HomeMy WebLinkAbout90-0808 Elgin BMXpr, 9D-oSo8 RESOLUTION AUTHORIZING EXECUTION OF AN AGREEMENT WITH ELGIN BMX ASSOCIATION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, that Larry L. Rice, City Manager, be and is hereby authorized and directed to execute an agreement on behalf of the City of Elgin with Elgin BMX Association for a bike moto cross facility, a copy of which is attached hereto and made a part hereof by reference. George VanDeVoorde, Mayor Presented: August 8, I990 Adopted: Vote: Yeas Nays Recorded: Attest: Dolonna Mecum, City Clerk c-'1'4");riti' g/9/90 041 - a t°4 0- �i • • 271 The Elgin BMX Association, a not for profit association, and the City of Elgin, a municipal corporation hereby agree that a BMX (Bike Moto Cross) facility would provide additional recreational opportunities for the citizens of Elgin and to that end the Elgin BMX Association and the City of Elgin hereby agree as follows: The Elgin BMX Association will: 1 . Build and maintain a BMX official size track, starting tower, starting gate and surrounding areas at its own expense. 2 . Incur all costs for insuring the facility, sanctioning races, obtaining permanent equipment and providing awards. 3 . The City of Elgin shall be named as a co-insured on all insurances, which shall at all times be maintained at the statutory minimum or above. 4 . Hold a series of beginner clinics each summer (June-August) 5 . Hold a series of sanctioned BMX races each season (May-Sep- tember) 6 . Promote the facility through its ties with the Chicago Area Bicycle Dealers Association, suburban bike shops, park districts and area media. 7. Obtain an agreement on decisions concerning the facility from the Department of parks and Recreation before implementation. 8 . Provide a written report and fiscal accounting of the opera- tion of the facility at the end of each year to the Director of the City of Elgin Parks and Recreation Department. 9 . The Elgin BMX Association shall indemnify and hold harmless the City of Elgin for any judgements rendered against the City in connection with the construction and use of this facility. The Elgin Parks and Recreation Department will: 1 . Promote the facility, races and clinics through its publica- tions. 2 . Provide lawn maintenance and trash pickup at the facility. 3 . Provide a source for watering of the site and incur expense of water usage. 4 . Allow use of the existing storage facility for small equip- ment storage as space allows. 5 . Provide access to equipment for special maintenance of the track as needed and when available. 6 . Give this facility the same consideration as park facilities and evaluate its ability to serve a segment of the community. This agreement will be in full force until and including Septem- ber 30 , 1991 . Elgin BMX Association PARTF City of E gin 40 44?_ G Okn at/ V President airman ' C ty M nager Elm Agenda Item No. 6; 11.„ July 13 , 1990 TO: Mayor and Members of City Council FROM: Larry Rice, City Manager SUBJECT: BMX Agreement PURPOSE: The Parks and Reclamation Task Force requests approval of an agreement between the Elgin BMX Association and the City of Elgin BACKGROUND: The BMX track officially opened in June of 1990 and will conduct races and beginner clinics through September. Starting in 1991 the track will be open from April to September of each year. The attached agreement was submitted to the City' s Legal Depart- ment and approved. The Parks and Reclamation Task Force approv- ed the agreement at their June 26 meeting. The agreement will be effective through September 30 , 1991 at which time a new agree- ment will be submitted for approval. To date $3 ,000 has been allocated and paid to the Elgin BMX Association from the Sports Complex Capital Improvement Fund 340 for moving of clay material and installation of electrical lines . FINANCIAL IMPACT: There will be only general in house maintenance expenses associ- ated with the track in regards to complex staff mowing, litter pickup and removal and water expense .
