants of the Casa Linda apartment complex that the City of Elgin has entered into an agreement to acquire the property and that all tenants and occupants must vacate the Casa Linda apartment complex property on or before November 30, 1995 . The notice Provider shall give to tenants and occupants of the Casa Linda apartment complex shall also inform all such tenants and occupants that the City of Elgin is funding a program whereby lawful tenants and occupants of the property may be entitled to a $400 . 00 per apartment allowance for moving expenses . 3 . That no more than one $400 . 00 reimbursement for moving expenses shall be provided for any one apartment unit. The reimbursement shall be available only to lawful tenants of the property meeting the following qualifications : ( 1) the person and all other occupants of the subject apartment unit must vacate the property on or before November 30, 1995, unless the City agrees in writing to a reimbursement to a person who vacates the property thereafter; (2 ) the person must have legal status in the United States; ( 3) the person' s name must appear on an eligibility list to be developed by the City based upon utility and owners records; (4) the person must be ineligible for assistance under the Elgin Township Assistance Program or has received less than $400 . 00 assistance from the Elgin Township Assistance Program being administered by the Provider, it being the intention of this agreement to provide assistance hereunder to persons not receiving funds under the Elgin Township Assistance Program or receiving less than $400 . 00 from such program. Persons receiving funds from the Elgin Township Assistance Program shall be eligible for reimbursement under the City' s reimbursement program only up to the total amount of $400 . 00 �, ,'` from both programs . Prior to the issuance of any funds to any individuals the City must issue to the Provider a written , consent form executed by the City authorizing the disbursement after confirmation that the person receiving the reimbursement funds meets the eligibility criteria as provided for herein and the City has confirmed through its Department of Code Administration that the subject apartment unit has been completed vacated and is no longer occupied by any person. 4 . That all funds received for this program shall be expended only for the program as described above. In the event Provider changes the program without the written consent of the City of Elgin, all funds shall be refunded to the City. 5 . That all monies granted for this program shall be expended by Provider before December 31, 1995 . 6 . That Provider shall submit to the City on or before January 31, 1996, a report of the activities of the programs described herein and the actual expenditures made for said programs . Provider shall reimburse to the City any unexpended funds, including but not limited to unexpended funds as a result of vacant units, units for which no reimbursement has been sought or units for which no lawful tenants or occupants can be properly identified. 7 . That Provider shall upon request make available to the City financial documents for the year for which this grant was received. 8 . That no monies shall be used for any purchase of permanent equipment, capital improvements or construction, payment of previous years deficit, activities outside of the state geographic boundary or subsidy for an individual ' s academic study. 9 . That no person shall be denied participation in the reimbursements described herein or the benefits of the programs described in paragraph 1 on the grounds of race, color, religion, national origin, sex or handicap. 10 . That this agreement shall not be construed to create an employment, joint venture or partnership agreement between the parties hereto. Helwig, City Manager SUBJECT: Purchase of Service Agreement with Centro de Informacion to Provide Moving Allowance for Casa Linda Residents PURPOSE The purpose of this memorandum is to provide the Mayor and members of the City Council with information concerning a moving allowance payment program to residents of the Casa Linda apartment complex. BACKGROUND In accordance with the court-approved settlement agreement, the Casa Linda property owners served the Casa Linda tenants with bilingual eviction notices requiring the premises to be vacated by November 30, 1995 . Approximately 80 dwelling units were affected by the eviction notice . The City Council approved, in concept, a program for defray- ing the tenants ' moving expenses . The program will be adminis- tered through Elgin Township and Centro de Informacion. The program will provide one-time payments of up to $400 for each dwelling unit upon receiving confirmation that the unit has been vacated. . The City will be entering into a Purchase of Service Agree- ment (PSA) with Centro de Informacion in which the City will make a lump sum payment in the amount of $32 , 000 ( 80 units @ $400/unit) . Centro will then disburse the funds after con- firming a dwelling unit has been vacated. Any remaining funds will be refunded to the City. Purchase of Service Agreement November 1, 1995 Page 2 Concerns were raised that tenants with outstanding arrest warrants might benefit from this grant program. The City will confirm that any tenant applying for assistance does not have an outstanding arrest warrant. The police department has determined there are 105 outstanding arrest warrants for persons having addresses in the Casa Linda complex. However, only 23 of those warrants were issued during the past two years . Moreover, of the 23, eight were issued for Class A misdemeanors and five for felonies . The police department continues to attempt serving the warrants . Earlier in the week, ten warrants were served but eight of the defendants had moved with no forwarding address, one had a bad address, and two were no answer. COMMUNITY GROUPS/INTERESTED PERSONS CONTACTED There has been ongoing cooperation between Centro de Information, Elgin Township, and the City. FINANCIAL IMPACT The $32 , 000 payment could be accommodated within thet $wag 2 . 2 million amount (account number 275-0000-791-93 . 36 ) originally budgeted for the acquisition/demolition of Casa Linda .
