RESOLUTION
AUTHORIZING EXECUTION OF AN APPLICATION FOR HIGHWAY PERMIT
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS, that Richard B. Helwig, City Manager, and Dolonna
Mecum, City Clerk, be and are hereby authorized and directed
to execute an Application for Highway Permit on behalf of the
City of Elgin with the Cook County Highway Department for
maintenance of a portion of Shoe Factory Road, a copy of which
is attached hereto and made a part hereof by reference.

WHEREAS, J(IMBALL HILL INC. / CITY OF ELGIN -
LOCATED AT 5999 NEW WILKE ROAD / 150 DEXTER COURT

hereinafter termed the applicant, requests permission and
authority to install, construct, operate and maintain the
following described improvements in Cook County, Illinois; on
COUNTY HIGHWAY known as SHOE FACTORY ROAD

SUBJECT TO THE CONDITIONS SHOWN ON PAGE 2 OF THIS APPLICATION:
IN ACCORDANCE WITH THE AMENDMENT TO THE COUNTY ORDINANCE CHAPTER 14
THE APPLICANT ACKNOWLEDGES THIS PERMIT IS NULL AND VOID IF THE
APPLICANT, BUSINESS ENTITY, (PARTNERSHIP OR CORPORATION) IS
DELINQUENT IN THE PAYMENT OF ANY TAX OR FEE ADMINISTERED BY THE
COUNTY OF COOK.

A COPY OF PERMIT MUST BE KEPT ON THE JOB SITE DURING CONSTRUCTION
The sidewalk called for herein shall be ramped for the handicapped
in compliance with the "State's Design Manual Communique-I-76-1" ,
dated March 3, 1976.
As a condition to granting this permit. the applicant(s) must
install a 30" X 30" stop sign on said entrance return. The sign
must conform to the standard specifications for traffic control
items, IDOT adopted February 1, 1984 and be installed in keeping
with the Cook County Standard TS-9.
Cook County right-of-way to be restored with 4" top soil and sod.
The Village/City of Elgin hereby accepts full responsibility for
the future maintenance, replacement, removal and relocation and
liability of the Street Entrance Watermain and Appurentances
mentioned herein.
The Village/City of Elgin hereby accepts full
responsibility for the future Maintenance replacement, removal and
• relocation and liability of the sidewalk mentioned herein, as well
as the abutting earthwork surrounding said sidewalk.
The general contractor, before starting the job, will deposit with
the Cook County Highway Department, Permit Bureau, insurance as
required on Form " A".
A Performance and Right-Of-Way Restoration Bond in the amount of
$ 10,000.00 on behalf of Kimball Hill Inc. , 5999 New Wilke Rd.
Rolling Meadows, Illinois. , has been deposited with the Cook County
Highway Department, Permit Bureau.
THE WORK CALLED FOR IN THIS PERMIT MUST BE PERFORMED AS STATED
ABOVE AND ON PAGE TWO ATTACHED HERETO.
In addition to the above, the City of Elgin hereby accepts full responsibility
for future maintenance, replacement, removal and relocation of the proposed
storm sewer pipe up to and including the first structures (D50 & D23 per plans)
in Cook County right-of-way. City will not be responsible for existing or
relocated storm sewer pipe and structures upstream from structures labelled
•
D50 and D23.

gENERAL CONDITIONS
1. That said Permittee(s) shall furnish all material to do all work
required, and pay all costs which may be incurred in connection
with such work, and shall prosecute the same diligently and without
.delay to completion.
2. That the construction work shall be in accordance with the current
Standard Specifications for Road and Bridge Construction of the
Illinois Department of Transportation including the Supplemental
Specifications thereto of the County of Cook, and as detailed in
the permit. -
3. That upon completion of said work, said Permittee(s) shall, within
30 days, at its own cost, restore said highway substantially to the
same condition in which it was before said work was commenced and
shall remove all debris, rubbish, materials, apparatus, tools, and
equipment, as well as all excess excavated materials, from the
right of way of said highway, all to the satisfaction of the Cook
County Superintendent of Highways.
4. That should future construction and operation of said highway by
The County of Cook (or by the State of Illinois if it is then
maintaining said highway) require alteration or change of location
of the improvement referred to herein, such change shall be made by
the Permittee(s) , its successor or assigns upon the written request
of The County of Cook or The State of Illinois, as the case may be,
without expense to said County or State.
5. That the said Permittee(s) , its successor or assigns shall assume
all risk and liability for accident and damages that may accrue to
persons and property, during the prosecution of the work or any
time thereafter, by reason of the location, construction, installa-
tion and work referred to herein, and said Permittee(s) agree to
indemnify and save harmless the County of Cook or the State of
Illinois, as the case may be, from any such claims for damages and
from all costs and expenses incurred on account thereof and in
connection therewith.
6. ' That no changes, alterations, or revisions will be permitted
unless approved in writing by the Cook County Superintendent of
Highways.
7. That a copy of this Permit must be kept on the job site during
construction of the work described herein.
8. That all trenches and openings made in the Cook County Highway
Department Right of Way shall be backfilled with sand or limestone
screenings adequately compacted in accordance with Method 1
specified in Article 603.08 of the State Standard Specifications.
9. That all pavement openings and curb cuts shall be saw cut full
depth.
10. That all pavement openings shall be immediately surfaced with a
temporary bituminous patch, at least three inches in thickness.
This patch then must be inspected daily and additional bituminous
patch material must be placed, daily if necessary, to maintain the
patched area at the same elevation as the adjacent undisturbed
pavement for a period of not less than 30 days. After 30 days
permanent replacement in kind shall be made to the base course and
pavement surface.
11. That all auger pits shall be a minimum of 10 feet from the edge of
pavement or back of curb, and wood or steel sheeting shall be used,
and auger pits left open overnight shall be protected with concrete
barrier walls.
12. That all casings shall be pressure grouted both inside and
outside of the casing.

