RESOLUTION
AUTHORIZING EXECUTION OF A GRANT AGREEMENT
WITH ILLINOIS ARTS COUNCIL
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS, that Larry L. Rice, City Manager, and Dolonna Mecum,
City Clerk, be and are hereby authorized and directed to
execute a grant agreement on behalf of the City of Elgin with
the Illinois Arts Council for local regranting program, a copy
of which is attached hereto and made a part hereof by
reference.

The COUNCIL and GRANTEE hereby agree as follows:
1.COUNCIL agrees to make a grant payable to GRANTEE in the amount of <

Additionally:
(a)GRANTEE may expend grant monies for PROJECT expenses incurred between the beginning date above and the
ending date of this AGREEMENT,as described in its application to the COUNCIL.
(b)If,for any reason,GRANTEE needs to extend the term of this AGREEMENT,application must be made in writing to
the COUNCIL at least thirty days prior to the above ending date of PROJECT.If no extension has been requested
of,and improved by,the COUNCIL,any monies payable hereunder remaining after the completion of the PROJECT,
or after the date set forth above,must be returned to the COUNCIL within 45 days.
3.The monies payable hereunder shall be paid to GRANTEE no sooner than forty-five days before the beginning date of
f PROJECT and no later than the ending date of PROJECT or June 1 of the fiscal year in which this grant is awarded,whichever -j
comes first,unless otherwise stipulated in the SPECIAL CONDITIONS section of this AGREEMENT.
4.No funds will be paid to GRANTEE unless COUNCIL receives from GRANTEE a completed cash request form in the
proper amount.
5.GRANTEE agrees that all funds issued by COUNCIL pursuant to this AGREEMENT shall be expended only for the specific
project described herein.

6.GRANTEE EE agrees that credit shall be given COUNCIL on al.l public notices,publicity;printed programs,public media,
and other applicable material.The following language shall be used in such notices:
"This program is partially supported by a grant from the Illinois Arts Council,a state agency,and by the
National Endowment for the.Arts:
?.GRANTEE agrees to the following with respect to reports on this grant:

(a)'lb submit to COI!NC;II,within thirty days after the ending date of PROJECT a"Financial Report"on forms
provided and a"Narrative Report"on forms provided or prepared according to instructions provided.
(b)'lb comply with any subsequent requirements which may be adopted by COUNCIL with respect to grant reporting.
Failure to submit timely and acceptable reports will jeopardize the receipt of future funds from the Council
8.The GRANTEE.should account fin•grant expenditures separately If separate accounting is not feasible,all grant
expenditures should be properly identified in the records.
9.GRANTEE agrees upon request to make available to COUNCIL and the General Assembly of the State of Illinois all
audited and unaudited financial statements for each year in which a grant was received from COUNCIL.COUNCIL.shall have
unlimited access to the accounts,books,records,and other financial documents of GRANTEE supporting information stated in
GRANTEE'S application fi)r COUNCIL hinds or any subsequent documentation regarding PROJECT funded hereunder.
10.Any and all patents,copyrights,or other legal interests in and to PROJECT or materials generated in pursuance of
PROJECT,shall be the sole and exclusive property of GRANTEE or G:RAN'rEE'S'dcsign.GRANTEE,,however,agrees to supply
COUNCIL with copies of any newspaper articles or related events contemplated hereunder,and herby grants to COUNCIL free
and unlimited license to use such newspaper articles for such purpose as COUNCIL,in its sold discretion,shall determine.
11.GRANTEE agrees that no monies pay-able hereunder shall be used for the purchase of permanent equipment,capital
improvements or construction,to pay balance of GRANTEE'S previous year's deficit,out of state touring,or subsidizing an
individual's academic study.
12.GRANTEE agrees that no person shall,on the grounds of race,color,religion,national origin,sex,age.or handicap, •
while otherwise qualified be excluded from participation in,be denied benefits off,or be otherwise subjected to discrimination
under any program or activity supported in whole or in part by funds provided hereunder.
13.GRANTEE agrees that it shall fully comply with all rules,regulations and other requirements now existing or which
may hereafter be adopted by COUNCIL with respect to GRANTS of this nature.
14.If funds provided hereunder are used in whole or in part for the employment of any person,GRANTEE further agrees
that no person shall on the grounds of race,color,religion,national origin,sex,age,or handicap while otherwise qualified,be
denied equal opportunity in the hiring process,or be otherwise discriminated against with respect to compensation,terms,
conditions,or benefits of employment.
15.'ihe undersigned certifies that GRANTEE has not been convicted of bribery or attempting to bribe an officer or employee
of the State of Illinois,nor has the GRANTEE made an admission of guilt of such conduct which is a matter of record.
16.GRANITE certifies that is has not been barred from bidding on this contract as a result of a violation of Section 33E-3
or 331-4 of The Criminal Code of 1961.
17.GRANTEE certifies that it is not a trustee nor a beneficiary of a land trust.
18.This grant is continf.==c•nt upon the availability of funds.

