HomeMy WebLinkAbout94-84 Resolution No. 94-84 RESOLUTION AUTHORIZING EXECUTION OF A GRANT AGREEMENT WITH THE ELGIN PUERTO RICAN PARADE COMMITTEE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, that Richard B. The City of Elgin shall make a $900 . 00 grant to GRANTEE for the following program: Puerto Rican music and dance workshop 2 . All monies granted for this program shall be expended by GRANTEE between January 1, 1994 and September 30, 1994 . All monies awarded must be expended. 3 . Grant monies shall not be paid out more than 30 days prior to start of the program upon written request by GRANT- EE . No funds will be paid to GRANTEE until the City has received the signed Grant Agreement. 4 . All funds received for this program pursuant to this Agreement shall be expended only for the program as described above. In the event GRANTEE changes the program without the prior consent of the City; all grant funds shall be refunded to that City. 5 . GRANTEE shall acknowledge funding of the project by the City of Elgin, Elgin Cultural Arts Commission and the Illi- nois Arts Council on all public notices, publicity, printed programs, public media and other applicable materials . GRANT- EE also agrees to supply the City of Elgin with copies of the above-mentioned publicity. 6 . GRANTEE shall submit a "Financial and Evaluation Report" to the City on forms provided, within two weeks after Septem- ber 30, 1994 . Printed on recycled paper 7 . GRANTEE shall, upon request, make available to the City of Elgin financial records for the year in which a grant was received from that Council . The City will be allowed to access to financial documents that pertain to information stated in the previously approved application for funding. 8 . No monies from this grant shall be used for any purchase of permanent equipment, capital improvements or construction, payment of previous year' s deficit, activities outside of the state geographic boundaries, or subsidy for an individual ' s academic study. 9 . No person shall, on the grounds of race, color, reli- gion, national origin, sex, handicap, sexual preference, participation in, be denied benefits of, or be otherwise subjected to discrimination under any activity including employment, supported in whole or in part by funds provided under this grant. 10 . GRANTEE agrees that the program described in Paragraph 1 and referred to in Paragraph 8 shall be conducted within the geographical boundaries of the City. 11 . GRANTEE does hereby agree to indemnify, save harmless, and defend the City of Elgin, the Illinois Arts Council , its agents, servants and employees, and each of them against and hold it and them harmless from any and all lawsuits, claims, demands, liabilities, losses, and expenses including, but not limited to, participants and spectators, or any death at any time resulting from injury or any damage to any spectators, or any death at any time resulting from injury or any damage to any property which may arise or which may be alleged to have arisen out of, or in conjunction with, the program as described in Paragraph 1 and referred to in Paragraph 8 . 12 . This Agreement shall not be construed to create an em- ployment, joint venture or partnership agreement between the parties . City of Elgin Grantee By Q '�5. By )1/:4-- Authorized Agent . IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, that Bert Leveille be and is hereby appointed as a member of the Cultural Arts Commission to fulfill the unexpired term of Marcia Schalk for a term to expire November 1, 1995 . BE IT FURTHER RESOLVED that Donald P.
