Rice, City Manager, be and is hereby authorized and directed to execute an agreement on behalf of the City of Elgin with Elgin Community College for training seminars, a copy of which is attached hereto and made a part hereof by reference. s/ George VanDeVoorde George VanDeVoorde, Mayor Presented: November 20, 1991 Adopted: November 20, 1991 Vote: Yeas 6 Nays 0 Recorded: Attest: s/ Dolonna Mecum Dolonna Mecum, City Clerk ELGIN COMMUNITY COLLEGE (ECC) OPERATED EMPLOYER TRAINING CONTRACT THIS CONTRACT, is between ELGIN COMMUNITY COLLEGE, hereinafter referred to as ECC, and CITY OF ELGIN, ILLINOIS, hereinafter referred to as the EMPLOYER. WITNESSETH : ECC and the EMPLOYER do, hereby, mutually agree to all provisions set forth in this contract. A. ECC agrees to perform the following for the EMPLOYER: 1) Provide the instruction, materials, texts, coordination, certifications (if any), and all other necessary duties in order to successfully conduct the training titled "Supervisory Topics" (see attached outlines). 2) The scheduled dates and times of said training will be Tuesdays, 9-11:00 a.m.; November 19, 26; December 3, 10, 17, 1991. 3) This training shall consist of 10 hours of instruction. 4) ECC shall award 0.00 hours of college credit per student who successfully completes the training, as defined by established ECC standards. 5) John Foens will be the instructor. 6) This training shall take place at City Hall, EOC Room, 150 Dexter Court, Elgin, IL 60120. B. The EMPLOYER agrees to perform the following: 1) Reimburse ECC $1,050.00 which is the total cost of this training. 2) Payment to ECC shall be due and payable upon completion of the training 3) Coordinate with ECC staff to insure all students are properly registered with ECC. 4) Enroll no more than 20 participants in this training without prior approval from ECC. 5) Coordinate with ECC staff to insure training success through the provision of proper facilities, participant attendance, and relevant training materials. The parties further agree that the following shall be essential terms and conditions of this contract: 1) No person on the grounds of race, color, religion, sex, or national origin, will be excluded from participation in, or be denied benefits of, or be otherwise subjected to discrimination in the performance of this contract, or in the employment practices of the EMPLOYER. 2) The EMPLOYER, being an independent contractor and not an employee of ECC, agrees to protect and hold ECC harmless from any and all liability not specifically provided for in this contract. 3) This contract may be terminated by either party by giving written notice to the other, at least fourteen (14) days before the effective date of termination. In such case, ECC is entitled to bill the EMPLOYER for all expenses incurred prior to the date of termination under the auspices of this contract. 4) This contract may be modified per written notice signed by both signatories listed below. Background: The Human Resources Department working with ECC has put together this five week, two hours a week Supervisory training seminar for our front line Supervisors . The program will be for 20 participants . It will cover subjects such as team building, problem solving and decision making, communication, discipline and delegation. Financial: The total cost of the program for the twenty employees will be $1,050. Recommendation: Council 's approval is recommended. vls