STATEMENT OF ASSURANCES
The applicant HEREBY AGREES THAT:
1. The activities and services for which assistance is sought will be administered by or under the supervision of the applicant.
2. Any funds received under this grant shall not be used to supplant funds normally budgeted for services of the same type.
3. It will comply with Title VI of the Civil Rights Act of 1964(42 U.S.C.200D);
and FURTHER AGREES THAT it will comply with Title VII of the Civil Rights Act of 1964(42 U.S.C.200e)as amended by the Equal Employment
Opportunities Act of 1972(Public Law 92-261)and the Americans with Disabilities Act of 1990(Public Law 101-336),and the Constitution of the
State of Illinois(article 1 section 17-19); and FURTHER AGREES THAT it will comply with Section 504 of the Rehabilitation Act of 1973
(29U.S.C.706);and FURTHER AGREES THAT it will comply with Title IX of the Education Amendment of 1972(20 U.S.C. 1981).
4. The figures,facts and representation in this application,including all exhibits and attachments,are true and correct to the best of its knowledge and belief

AN ORDINANCE
ESTABLISHING A CULTURAL ARTS COMMISSION
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS:
Section 1 . That Title 3 entitled Board and Commissions
of the Elgin Municipal Code, 1976 , as amended, be and is
hereby further amended by adding Chapter 3 . 75 to read as
follows :
Chapter 3 . 75
Cultural Arts Commission
3. 75 . 010 Cultural Arts Commission created.
There is hereby created a Commission, to be
known as the Cultural Arts Commission (hereinafter
referred to as "Commission") .
3 . 75 . 020 Membership; appointment and term of office.
The Commission shall consist of nine (9 )
members, all of whom shall be appointed by the Mayor
with the advice and consent of the City Council .
A. Seven of said nine members shall be
residents of the City of Elgin who are known to have
an interest and expertise in the functions of the
Commission and who shall be voting members of the
Commission.
B. Two of the members of the said Commission
shall be non-voting ex-officio members, one of whom
shall be a member of the City Council of the City of
Elgin, and the other shall be a member of the
Hemmens Advisory Board.
3 . 75. 030 Term of members .
A. Upon creation of the Commission and the
initial appointment of the residents of Elgin as
voting members, two such members shall be appointed
for terms of four (4) years, two members for terms
of three ( 3) years, two members for terms of two (2)
years, and one member for a term of one ( 1 ) year.
B. After the initial appointments as provided
above, each subsequent appointment shall be for a
term of four (4 ) years, provided that no Commission
member shall serve for more than two full
consecutive terms .
C. All vacancies occurring in the membership
of the Commission shall be filled by appointment for
the remainder of the unexpired term in the same
manner as the original appointment. Each member
shall hold office as a member of the Commission
until a successor has been appointed.
3 . 75 . 040 Meetings; by-laws .
A. The Commission shall have the power to
adopt its own by-laws and schedule of regular
meetings, and determine the place that such meetings
shall be held. These rules shall include procedures
for the election by the members of a Vice-Chairman
and Secretary from among the membership of the
Commission, provided that no such officer shall
serve for more than two consecutive one-year terms .
The Chairman shall be appointed by the Mayor and
City Council .
B. Special meetings of the Commission may be
called by the Chairman or any three (3) members
provided that notice is given as provided in the
Illinois "Open Meetings Act" .
C. Robert ' s Rules of Order, Revised, shall
govern the procedures of the meetings of the
Commission, except as same may be specifically
modified by the by-laws of the Commission.
3 .75 . 050 Functions of the Commission.
The Cultural Arts Commission shall :
A. Make recommendations to the City Council of
the City of Elgin for the provision of an
environment in which the cultural arts will flourish
within the corporate limits of the City of Elgin.
B. Foster educational opportunities and
enhance the quality of life for all of the residents
of the City of Elgin by making recommendations to
develop arts and cultural programs directed at
various age, ethnic, and religious groups .
C. Enhance the economic base in the City of
Elgin by promoting opportunities to combine arts and
economic development.
D. Cooperate with the professional city staff
to administer all Commission programs and activities .
E. Support and foster strong bonds between and
among all arts organizations in the community and
encourage new arts organizations in a manner which
will make the whole considerably stronger than the
individual parts, which shall include working
cooperatively with other city boards, commissions
and committees, and other public and private
agencies .
F. Apply for grants to support Commission
programs and administer and serve as a vehicle for
"Regrants" under the rules of the Illinois Arts
Council and other agencies .
G. Provide a vehicle for publicizing all
arts-related events of various organizations as well
as community, state or national events related to
the arts, and provide a strong public relations
program for communicating the Commission' s goals and
their impact on community life.
H. Acts as a resource center and clearing
house for information and provide technical
assistance to community arts organizations to enable
them to improve the effectiveness of grant writing,
planning, audience development, identification of
sources for funds, and assistance in connection with
legal, tax, insurance and liability issues related
to arts programs and arts organizations .
Section 2 . That this ordinance shall be in full force
and effect from and after its passage in the manner provided
by law.

UNDER THE ILLINOIS ARTS COUNCIL REGRANTING PROGRAM
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS, that George VanDeVoorde, Mayor, be and is hereby
authorized and directed to execute a grant application for
funding under the Illinois Arts Council Regranting Program to
promote and assist Elgin' s artistic community, a copy of which
