WHEREAS, this Amendment will provide the appropriate adjustments; and WHEREAS, the adjusted maximum amount will exceed the contract value by not more than $26,218.42; and WHEREAS, the undersigned determined that this Amendment is in the best interest of the Local Agency and is authorized by law. NOW, THEREFORE, the parties hereto do mutually agree as follows: Page 1 of 2 Under THE LA AGREES, the first and second sentences of paragraph 4.d. on page 6 of the Construction Engineering Services Agreement for Federal Participation shall be revised to read: The ENGINEER shall be paid a fixed fee (lump sum) of $33,996.27 to cover profit only. The total amount payable, including actual cost, fixed fee and contingencies, shall not exceed $280,490.51 for 990 calendar days of engineering services provided under this AGREEMENT. Exhibits D and E, are revised to indicate adjusted hours and costs (Attachments #1 and #2). Save as to these provisions, all other terms and conditions of said contract are to remain in full force and effect. Rev. Stat., ch. 127, par. 152.311). The Drug Free Workplace Act, effective January 1, 1992, requires that no grantee or contractor shall receive a grant or be considered for the purposes of being awarded a contract for the procurement of any property or services from the State unless that grantee or contractor has certified to the State that the grantee or contractor will provide a drug free workplace. False certification or violation of the certification may result in sanctions including, but not limited to, suspension of contract or grant payments, termination of the contract or grant and debarment of contracting or grant opportunities with the State for at least one (1) year but not more than five years. For the purpose of this certification, "grantee" or "contractor" means a corporation, partnership or other entity with twenty-five (25) or more employees at the time of issuing the grant, or a department, division or other unit thereof, directly responsible for the specific performance under a contract or grant of $5,000 or more from the State. 1. Publishing a statement: a. Notifying employees that the unlawful manufacture, distribution, dispensing, possession or use of a controlled substance, including cannabis, is prohibited in the grantee's or contractor's workplace. b. Specifying the actions that will be taken against employees for violations of such prohibition. c. Notifying the employee that, as a condition of employment on such contract or grant, the employee will: (1) abide by the terms of the statement; and (2) notify the employer of any criminal drug statute conviction for a violation occurring in the workplace no later than five (5) days after such conviction. 2. Establishing a drug free awareness program to inform employees about: a. the dangers of drug abuse in the workplace; b. the grantee's or contractor's policy of maintaining a drug free workplace; c. any available drug counseling, rehabilitation and employee assistance programs; and d. the penalties that may be imposed upon an employee for drug violations. 3. Providing a copy of the statement required by subparagraph 1 to each employee engaged in the performance of the contract or grant and to post the statement in a prominent place in the workplace. 4. Notifying the contracting or granting agency within ten (10) days after receiving notice under part (2) of paragraph c of subsection 1 above from an employee or otherwise receiving actual notice of such conviction. 5. Imposing a sanction on, or requiring the satisfactory participation in a drug abuse assistance or rehabilitation program by any employee who is so convicted, as required by Section 5 of the Drug Free Workplace Act. 6. Assisting employees in selecting a course of action in the event drug counseling, treatment and rehabilitation is required and indicating that a trained referral team is in place. 7. Making a good faith effort to continue to maintain a drug free workplace through implementation of the Drug Free Workplace Act. As discussed, PSI's billing is in excess of the original estimate. We reviewed what occurred on this project with a focus on the subgrade problem and the great amount of time which we were required to monitor and make recommendations regarding removal and replacement of the poor subgrade soils. Due to the large additional amount of removal and replacement, our services were required substantially more than originally anticipated and in addition we also tested a large amount of pavement cores for thickness and density. This also was not part of our estimate but was later required by I.D.O.T. The account balance is $5,117.50 and breaks down as follows: 42 Core Densities at $35.00/each = $1470.00; 88.5 Hours for Senior Engineering Technician for Subgrade at $35.00/hour = $3097.50; and 11 Hours for Project Engineer at $50.00/hour = $550.00. • If you have any further questions regarding this matter, please feel free to contact me at your convenience. As discussed, I had met on October 28, 1993 with Mr. Joseph Evers of the City of Elgin Engineering Department, at which time we discussed P.S.I. billing in excess of the original estimate. We reviewed what