RESOLUTION
PROTESTING RECLASSIFICATION OF PROPERTY IN KANE COUNTY
WHEREAS, application has been made to reclassify certain
territory located on the south side of Water Road, which is
not included within the boundaries of any municipality, from
Kane County F Farming to Kane County E-1 and E-3 Estate
Residential, said territory being legally described as follows :
Parcel 1 :
That part of the Southeast Quarter of
Section 19 , in Township 41 North, Range 8 East of
the Third Principal Meridian described as follows :
Commencing at the Southwest corner of the Southeast
Quarter of said Section 19 ; thence South 88 degrees
56 minutes 43 seconds East along the South line of
said Southeast Quarter 188 . 83 feet for the point of
beginning; thence North 42 degrees 13 minutes 27
seconds East 1152 .47 feet to the center line of
Water Road; thence South 53 degrees 57 minutes 38
seconds East 219 . 82 feet; thence South 42 degrees 13
minutes 27 seconds West 985 . 04 feet to the South
line of said Southeast Quarter; thence North 88
degrees 56 minutes 43 seconds West along said South
line 290 . 32 feet to the point of beginning, in Kane
County, Illinois .
Parcel 2 :
That part of the Southeast Quarter of
Section 19 and that part of the Northeast Quarter of
Section 30, in Township 41 North, Range 8 East of
the Third Principal Meridian described as follows :
Commencing at the Northwest corner of the Northeast
Quarter of said Section 30; thence South 88 degrees
56 minutes 43 seconds East along the North line of
said Northeast Quarter 188 . 83 feet; thence North 42
degrees 13 minutes 27 seconds East 1152 . 47 feet to
the center line of Water Road; thence South 53
degrees 57 minutes 38 seconds East, 219 . 82 feet for
the point of beginning; thence continuing South 53
degrees 57 minutes 38 seconds East along said center
line 30 . 18 feet to the Northwest corner of Noble
Manors Subdivision, being a Subdivision of said
Sections 19 and 30; thence South 42 degrees 13
minutes 27 seconds West along the West line of said
Subdivision 881 . 33 feet to a jog in said West line;
thence South 0 degrees 21 minutes 17 seconds West
along said West line being a line parallel to the
West line of Northwest Quarter of the Northeast
Quarter of said Section 30, a distance of 1385 . 78
feet to a point on the South line of the Northwest
Quarter of said Northeast Quarter; thence North 89
degrees 10 minutes 16 seconds West along said South
line 572 . 86 feet to the Southwest corner of the
Northwest Quarter of the Northeast Quarter of said
Section 30; thence North 0 degrees 21 minutes 17
seconds East along the West line of said Quarter
1327 . 27 feet to the Northwest corner of said
Northeast Quarter of Section 30; thence South 88
degrees 56 minutes 43 seconds East along the North
line thereof 479 . 15 feet; thence North 42 degrees 13
minutes 27 seconds East 985 . 04 feet to the point of
beginning, in Kane County, Illinois .
WHEREAS, said territory is within one and one-half miles
of the corporate boundaries of the City of Elgin; and
WHEREAS, the City of Elgin has passed a comprehensive
plan; and
WHEREAS, the Planning and Development Commission of the
City of Elgin has reviewed said application and recommended
that the application be denied; and
WHEREAS, the proposed reclassification threatens an
adverse effect upon the value of surrounding properties and is
inconsistent with the comprehensive plan of the City of Elgin;
and
WHEREAS, Section 3158 of Chapter 34 of the Illinois
Revised Statutes provides that no amendment of regulations or
districts under county zoning ordinances shall be made where
the land affected lies within one and one-half miles of a
zoned municipality and a protest.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF ELGIN, ILLINOIS, that it hereby protests the
reclassification of the above described territory from Kane
County F Farming to Kane County E-1 and E-3 Estate Residential .
BE IT FURTHER RESOLVED that the City Clerk be and is
hereby authorized and directed to file a certified copy of
this resolution with the County Clerk of Kane County.
