RESOLUTION
DISAPPROVING AND OBJECTING TO LITTLE CITY FOUNDATION
GROUP HOME AT 2050 ROYAL BOULEVARD, ELGIN, ILLINOIS
WHEREAS, the Illinois Development Finance Authority Act
provides that one of the conditions which must be met before
bonds may be issued by the Illinois Development Finance
Authority for a subject project is that the Illinois
Development Finance Authority must notify a municipality with
planning and subdivision control jurisdiction over a proposed
site so as to allow the municipality to within forty-five (45)
days thereafter to approve or disapprove of the proposed
industrial project; and
WHEREAS, the City of Elgin has received correspondence
dated July 17 , 1995, from the Illinois Development Finance
Authority advising the City of a proposed group home to be
established by the Little City Foundation at 2050 Royal
Boulevard, Elgin, Illinois; and
WHEREAS, the attorneys for the Little City Foundation
have since advised the City of Elgin that due to an apparent
conflict with the City' s zoning ordinance that the Little City
Foundation has invoked a contingency in its real estate
contract to purchase 2050 Royal Boulevard and that Little City
Foundation was no longer pursuing the acquisition and
development of this property; and
WHEREAS, as a result of the proposed development' s
apparent conflict with the City' s zoning ordinance and Little
City Foundation having advised the City that it was no longer
pursuing the acquisition and development of the subject
property, the City Council of the City of Elgin has determined
to notify the Illinois Development Finance Authority of its
objection to the proposed development.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF ELGIN, ILLINOIS that the City of Elgin does hereby
disapprove and object to the proposed group home project by
Little City Foundation at 2050 Royal Boulevard, Elgin,
Illinois . The City Manager is directed to cause a certified
copy of this resolution to be sent by registered or certified
mail to the Illinois Development Finance Authority.

SUBJECT: Little City Foundation Proposed Acquisition and
Development of 2050 Royal Boulevard
PURPOSE
To advise the City Council, of a proposed development by the
Little City Foundation and to request formal City Council
action with respect to same.
BACKGROUND
• The city has received correspondence dated July 17, 1995,
from the Illinois Development Finance Authority advising the
city of a proposed group home to be established by the Little
City Foundation at 2050 Royal Boulevard.
The Illinois Development Finance Authority Act provides that
one of the conditions which must be met before bonds may be
issued by the Illinois Development Finance Authority for a
subject property is that the Development Finance Authority
must notify a municipality with planning and subdivision
control jurisdiction over a proposed site so as to allow the
municipality to approve or disapprove of the proposed
project. The municipality has 45 days from the date of no-
tice to act on a proposed project.
The property in question at 2050 Royal Boulevard is a single
family residence. The proposed development for the property
-,•-:. was to house four developmentally challenged adults with some
;professional staffing at the property. The city's zoning
: -ordinance requires distance setbacks between such develop-
.,-ments and further requires that these types of developments
-.-:; be dispersed throughout the different neighborhoods of the
:city. The location at 2050 Royal Boulevard would be in viola-
. tion of the dispersion requirement as the subject neighbor-
hood already has an existing family residential care facility
. within the neighborhood and there are other neighborhoods in
which no residential care facilities are located. Based upon
this conflict with the city's zoning ordinance, the attorneys
for the Little City Foundation have advised the city they are
no longer pursuing the acquisition and development of the
property.

RECOMMENDATION
It is recommended that as a result of the proposed develop-
ment's apparent conflict with the city's zoning ordinance and
Little City Foundation having advised the city that it was no
longer pursuing the acquisition and development of the sub-
ject property, that the City Council pass a resolution disap-
proving and objecting to the proposed development and that
the Illinois Development Finance Authority be notified of
same.

Following is the pertinent provision of Section 6.1 of the Illinois Development Finance
Authority Act, 20 ILCS 3505/1 et. seq. (1992); Illinois Revised Statutes 1991, ch. 48,
par. 850.01 et. seq., which describes one of the conditions that must be met before
bonds (the statutory definition of which includes other indebtedness) may be issued
by the Authority:
The Authority shall not issue any bonds relating to the financing of an
industrial project located within the planning and subdivision control
jurisdiction of any municipality unless: (1) notice, including a
description of the proposed project and the financing therefor, is
submitted to the corporate authorities of such municipality; and (2)

such corporate authorities, within 45 days after mailing of the notice,
have failed to notify the Authority that the municipality has adopted a
resolution disapproving the industrial project or have notified the
Authority that the municipality has adopted a resolution approving the
industrial project.
Please be advised that the corporate authorities of , Illinois, have 45 days after the
mailing date of this letter to adopt either of the aforesaid resolutions. If the Authority
has not been notified of the adoption of any such resolution within 45 days, it will
assume that the corporate authorities have no objections to this project.
Please send notification of the adoption of an approving or disapproving resolution,
and a certified copy of the pertinent resolution by registered or certified mail to:
