RESOLUTION
AUTHORIZING EXECUTION OF A GRANT OF EASEMENT AND ACCEPTANCE
OF THE EASEMENT FOR A WATER MAIN
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS, that Larry L. Rice, City Manager, and Dolonna Mecum,
City Clerk, be and are hereby authorized and directed to
execute a Grant of Easement on behalf of the City of Elgin
with Irene M. Hageman and accepting said easement for water
main purposes, for the property legally described as follows :
PERMANENT EASEMENT
The westerly 10 . 00 feet of the easterly 30 . 00
feet of the following described property: Beginning
at a point on the south line of said northwest
quarter that is 997 . 40 feet, measured along said
south line, easterly of the southwest corner of said
northwest quarter; thence easterly, along said south
line, a distance of 183 .20 feet to the westerly
right of way line of a strip of land owned by
Commonwealth Edison Company; thence northerly, along
said westerly right of way line, a distance of
280 . 00 feet; thence westerly, parallel with the said
south line of the northwest quarter, a distance of
183 . 20 feet; thence southerly, parallel with the
said westerly right of way line of Commonwealth
Edison Company, a distance of 280 . 00 feet to the
point of beginning; being situated in Hanover
Township, Cook County, Illinois and containing
2 , 799 . 87 square feet more or less .
TEMPORARY CONSTRUCTION EASEMENT
The westerly 10 .00 feet of the easterly 40 . 00
feet of the following described property: Beginning
at a point on the south line of said northwest
quarter that is 997 . 40 feet, measured along said
south line, easterly of the southwest corner of said
northwest quarter; thence easterly, along said south
line, a distance of 183 . 20 feet to the westerly
right of way line of a strip of land owned by
Commonwealth Edison Company; thence northerly, along
said westerly right of way line, a distance of
280 . 00 feet; thence westerly, parallel with the said
south line of the northeast quarter, a distance of
183 .20 feet; thence southerly, parallel with the
said westerly right of way line of Commonwealth
Edison Company, a distance of 280 . 00 feet to the
point of beginning; being situated in Hanover
Township, Cook County, Illinois, and containing
2 ,799 . 87 square feet more or less .

BE IT FURTHER RESOLVED that the City Clerk is hereby
authorized and directed to cause the Grant of Easement to be
recorded in the office of the Recorder of Deeds of Cook
County, Illinois .

GRANT OF EASEMENT
THIS INDENTURE, made and entered into this / 9 day
of , 1993, by and between Irene M.
Hageman, hereinafter referred to as "Grantor" , and the CITY
OF ELGIN, a municipal corporation, hereinafter referred to as
"City" , Witnesseth:
That in and for the consideration of one thousand nine
hundred and fifty dollars ($1,950 . 00) and other good and
valuable consideration, which includes the waiver of the fee
charged to tap into the water line if and when the grantor
desires to connect to the city water service, which is hereby
acknowledged, Grantor does hereby grant and convey to the
City a permanent easement for the construction and mainte-
nance of a water line in, upon and over the following de-
scribed real property in the City of Elgin, County of Cook,
State of Illinois, more particularly described as :
The westerly 10 . 00 feet of the easterly 30 . 00 feet of the
following described property: Beginning at a point on the
south line of said northwest quarter that is 997 . 40 feet,
measured along said south line, easterly of the southwest
corner of said northwest quarter; thence easterly, along said
south line, a distance of 183 .20 feet to the westerly right

Further, Grantor does hereby grant and convey to City a L3
temporary construction easement in, upon and over the follow- Odb

corner of said northwest quarter; thence easterly, along said
south line, a distance of 183 .20 feet to the westerly right
of way line of a strip of land owned by Commonwealth Edison
Company; thence northerly, along said westerly right of way
line, a distance of 280 . 00 feet; thence westerly, parallel
with the said south line of the northwest quarter, a distance
of 183 . 20 feet; thence southerly, parallel with the said
westerly right of way line of Commonwealth Edison Company, a
distance of 280 . 00 feet to the point of beginning; being
situated in Hanover Township, Cook County, Illinois and con-
taining 2 , 799 . 87 square feet more or less .
This grant of easement is executed, delivered and is
grated upon the following conditions :
1 . The City shall restore all grounds, sidewalks, pave-
ment, ground coverings and other surface improvements to
their condition prior to any excavation hereunder, or to a
condition conforming to the terms of the Elgin Municipal
Code, if the requirements of said code are amended prior to
or during excavation.
2 . Grantor shall not erect any permanent structure on
the permanent easement described herein.
The terms and conditions of this permanent and temporary
easement shall be binding upon the Grantors and Grantee, and
upon their heirs, executors, successors and assigns .
Said temporary construction easement shall expire on
April 30 , 1994 .
