RESOLUTION
AUTHORIZING EXECUTION OF A CONFIRMATION OF ORDER FOR
SPECIAL CONSTRUCTION SERVICE WITH AMERITECH
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS, that Richard B. Helwig, City Manager, be and is
hereby authorized and directed to execute a Confirmation of
Order for Special Construction Service on behalf of the City
of Elgin with Ameritech for placement of fiber-optic
facilities between the law enforcement facility and Ameritech,
a copy of which is attached hereto and made a part hereof by
reference.

CONFIRMATION OF ORDER FOR
SPECIAL CONSTRUCTION SERVICE

This confirms an order placed with Ameritech (The Company) by City of Elgin(The Customer)
located at 151 Douglas, Elgin, Illinois, for special construction service pursuant to Tariff ICC
No. 5, Part 1, Section 8, on file with the Illinois Commerce Commission.
Special Construction includes the temporary, expedited, or specially routed or configured
placement or rearrangement of facilities on the central office side of the Network Point of
Presence (NETPOP) or the establishment of an Additional Point of Presence (APOP). Such
facilities are used to provide telecommunications service to the Customer's premises and remain
the property of the Company.
With regard to Special Construction service established in fulfillment of this confirmed order,the
following apply:
A. Special Construction work requested by Customer:
Placement of fiber-optic facilities from the customer location to the Elgin Central
Office in order to provide local loop diversity.
This description of work is produced at the Customer's direction at the time that this
Confirmation of Order is signed, and the rates quoted herein are based on this description.
Customer requested changes in the work to be performed will not be accepted by the
Company unless a subsequent Confirmation of Order has been established to cover the
revised work description.
B. The Customer has selected the single one time payment option, for a term of five (5) years, in the
amount of$12,50000 for the services described in Paragraph A.
The above mentioned rate is contingent upon the Customer committing to a 5 year contract
for three (3) Ameritech Optinet DS1 circuits terminated at 151 Douglas, Elgin.
C. No portion of either a single one time payment or Initial Non-recurring Charge (INC)will
be refunded.
Ameritech has entered into agreements with certain independent parties to act as Authorized
Representatives in the sale of Ameritech products and services. These Authorized
Representatives may, in addition to Ameritech products and services, offer their own line of
products and services under separate agreements. The evaluation, selection and performance of
these non-Ameritech products, and integration thereof, should be done independently of
Ameritech's offerings, and Ameritech makes no representatives or warranties with respect to such
products or their suitability for use with special Construction service.
It is understood that the tariff on file with the Illinois Commerce Commission provides that in the
event that the Customer cancels this order prior to establishment of service, the Company shall
be reimbursed by the Customer for costs incurred.
All terms and conditions of the Special Construction service offering are set forth in the
applicable above mentioned tariff, which fully determines the rights and obligations of the
Customer and Ameritech. No representations or agreements.either written or oral. shall alter or
in any way affect these rights or obligations, In the event of a conflict or discrepancy between
the provisions of this confirmed order and the provisions of the tariff,the provisions of the tariff
shall govern.

be due on the next scheduled bill date after actual install_