occurred on this project with a focus on the subgrade problem and the great amount of time which we were required to monitor and make recommendations regarding removal and replacement of the poor subgrade soils. Due to the large additional amount of removal and replacement, our services were required substantially more than originally anticipated and in addition we also tested a large amount of pavement cores for thickness and density. This also was not part of our estimate but was later required by I.D.O.T. In our proposal estimate for this project, we had estimated 90 hours of technician time for subgrade soil inspection, but due to the poor subgrade soil found on this site, we were required on the site for 199 technician hours, in order to direct the contractor on removal of unsuitable soil. These additional hours resulted in $3815.00 of additional billing. In addition to this, we had no cost estimate in our porposal for the core density tests later required. We performed density tests on 42 asphalt cores which resulted in an additional 1545.00 in cost. Our account balance shows that $5116.85 is outstanding and in light of the unanticipated problems on this site, Mr. Evers agreed that the extra costs were justified and agreed to pay them. Helwig, City Manager SUBJECT: Big Timber Road Improvements Amendment to Construction Engineering Services Agreement PURPOSE This memorandum will provide the Mayor and members of the City Council with information necessary to consider an amendment to the Construction Engineering Services agreement for Big Timber improvements . BACKGROUND The City of Elgin entered into an agreement with Kane County and the Illinois Department of Transportation on October 23, 1991 . The agreement defined the responsibilities of each . party for improving Big Timber Road from McLean Boulevard to RaAiall Road. The City' s responsibility included providing the construction engineering services . To provide these services, the City entered into a Construction Engineering Services Agreement with Hampton, Lenzini and Renwick on March 11, 1992 . The original construction engineering services agreement was based upon 210 calendar days, 6,201 man-hours of work effort and a project completion date of June 30, 1993 . The project was substantially completed July 21, 1993, with traffic signal work being completed on December 28, 1993 . The project extended beyond the June 30 completion date to July 21 because of the delays in receiving several traffic signal items, additional excavation of poor soils, additional pavement patching and additional material testing. The extension to December 28 was due to delays in receiving the traffic signal mast arms for the Randall/Big Timber intersection. After December 28, 1993 the only remaining item to be completed was the installation of the Radio Interconnect Interface Unit for all traffic signals on the Big Timber Road improvement project. Mayor and Members of City Council May 3, 1995 Page 2 The Radio Interconnect Interface Unit item, a signal communication device, is not critical for the daily operation of the signals . However this item is costly and staff was unwilling to lose the State 's and County's cost participation in this item. In August 1994 , after months of discussion with all parties including the manufacturer, it was determined that this item is no longer available and that the item would be deleted from the contract. In August of 1994 , the Contractor and the Engineer were directed to close-out the project. These delays (receiving the traffic signal equipment and the need for additional excavation, pavement patching and material inspection) were all unforeseeable at the time of , project letting. Because of the project construction extending beyond the originally anticipated completion date of June 30, 1993, the Engineer incurred an additional 780 calendar days and 421 man-hours of work effort. COMMUNITY GROUPS/INTERESTED PERSONS CONTACTED The State of Illinois has reviewed and concurs with the amendment ( letter attached) . FINANCIAL IMPACT The amount of the original agreement totalled $254 , 272 . 09 and 210 calendar days . This amendment will add $26,218 . 42 to the original agreement amount and increase the calendar days by 780 days for a final fee of $280,490 . 51 and 990 calendar days - of engineering services . In accordance with the original agreement, the responsibility for cost of construction engineering services is shared 75 percent State, 18 . 75 percent County and 6 .25 City. This amendment will increase the City' s share by $1,638 . 65 for a total share of $17 , 530 . 66 . Per the agreement the City will pay the full amount and- invoice the State and the County. LEGAL IMPACT The original agreement allows for additional engineering to be negotiated. Mayor and Members of City Council May 3, 1995 Page 3 RECOMMENDATION It is recommended that the City Council authorize the execution of the Amendment No. 1 for the Agreement for Consultant Services and direct staff to prepare the ne cessary Y resolution. The ultimate cost to the City of Elgin for this Amendment No. 1 is $1, 638 . 65 . After execution, the agreement will be sent to IDOT for approval .
