RESOLUTION
APPROVING CHANGE ORDER NO. 1 IN THE CONTRACT WITH
J.E.M. MORRIS CONSTRUCTION, INC. FOR THE
RIVER BANK BIKE PATH - PHASE II
WHEREAS, the City of Elgin has heretofore entered into a
contract with J.E.M. Morris Construction, Inc. for the River
Bank Bike Path - Phase II; and
WHEREAS, it is necessary and desirable to modify the
terms of the contract as is described in Change Order No. 1,
attached hereto.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF ELGIN, ILLINOIS, that Larry L. Rice, City Manager, be
and is hereby authorized and directed to execute Change Order
No. 1, a copy of which is attached hereto and made a part
hereof by reference.

RIVER BANK BIKE PATH, PHASE II
CHANGE ORDER NO. 1
SCOPE: This Change Order No. 1 covers additional work
required by the Illinois Department of
Transportations Division of Water Resources and the
U.S . Army Corps of Engineers for work on the River
Bank Bike Path Phase II project.
The contractor for this project is J.E .M. Morris
Construction, Inc. , of Big Rock, Illinois .
REASONS FOR CHANGE: This change order is required for the
costs associated with the items requested by the Illinois
Department of Transportation Division of Water Resources and
U.S . Army Corps of Engineers to be added to the improvements to
satisfy their requirements for work within the floodway of the
Fox River. These changes in the scope of the work were not
anticipated under the original contract for the work.
SUMMARY OF CHANGES IN CONTRACT AMOUNT: The amount of the
contract will be revised as follows :

The present contract with J.E.M. Morris Construction, Inc. is
for $232,879 .55 . By reason of this Change Order No. 1, the
contract for River Bank Bike Path Phase II will be increased in
the amount of Twenty-one thousand three hundred and eighty-three
and 10/100 dollars ( $21,383 . 10) , the total contract value being
Two hundred fifty-four thousand two hundred sixty-two and 65/100
dollars ( $254,262 . 65) .
OTHER CONTRACT PROVISIONS: All other contract provisions shall
remain the same. �

MEMORANDUM
TO: Mayor and Members of the City Council
FROM: City Manager
SUBJECT: River Bank Bike Path - Phase II
Change Order No. 1
PURPOSE: This memorandum will provide the Mayor and Council
with information to consider Change Order No. 1 to the subject
contract.
BACKGROUND: The City Council awarded a contract to construct
the River Bank Bike PafENPhase 2 to J.E.M. Morris Construction,
Inc. , at their March 27, 1991 meeting. The contract was awarded
without the final construction permit required by the Illinois
Department of Transportation Division of Water Resources and
U.S. Army Corps of Engineers permit for construction in the Fox
River. A drawing showing the required work will be provided at
the September 11, 1991 meeting.
The permit requires that certain additional work be completed as
a condition of approval. The work includes the removal of one
tree and scub vegetation, excavation of the west bank to provide
for compensatory storage of flood waters and river bank clean-up
of the east bank under the Riverside parking deck.
FINANCIAL IMPACT: The original contract was in the amount of
$232,879 .55. The additional work necessary to satisfy the
governing bodies in this type of work is in the amount of
$21,383. 10 . The total cost of the contract would increase to
$254,262.65 . The total amount budgeted for this work is $379,000
(Account Number 388-991-9907) .
RECOMMENDATION: It is recommended that the City Council
authorize the City Manager to execute Change Order No. 1 for the
River Bank Bike Path Phase II in the amount of $21,383 . 10 . A
copy of the c n e order is attached for your consideration.
