RESOLUTION
DECLARING CERTAIN PROPERTY TO BE A PUBLIC NUISANCE
( 660-662 East Chicago Street)
WHEREAS, inspections of structures located on the
property hereinafter described have been made by inspectors of
the Bureau of Inspection Services of the City of Elgin; and
WHEREAS, said structures consist of two multi-family
houses ; and
WHEREAS, said structures are in a state of disrepair,
open, littered with various debris and constitute a fire
hazard; and
WHEREAS, said structures, in their dilapidated state, are
dangerous and unsafe and constitute a threat to the public
health, safety and welfare of the residents of the City of
Elgin, Illinois ; and
WHEREAS, the owners of said structures have refused,
despite repeated demands, to repair or demolish the
structures; and
WHEREAS, the owners of said structures have failed to
comply with notices to appear.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF ELGIN, ILLINOIS:
Section 1 . That the multi-family houses located on the
property legally described as :
That part of Lot 1 in Block IV of Eastview
Addition to Elgin and that part of the Northeast 1/4
of Section 13, Township 41 North, Range 8 East of
the Third Principal Meridian, described as follows :
Beginning at a point in the North line of Lot 1 in
Block IV aforesaid, 178 feet West of the Northeast
corner thereof; thence South parallel with the East
line of said Lot 1 to the northerly line of Chicago
Street; thence easterly along the northerly line of
said street, 8 inches for a point of beginning;
thence northwesterly along the northerly line of
Chicago Street to a point in line drawn parallel to
and 495 feet West of the East line of the Northeast
1/4 of said Section 13; thence North along said
parallel line 177 . 6 feet; thence East parallel with
the South line of said Northeast 1/4 to a point 342
feet West of the East line of the Northeast 1/4 of
said Section 13; thence southerly parallel with the
East line of said Northeast 1/4 of said Section 13
to a point 66 . 5 feet North of the South line of the
Northeast 1/4 of said Section 13; thence West
parallel with the South line of said Northeast 1/4
of said Section 13, 97 feet; thence southerly to the
point of beginning; in the City of Elgin, Kane
County, Illinois .
are hereby declared to be a public nuisance.
Section 2 . That the owners or persons in control of said
premises are hereby directed to abate said public nuisance by
demolishing or repairing the structures located upon the above
described property within thirty ( 30) days after receipt of a
copy of this resolution.
Section 3 . That the City Clerk is hereby directed to
mail certified copies of this resolution to the owners of
record and lienholders of record.
Section 4 . That upon failure of the owner or lienholders
of record to abate the public nuisance described herein, the
Corporation Counsel be and is hereby directed to apply to the
Circuit Court of Kane County for an order authorizing the
demolition of the structure described above in accordance with
the provisions of Section 11-31-1 of Chapter 24 of the
Illinois Revised Statutes .
