HomeMy WebLinkAbout92-0212 Ecker Center qa-oala RESOLUTION AUTHORIZING EXECUTION OF A PURCHASE OF SERVICE AGREEMENT WITH THE ECKER CENTER FOR MENTAL HEALTH BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, that George VanDeVoorde, Mayor, and Dolonna Mecum, City Clerk, be and are hereby authorized and directed to execute a Purchase of Service Agreement on behalf of the City of Elgin with the Ecker Center for Mental Health for the provision of respite services for low income adults at 695 South State Street, a copy of which is attached hereto and made a part hereof by reference. s/ George VanDeVoorde George VanDeVoorde, Mayor Presented: February 12 , 1992 Adopted: February 12 , 1992 Vote: Yeas 7 Nays 0 Recorded: Attest: s/ Dolonna Mecum Dolonna Mecum, City Clerk PURCHASE OF SERVICE AGREEMENT CITY OF ELGIN, ILLINOIS/ECKER CENTER FOR MENTAL HEALTH On this 3rd day of Febr. , 1992, the City of Elgin, Illinois, by and between the Ecker Center for Mental Health, a not for profit corporation, and the City of Elgin, Illinois, a municipal corporation hereinafter referred to as "City" . WHEREAS, the City desires to assist in the implementation of a program providing respite services at the Crisis Residential Center located at 695 South State Street. WHEREAS, THE Ecker Center for Mental Health is an organization which provides adult respite services including intervention, psychiatric services and temporary residential care at 695 South State Street. It is hereby agreed: 1 . The Ecker Center for Mental Health will provide respite services for low income adults. The provision of the respite services by the Ecker Center for Mental Health shall take place at 695 South State Street located within the corporate limits of the City of Elgin. 2 . The Ecker Center for Mental Health shall maintain the necessary licensing for a facility to accommodate a maximum of eight adults. The Ecker Center for Mental Health shall maintain the facility at 695 South State Street for a period of at least five (5) years. 3 . The Ecker Center for Mental Health has rehabilitated a building located at 695 South State Street in a manner which is suitable for operation of a Crisis Residential Center providing short term respite services to individuals requiring mental health intervention. 4 . The Ecker Center for Mental Health shall submit a report which documents all work completed regarding this rehabilitation and all costs accrued in the completion of this project. 5 . The City shall provide funds to the Ecker Center for Mental Health in an amount not to exceed $ 47 ,488 for the express purpose of reimbursing the Ecker Center for Mental Health for funds expended for the rehabilitation of the building located at 695 South State Street, upon submission by the Ecker Center for Mental Health of a written report, satisfactory to the City, containing a summary of all rehabilitation and construction expenditures. 6 . In the event that the Ecker Center for Mental Health does not continue to provide the respite services at the location indicated in paragraph 2 of this agreement, the Ecker Center for Mental Health shall remit to the City the following amounts: a. In the event operation of this activity ceases within twelve (12) months of the date of this agreement, Ecker Center for Mental Health will remit an amount equal to 100% of the total payments made by the City to the Ecker Center for. Mental Health for this project; -2- b. In the event operation of this activity ceases after more than twelve (12) but less than twenty-four (24) months of the date of this agreement, the Ecker Center for Mental Health will remit an amount equal to 80% of the total payments made by the City to the Ecker Center for Mental Health for this project; c. In the event operation of this activity ceases after more than twenty-four (24) but less than thirty-six (36) months of the date of this agreement, the Ecker Center for Mental Health will remit an amount equal to 60% of the total payments made by the City to the Ecker Center for Mental Health; d. In the event operation of this activity ceases after more than thirty-six (36) but less than forty-eight (48) months of the date of this agreement, the Ecker Center for Mental Health will remit an amount equal to 40% of the total payments made by the City to the Ecker Center for Mental Health for this project; e. In the event operation of this activity ceases after more than forty-eight (48) but less than sixty (60) months of the date of this agreement, Ecker Center for Mental Health will remit an amount equal to 20% of the payment made by the City. This provision shall in no way limit the City of Elgin in asserting its claims against the Ecker Center for Mental Health for breach of any other terms contained in this agreement. Rice, City Manager SUBJECT: Purchase of Service Agreement Ecker Center For Mental Health Purpose: To consider a Purchase of Service Agreement with the Ecker Center for Mental Health. Background: As part of the Community Development Block Grant hearing process the allocation of General Fund dollars to certain organizations was considered and approved by the City Council. The Ecker Center For Mental Health was allocated $ 47,488 . in general fund dollars and $ 7 ,512 in Community Development Block Grant funds to rehabilitate 695 South State Street for use as a Respite Center to provide intervention and psychiatric services and temporary residential care for primarilary low and moderate income adults. Financial Impact: The $ 47,488 . allocation was made from a total of available General Fund dollars of $560 ,000 . Therefore sufficient funds exist in the budget for this activity. Recommendation: It is recommended that the City Council approve the attached Purchase of Service Agreement. A copy has been provided to the Ecker Center for Mental Health and has been executed by the Ecker Center. If approved a resolution authorizing execution of the agreement is on the agenda for the regular session of the City Council. Additionally, authorization for payment to the Ecker Center in the amount of $39,340 . is also on the regular City Council meeting agenda.
