RESOLUTION
ACCEPTING A GRANT OF DRAINAGE EASEMENT
(1100 Summit Street, Southern Boundary)
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS,
that it hereby accepts a Grant of Drainage Easement for the property legally described
as follows:
The Southerly 15 feet of that part of the Southwest Quarter of the
Southeast Quarter of Section 7, Township 41 North, Range 9, East of the
Third Principal Meridian, described as follows: Beginning at the Northeast
Corner of the Southwest Quarter of said Southeast Quarter; thence South I
degree 13' West along the East line of said Southwest Quarter of the
Southeast Quarter, 776.0 feet to the North line of State Route 58; thence
South 89 degrees 49' West along said North line, 341.18 feet; thence North
I degree 13' East parallel with the East line of the Southwest Quarter of
the Southeast Quarter 759.59 feet to a point in the North line of said
Southwest Quarter of the Southeast Quarter; thence North 87 degrees 30'
East along said North line, 341.53 feet to the point of beginning, except
therefrom the South 508.36 feet of the East 150.0 feet thereof, in Elgin,
Cook County, Illinois.
BE IT FURTHER RESOLVED that the City Clerk is hereby authorized and directed
to cause the Grant of Drainage Easement hereby accepted to be recorded in the office of
the Recorder of Deeds of Cook County, Illinois. RECORDING 816 2L

GRANT OF DRAINAGE EASEMENT

Deed made this 1 day of Uri to b{ , 1989, between ST. JAMES A.M.E.
CHURCH, a religious corporation, of 305 Ann Street, Elgin, Kane County, Illinois,
hereinafter referred to as the GRANTOR, and The CITY OF ELGIN, a Municipal
Corporation, of 150 Dexter Court, Elgin, Cook and Kane Counties, Illinois, hereinafter
referred to as the GRANTEE.
Whereas, the GRANTOR is the owner in fee simple of a piece of real property
described as follows:
that part of the southwest quarter of the southeast quarter of section 7,
township 41 North, range 9, East of the third principal meridian, described as
follows: beginning at the northeast corner of the southwest quarter of said
southeast quarter; thence South 1 degree 13' West along the East line of said
southwest quarter of the southeast quarter, 776.0 feet to the North line of State
Route 58; thence South 89 degrees 49' West along said North line, 341.18
feet; thence North 1 degree 13' East parallel with the East line of the southwest

Whereas, the GRANTEE CITY OF ELGIN is a Municipal Corporation with C)

jurisdiction over the above mentioned piece of real property and requires a drainage easement

over said property, known as 1100 Summit Street, Elgin, Cook County, Illinois. GD
Whereas, the GRANTOR has agreed, in consideration of ten dollars ($10.00) and
other valuable consideration paid by the GRANTEE, the receipt by the GRANTOR of which
is hereby acknowledged, to grant to the GRANTEE an easement in gross for purposes of
ingress and egress and for the use, repair, maintenance, and replacement of a drainage
easement located on the southerly 15 feet of said property along the entire southern boundary

of said property. Said easement for purposes of ingress and egress shall include that area
extending 15 feet North from the southern boundary of said property.
Now this deed witnesseth that the GRANTOR hereby grants unto the GRANTEE full
and free right and authority to use, repair, maintain, and replace said drainage easement.
Said easement for purposes of ingress and egress shall include that area extending 15 feet
North from the southern boundary of said property. This easement shall be an easement in
gross and shall continue until said easement is no longer necessary and required for the use,
repair, maintenance and replacement of said drainage easement, at which time it will
automatically terminate.
In witness whereof the GRANTOR and GRANTEE have hereunto set their signatures
