GRIFFIN BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, that George VanDeVoorde, Mayor, and Dolonna Mecum, City Clerk, be and are hereby authorized and directed to execute an Abrogation Agreement on behalf of the City of Elgin with William H. Griffin and Beverly J. GRIFFIN and BEVERLY J. GRIFFIN, his wife, hereinafter referred to as "Griffin" , and the CITY OF ELGIN, a municipal corporation, hereinafter referred to as "City" , WITNESSETH WHEREAS, Griffin is the owner of the following described land in the City of Elgin, County of Kane, and State of Illinois to-wit: That part of Lot 1 in Block V of William Redeker' s Second Addition to Elgin, described as follows : Beginning at the Northwest corner of said Lot 1; thence South along the West line thereof, 66 . 0 feet to the southwest corner of said lot; thence East along the South line of said lot 3 .5 feet; thence North and parallel to said West line 44 . 0 feet; thence Northeasterly 23 .58 feet to a point, said point being 12 . 0 feet East of the point of beginning, as measured along the North line of said lot 1 thence west along said North line 12 . 0 feet to the point of beginning, in the City of Elgin, Kane County, Illinois . WHEREAS, under an easement agreement obtained in a deed from the City of Elgin, Illinois, a municipal corporation to EMILY V. WAHL dated October 13, 1977 and recorded October 21, 1977 as Document 1429014, wherein the City was granted a right of way over the premises described above; and WHEREAS, both parties hereto desire the cancellation and abrogation of said easement agreement described in Document 1429014; i NOW, THEREFORE, in consideration of the sum of $10 . 00 paid by GRIFFIN to the City, the receipt whereof is hereby acknowledged, the City hereby releases, quit claims, abandons and abrogates unto Griffin the easement rights granted to the City in the premises first above described. BACKGROUND: The City obtained an easement for the delivery of chemicals and equipment to the well site at St. Charles and Dixon on October 13, 1977 . The property is no longer used by the City and, therefore, there is no need for the easement. The owner has requested that the property be returned to them. FINANCIAL IMPACT: There is no cost to the City. This vacation of easement will be filed with the Kane County Recorder of Deeds at the cost of the owner. RECOMMENDATION: It is recommended that the City Council authorize the Mayor and City Clerk to execute an Abrogation Agreement for the Easement at 901 Elizabeth Avenue.