1. That if during the progress of the work, that subterranean
conditions prohibit the construction of said improvement in and
along the alignment as outlined in the plans, it is expressly
understood that construction operations shall cease until a
proposed revised alignment has been approved by the Cook County
aighway Department.
14. That without further action, the Cook County Highway Department
reserves the right to make connections to the proposed storm sewer
for the purpose of draining the highway.
15. That the Permittee(-s ) shall be responsible for providing positive
drainage.
16. That the pavement, parkway and all drainage systems shall be kept
clean and free of debris at all times.
17. That unless particularly specified in the permit, no equipment
other than pneumatic tired equipment used during the installation •
shall be permitted to stop or operate on the pavement nor shall any
excavated materials be stored temporarily or otherwise on the
County's pavement.
18. That in the removal of sidewalks, curb, gutter or pavement, the use
of any type of concrete breaker that will damage the underground
structures will not be permitted.
19. That the Permittee(s ) shall provide and maintain at his own
expense, such temporary roads and approaches, as may be necessary
to provide access to driveways, house, buildings or other property
abutting said improvement.
_0. That the earth shall be removed to its full depth, starting at the
edge of the pavement, for the full dimensions of the proposed
driveway, and replaced with materials to be used in the construe-
' . tion of the driveway.
21 . That when existing traffic control signs such as stop signs, stop
ahead signs and crossroad signs are removed in the progress of the
work, said signs shall be immediately reset as close as possible to
their original location; after the construction of said improvement
has been approved, said traffic control signs shall be restored to
their original position and condition or as directed by the County
Permit Engineer.
22. That the operations of the Permittee(s) shall be conducted in a
manner to insure the minimum hindrance to traffic using the
pavement and at no time shall its operations obstruct more than one
half 11/2 ) of the available pavement width.
23. That the use of flagmen and that the number, type, color, size and
placement of all traffic control devices shall conform to the
latest edition of the State of Illinois "Manual on Uniform Traffic
Control Devices for Streets and Highways."
24. That his permit covers only the specific work mentioned herein and
does not presume to release the applicant from fulfilling any other
laws relating to this work.
25. This permit is issued with the expressed understanding that the
Permittee has obtained the proper authority for the said
installation from . the "Illinois Environmental Protection Agency
Division of Public water Supplies -Technical Policy Statements" -
Approved 1/13/75.
26. That at least three (3 ) days advance notice prior to the start of
work shall be given to the County Permit Division, Mr. Bhanu
Vyas(312 ) 443-5988.
27. This permit can be revoked at the discretion of the Cook County
Highway Department, Superintendent of Highways, at any time.

SUBJECT: Authorization to execute a Maintenance Agreement
with Cook County at Cobbler' s Crossing
PURPOSE
The purpose of this memorandum is to provide the Mayor and
members of the City Council with information to consider the
execution of a Cook County Highway Permit Application for
improvements to Congdon Avenue by Kimball Hill .
BACKGROUND
The City of Elgin and Cook County approved a final plat for
Unit 14 of Cobblers Crossing which included an intersection
with Congdon Avenue, a Cook County highway. The County
identifies this highway as Shoe Factory Road.
In applying for a permit, Kimball Hill and the City of Elgin
must both execute the application. Kimball Hill has
completed their portion. The City' s portion of the permit is
based on acceptance of maintenance of certain improvements
within the County' s right-of-way. Please refer to the
attached copy of the application.
By executing the application, the City will be accepting
responsibility for sidewalks, water main, storm sewer and the
entrance pavement within Cook County' s right-of-way. Please
note that only new portions of storm sewer will be accepted.
