RESOLUTION
ESTABLISHING MORATORIUM ON THE ISSUANCE OF LIQUOR LICENSES
WHEREAS, the regulation of the sale of alcoholic
beverages is intimately related to the public health, safety,
comfort and welfare; and
WHEREAS, Article VII of the Illinois Constitution, 1970,
includes the protection of the public health, safety, morals
and welfare among the government and affairs that home rule
units may regulate; and
WHEREAS, the City of Elgin is a home rule unit within the
meaning of the Constitution of Illinois, 1970; and
WHEREAS, the City of Elgin has experienced rapid and
substantial growth; and
WHEREAS, Chapter 6 . 06 of the Elgin Municipal Code, 1976 ,
providing for the regulation of alcoholic liquor dealers has
not been comprehensively reviewed since prior to the
recodification of the Elgin Municipal Code in 1976 ; and
WHEREAS, recent growth and changed conditions require
that the City of Elgin' s regulation of alcoholic liquor
dealers be comprehensively reviewed and revised and amended as
the best interests of the public may require; and
WHEREAS, the City Council has heretofore determined that
a study and review of Chapter 6 . 06 relating to alcoholic
liquor dealers, be undertaken; and
WHEREAS, it is in the best interest of the City of Elgin
and in furtherance of the public health, safety and welfare
that no new licenses for alcoholic liquor sales be issued
during the pendency of the city' s review and study of
Chapter 6 . 06 .
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF ELGIN, ILLINOIS, that it hereby declares and directs a
moratorium on the issuance of new liquor licenses for a period
of sixty (60) days so as to permit a study and review and
consideration of amendments to Chapter 6 . 06 relating to
alcoholic liquor dealers .
BE IT FURTHER RESOLVED that the moratorium hereby
established shall apply to the issuance of any new license
other than Class G, I , K, 0, extended hours and exterior sales
permits as currently provided in Chapter 6 . 06 of the Elgin
Municipal Code, 1976, as amended.
