Work will be done during regular working hours except upon the Customer's/Contractor's specific request and agreement to pay for over- time work. All material and equipment from the main to and including the meter is the property of the Company.All material and equipment be- yond the meter is the property of the Utility Customer and is to be maintained and repaired at the Utility Customer's expense. Except in case of emergency, no repairs chargeable to the Utility Customer shall be made other than upon the Utility Customer's written order. The Utility Customer agrees that the Company shall have the right to enter the Utility Customer's premises at all reasonable hours to make the necessary repairs to piping,regulators, meters and other equipment connected to the Company's system. The Company shall not be responsible for any damages resulting from delay in completing the above work, where such delay is due to casualties,labor disputes,or other causes beyond the reasonable control of the Company. The Customer/Contractor agrees to indemnify and hold harmless the Company against all costs,damages,liabilities and expenses (includ- ing those incurred in connection with any claim, suit or proceeding) arising out of the Work,except when such costs,damages,liabilities,and expenses arise solely from the negligence of the Company. This Proposal shall be void unless accepted within 30 days of its presentment. This Proposal contains the entire understanding between the parties with respect to the subject matter hereof,and may be modified,a- mended or mutually rescinded only by a written instrument executed by the parties hereto. This Proposal,as submitted,becomes a Contract when accepted by the Customer/Contractor and approved by the Company. Rice, City Manager SUBJECT: Highland Avenue Culvert at Sandy Creek Northern Illinois Gas (N. I .Gas) Main Relocation PURPOSE: This memorandum will provide the Mayor and Council with information to consider the proposed relocation of a N.I.Gas main at the subject project location. BACKGROUND: The 1992 Capital Budget includes this project for construction. As part of the construction it will be necessary to relocate an existing N. I .Gas main on the north side of Highland Avenue in the project area. N.I .Gas has prepared an t agreement for this work, copy attached. The work will be performed by N.I .Gas crews as soon as the agreement is returned to them. The Illinois Department of Transportation's Division of Water Resources (DOWR) is reviewing the permit to construct the improvements. A representative of DOWR has indicated that the permit should be issued by May 15, 1992. It is anticipated that the bids for this work will be sought once the permit is issued by DOWR. FINANCIAL IMPACT: The cost of the N. I .Gas relocation of the main is $18, 123.00. Half of this cost will be reimbursed by Kane County per the intergovernmental agreement between the City and County. The cost of the permit could be charged to the 1992 G.O Bond Fund (392-982-9908) RECOMMENDATION: It is recommended that the Mayor and Council authorize the City Manager to execute the agreement for the relocation of the existing Northern Illinois Gas main in Highland Avenue at Sandy Creek. It is further recommended that the staff be directed to prepare a check in the amount of $18, 123 . 00 in payment for the relocation.
