Geneva Street) BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, that it hereby accepts a Plat for Easement for a permanent and temporary construction easement for the construction and maintenance of a retaining wall at 62 S. Geneva Street, Elgin, Illinois, from Paul F. Born, Jr. for the property legally described as follows: Permanent Easement That part of Lot 9, Block 5 of J.T. Gifford's Plat, being a subdivision of part of the Southwest Quarter of Section 13, Township 41 North, Range 8 East of the Third Principal Meridian, in the City of Elgin, Kane County, Illinois, described as follows: The Easterly five (5) feet of the Southerly thirty-three (33) feet of the Northerly forty-three (43) feet of said Lot 9. Temporary Construction Easement That part of Lot 9, Block 5 of J.T. Gifford's Plat, being a subdivision of part of the Southwest Quarter of Section 13, Township 41 North, Range 8 East of the Third Principal Meridian, in the City of Elgin, Kane County, Illinois, described as follows: The Westerly two (2) feet of the Easterly seven (7) feet of the Southerly thirty-three (33) feet of the Northerly forty-three (43) feet of said Lot 9. Geneva Street PURPOSE: This memorandum will provide the Mayor and Council with information to consider the acceptance of an easement for the improvement of a retaining wall at the subject property. BACKGROUND: The City Council approved a bid award to the low bidder, Northwest Contractors , Inc. of Elgin, IL for the filling in of a sidewalk vault at 62 S . Geneva Street at the City Council meeting on June 14 , 1989 . Since that time, it was determined that the proposed improvement could cause future problems and the project was re-designed. The new design calls for a retaining wall to be constructed at the site and to fill in the existing vault with gravel. In order to construct and maintain this wall, it is necessary to obtain and accept a plat of easement from the owner of the proper- ty, Paul F. Born, Jr. Mr. Born has granted the easement which is included for your review on the attachment. FINANCIAL IMPACT: The only costs involved would be with filing the easements with Kane County and these costs are minimal.
