FOR ELGIN BIKE PATH PHASE II WHEREAS, the City of Elgin has heretofore entered into a contract with JEM Morris Construction, Inc. for Elgin Bike Path Phase II; and WHEREAS, it is necessary and desirable to modify the terms of the contract as is described in Change Order No. 4 , attached hereto. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, that Larry L. The contractor for this phase of the project is JEM Morris, Construction, Inc. , of Big Rock, Illinois . REASONS FOR CHANGE: This change order is required to close the contract with JEM Morris, Inc. By reason of this Balancing Change Order, the contract for construction of the Elgin Bike Path Phase II will be increased in the amount of Three thousand eight hundred sixty-six and 40/100 dollars ($3, 866 .40) , the total contract value being Two hundred eighty-three thousand three hundred and 05/100 dollars ( $283,353 . 05) . BACKGROUND: The City Council awarded the contract for the subject work to JEM Morris Construction on March 27, 1991 . The work is now complete with only minor items of clean up remaining. All of the pay items have been completed and inspected with the exception of the clean up. It is expected that all of the above work will be completed by Friday, June 26, 1992 . In order for the grant which covers this work to be paid out it is necessary this change order be completed balancing the final quantities for the project. FINANCIAL IMPACT: The original contract for this work was in the amount of $232,879 .55 . Change order numbers 1, 2 and 3 increased the cost to 279,453 . 65 . The Balancing Change Order proposes to increase the contract cost to $283, 353 . 05 . Sufficient funds have been established in the 1988 General Obligation Bond Project Fund (Appropriation #388-991-9907) . RECOMMENDATION: It is recommended that the City Council authorize the City Manager to execute the Balancing Change Order to the contract with JEM Morris Construction, Inc. , for the Elgin Bike Path Phase II in the amount of $3,866 .40.
