RESOLUTION
APPROVING CHANGE ORDER NO. 2 IN THE CONTRACT WITH J.E.M. MORRIS
CONSTRUCTION, INC. FOR RIVER BANK BIKE PATH, PHASE II
WHEREAS, the City of Elgin has heretofore entered into a
contract with J.E.M. Morris Construction, Inc. for River Bank
Bike Path, Phase II; and
WHEREAS, it is necessary and desirable to modify the
terms of the contract as is described in Change Order No. 2,
attached hereto.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF ELGIN, ILLINOIS, that Larry L. Rice, City Manager, be
and is hereby authorized and directed to execute Change Order
No. 2, a copy of which is attached hereto and made a part
hereof by reference.

RIVER BANK BIKE PATH, PHASE II
CHANGE ORDER NO. 2
SCOPE: This Change Order No. 2 covers additional work
required because of the compensatory storage done for
the work on the east side of the Fox River. The work
includes topsoil and seed to cover the excavated area
under the Intermodal Transportation Center.
The contractor for this project is J.E.M. Morris
Construction, Inc. , of Big Rock, Illinois .
REASONS FOR CHANGE: This change order is required for the
costs associated with the items necessary to restore the bank to
it a natural appearance. Complete landscaping of the bank will
not be completed until the City Council approves an overall
masterplan for the banks of the River in the Center City area.
SUMMARY OF CHANGES IN CONTRACT AMOUNT: The amount of the
contract will be revised as follows :

The present contract with J.E.M. Morris Construction, Inc. is
for $254 ,262 . 65 . By reason of this Change Order No. 2 , the
contract for River Bank Bike Path Phase II will be increased in
the amount of Two thousand three hundred and twenty-five and
no/100 dollars ( $2 , 325 . 00) , the total contract value being Two
hundred fifty-six thousand five hundred eighty-seven and 65/100
dollars ( $256,587 . 65) .
OTHER CONTRACT PROVISIONS: All other contract provisions shall
remain the same.

MEMORANDUM
TO: Mayor and Members of the City Council
FROM: City Manager
SUBJECT: Fox River Bike Path Phase II
Change Order No. 2
PURPOSE: This memorandum will provide the Mayor and Council
with information to consider approving Change Order No. 2 for
the subject project.
BACKGROUND: The City Council approved the change order No 1
to the subject project at their September 11, 1991 meeting.
That change order was submitted for your approval in order to
complete the compensatory storage necessary to construct the
path within the flood plain. With the level of the river at a
low elevation it was considered important not to delay the work
until the cost of restoration could be calculated. The
compensatory storage excavation has been completed.
Change Order No. 2 covers the cost of restoring the area under
the Intermodal Transportation Center with black dirt and a
special mixture of seed along with an erosion blanket to keep
the bank in is present location until the seed can germinate and
the retain the bank. Further landscaping of the bank will be
deferred until a master plan can be developed for this reach of
the Fox River.
FINANCIAL IMPACT: The current contract is in the amount of
$254,262 . 65 . The additional work proposed for the restoration
of the bank under the Intermodal Transportation Center is
proposed to cost $2,325. 00. The total cost of the contract
would increase to $256,587 . 65 . The total amount budged for the
construction of the Bike Path is $379,000 (Account Number
388-991-9907)

RECOMMENDATION: It is recommended that the city Council
authorize the City Manager to execute Change Order No. 2 for the
River Bank Bike Path Phase II in the amount of $$2,325 . 00. A
copy of the change order is attached for your consideration.
