AGREEMENT FOR CONSULTANT SERVICES
THIS AGREEMENT, entered into this cAlltday of
1990, by and between the CITY OF ELGIN, State o Ii inois,
hereinafter referred to as the CITY, and MIDWEST CONSULTING
ENGINEERS, INC. , a firm of consulting engineers whose address is
5151 N. Harlem. Avenue, Chicago, Illinois 6056, hereinafter referred
to as the CONSULTANT.
WHEREAS, the CITY proposes to engage the CONSULTANT to render
professional services in connection with the proposed improvement:
The construction engineering of the National Street Bridge over the
Fox River.
This AGREEMENT contains all the terms and conditions of the
agreement between the CITY and the CONSULTANT and any changes in
this AGREEMENT shall have no effect unless they are made in
writing, signed by both parties, and incorporated as an amendment
to this AGREEMENT. No other written or oral understandings,
representations or agreements, other than those herein, have been
made by and between the parties hereto.
In consideration of these premises, the parties hereto agree
as set forth in the following pages numbered 1 thru 3 inclusive.
Executed by the CITY of ELGIN, Kane County, State of Illinois,
acting by and through its City Council.

1. Description of Project
The project includes the construction engineering of the
National Street bridge over the Fox River in the City of
Elgin, Kane County, Illinois.
2 . Scope of Services
The Consultant will perform or be responsible for the
performance of the following engineering services:
- Conduct a preconstruction conference to establish a
construction schedule and coordinate utilities, traffic
and City construction procedures.
- Provide sufficient observation of the construction work
and the contractor's operations in order to provide the
CITY with assurance that the project is constructed to
conform with the details and specifications and that the
integrity of the design concept as reflected in the
documents has been implemented and preserved by the
Contractor.
- Establishment and setting of lines and grades for
construction of the project.
- Maintenance of a daily diary recording and documenting
the contractor's activities throughout construction,
weather conditions, material testing results,
contractor's conformance to the contract schedule, and
sufficient information to permit verification of the
nature and cost of CITY authorized changes in plans and
extra work.
- Administration of the construction contract, including
preparation and submission to the CITY in the required
form and number of copies, all partial and final payment
estimates, change orders, records, and reports required
by the CITY.
- Coordination of the construction progress and schedule by
holding weekly meetings with the CITY and contractor.
- Proportioning and testing of all concrete and all
bituminous mixtures. Perform all compaction tests
required by the specifications. Provide CITY with copies
of all test results.
- Provide the CITY with one (1) set of the records and
documents showing any changes made to the plans during
construction of the project.

3 . Compensation
We propose to provide our services for a fee based on our
actual labor costs on the project times a factor of 2. 65 to
cover payroll burden, overhead and fringe benefits, indirect
costs and profit. Direct expenses (travel and sub-
consultants) will be billed at their actual cost to us. The
contract will be subject to an upper limit of compensation.
The proposed upper limit of compensation (not-to-exceed) is
$20,830.00, including sub-consultant costs. Invoices will be
issued monthly for the amount of work actually completed
(including sub-consultant expenses) during the month.
This fee has been calculated as follows:
28 hrs/week x 13 weeks x 17. 50/hr x 2. 65 = 16, 880

We propose to use a sub-consultant to provide all required
testing services. The sub-consultant selected to provide
these services is subject to the approval of the CITY.

I hereby certify that I am the President and duly authorized
representative of the firm of MIDWEST CONSULTING ENGINEERS, INC.

has:
a) Employed or retained for a commission,
percentage, brokerage, contingent fee or other
considerations, any firm or person (other than
a bona fide employee working solely for me or
the above consultant) to solicit or secure
this contract;
b) Agreed, as an express or implied condition for
obtaining this contract, to employ or retain
the services of any firm or person in
connection with carrying our the contract; or
c) Paid, or agreed to pay, to any firm,
organization or person (other than a bona fide
employee working solely for me or the above
consultant) any fee, contribution, donation or
consideration of any kind, or in connection
with, procuring carrying out the contract;
