Spector Division Manager Paratransit Enclosure LOCAL SHARE AGREEMENT This Agreement is made this Dt day of , 199Qby and between the Suburban Bus Division of the Regional Transportation Authority (RTA) , operating under the name and hereinafter referred to as "Pace" , an Illinois municipal corporation, and the City of Elgin, an Illinois municipal corporation, hereinafter referred to as the "Municipality" . The parties, in consideration of the mutual promises hereinafter set forth, hereby agree to the following: 1 . This agreement will be in effect beginning January 1 , 1992 , and ending December 31 , 1992 . 2. The Municipality will participate in a project which provides curb-to-curb bus service within the Municipality. 3 . Pace will arrange to provide the following service : A. Dial-a-ride services for seniors 65 years of age and older, and persons with disabilities will be provided in the Municipality, Monday through Friday from approximately 7 : 30 AM to 4 : 30 PM. Additional service may be provided as mutually agreed upon by Pace and the Municipality. B. There will be no transportation service on New Year ' s Day, Memorial Day , July 4th, Labor Day, Thanksgiving Day, and Christmas Day. C. Rides will be scheduled by calling the dispatcher on the day before a trip is being requested. Requests for service the day of the trip will be honored to the extent that the request can be accommodated within the framework of the day' s schedule . The dispatcher will notify the passenger of the approximate pick-up time . 4 . Fares for the services are listed below. All fares are subject to change at the discretion of Pace . Full Fare $ N/A Reduced Fare $ . 65 Transfers $ . 05 -Page Two- The applicable fares listed above are defined as follows: The reduced fares category includes senior citizens (Age 65+) and persons with disabilities . Children under the age of 7 can only ride when accompanied by a fare paying passenger (a maximum of two children per fare paying passenger) . The first two children under the age of 7 can ride free , with any additional children paying the reduced fare rate. If the Municipality desires that fares be lower for any fare categories, the passenger will be charged the lower fare and the Municipality will be charged the difference between the fares specified in this Agreement and the lower fares . 5 . Pace will provide to the Municipality on a monthly basis, a report with the following: A. Number of one way trips (for dial-a-ride trips originating and ending within the Municipality boundaries) ; B. Vehicle service hours (provided for dial-a-ride service within the Municipality as outlined in Sections 2 and 3 of this Agreement) ; C. A bill for services provided as outlined in Section 6 of this Agreement. 6 . The Municipality agrees to reimburse Pace monthly for the Local Share incurred in operating the service described in this Agreement. The Local Share will be calculated in the following manner : A. The Total Expense of the project will be calculated by multiplying the actual number of vehicle service hours delivered per this Agreement by the hourly rate for providing service. B. The Pace Contribution will be $2 . 50 per trip or 75% of Operating Deficit, whichever is less . C. The Local Share is the Total Expense , as described in Section 6A, minus fares , minus the Total Pace Contribution. The Municipality shall pay Pace within 30 days of receiving the monthly bill. • , -Page Three- 7 . This Agreement constitutes the entire Agreement between the parties hereto. Any proposed change in this Agreement shall be submitted to Pace for its prior approval. No modification, addition, deletion, etc . , to this Agreement except as to minor service changes shall be effective unless and until such changes are reduced to writing and executed by the authorized officers of each party. 8 . This contract can be terminated upon thirty (30) calendar days written notice by Pace, if: 1) sufficient funds have not been appropriated to cover the estimated requirements by Pace or by any other agency funding the service; or, 2) Pace develops alternative public transportation services which, as determined by Pace , will better meet the transportation needs of the public; or, 3) the Municipality fails to make payments as required by Section 6 of this agreement. 9 . Pace will not be responsible for any failure to provide service due to circumstances beyond the reasonable control of Pace. However, Pace shall make every reasonable effort to have service restored as soon as practical under the circumstances . No fees will be charged for unperformed service. IN WITNESS WHEREOF, the parties hereto have caused this Agreement to be made effective and executed as of the date first set forth above by their duly authorized officials . Rice, City Manager SUBJECT: Paratransit Local Share Agreement PURPOSE The purpose of this memorandum is to recommend that the City Council authorize the City Manager to enter into an agreement with Pace to fund the local share portion of the Elgin Dial-A-Ride service. BACKGROUND Since November of 1986, the City of Elgin Transportation Department has operated the local dial-a-ride service. The service has consisted of door-to-door mini-bus service for elderly and handicapped persons who were unable to utilize regularly scheduled fixed route bus service. Effective Janu- ary 1, 1992, Pace will directly operate all local transit service. However, there still is a need to provide the local share of the program cost. FINANCIAL IMPACT The City will continue to receive $16,614 from the Two Rivers Head Start Agency. The Pace budget projects a local share requirement of $23, 771. When the Two Rivers contribu- tion is deducted from the local share requirement, a shortfall of $7 , 157 exists . It is Pace's expectation that this amount would be funded by the City of Elgin. In past years, the most money that the City has contrib- uted has been approximately $4,000 . It would be the City' s intent to use the Two Rivers funds before spending any City of Elgin funds. It is our feeling that the operating budget for the paratransit service will be reduced under Pace. Certain overhead charges and administrative transfers would emk not be necessary. Thus, the budget would be reduced and the local share requirement would not be as great. A City contri- bution of $5, 000 may be more realistic.
