Letter of Agreement
Elgin Community College
and
The City of Elgin
August 22, 1989 - August 27 , 1990
The Board of Trustees of Community College District 509 shall:
1. Use the parking lot owed by City of Elgin that is located
adjacent to the City of Elgin Softball Complex, situated on
Spartan Drive in Elgin, as an instructional laboratory for
students enrolled in ECC' s Truck Driving course work.
2. Restrict use of the above referenced parking lot to the following
times:
September 1 through October 26 : 6 : 00 AM to 5 : 00 PM,
Monday through Friday
October 27 through November 12 : 6 : 00 AM to 10: 30 PM,
Monday through Friday
November 20 through January 12 : 6 :00 AM to 10 : 30 PM,
Sunday through Saturday
January 15 through April 6 : 6 :00 AM to 10 : 30 PM,
Sunday through Saturday
April 3 through May 4 : 6 :00 AM to 10 : 30 PM,
Monday through Friday
May 5 through August 27 : 6 : 00 AM to 5 :00 PM,
Monday through Friday
3 . Pay the City of Elgin for any costs of such extra cleaning duties
as may from time to time in the opinion of the City be required
in relation to ECC usage of the parking lot.
4 . Pay the City of Elgin for any costs of such parking lot surface
repairs as may in the opinion of the City be directly related to
the ECC usage of the lot.
5 . Provide the City of Elgin with a certificate of insurance naming
the city as an additional insured. Such certificate shall provide
that it may not be revoked except upon then (10) days written
notice to the City of Elgin and shall be in amounts and coverage
required by the City.

The City of Elgin shall:
1 . Allow ECC to use the parking lot adjacent to the City of Elgin
Softball Complex on Spartan Drive, as an instructional laboratory
for students enrolled in ECC' s Truck Driving course work, during
the time periods defined in this agreement, without any charges
except those defined in this agreement.
It is understood that this agreement will be for the period of August
22, 1989 , through August 27 , 1990 . Parking usage times defined by
this agreement may be modified by written thirty day advance notice
of such change requests.

MEMORANDUM
TO: Mayor and Members of City Council
FROM: James J. Cook, City Manager
SUBJECT: Elgin Community College/Softball Complex Agreement
PURPOSE: The Parks and Reclamation Task Force (via a telephone poll)
requests the City Council ' s approval of an agreement with Elgin
Community College concerning their utilization of the Sports Complex
parking lot for Truck Driving Training classes.
BACKGROUND: FCC is developing a campus master plan which includes a
large new parking lot south of the vocational building. When
completed, this lot is intended to house the Truck Driving Training
classes. Until that time the college has requested the use of the
Softball Complex parking lot for these classes .
Following numerous discussions, the attached agreement was developed.
The Parks and Recreation Department' s two concerns, (that the driving
classes would not compete with our programs and that the trucks--18
wheel semi-trailers-- would not damage the lot surface) , have been
addressed conditionally (see attachments) .
The Parks and Engineering Staffs will video tape the condition of the
entrance road and parking lot within the next week and again after
the final class . Per this agreement if there are any problems , they
will be recorded and presented to ECC.
Due to some miscommunications related to the beginning date of the
first classes and the changes in the agreement drafts by the college,
the first session began prior to the Council receiving a copy of the
agreement for their consideration. The City staff, after receiving
the insurance waiver , has given the college permission to hold the
first session.
FINANCIAL IMPACT: None
RECOMMENDATION: The Parks and Reclamation Task Force recommends the
City Council approval of an agreement with ECC concerning their
utilization of the Sports Complex parking lot for Truck Driving
Training classes.

SUBJECT: Softball Complex Roadway and Parking Lot
Elgin Community College Truck Driving School
Per our meeting of August 30 , 1989 , this memorandum will
provide you with a narrative of our concerns in this matter .
It is our understanding that Elgin Community College (E . C . C . )
is conducting driving classes for semi trucks . The trucks
will be multi-unit vehicles . The vehicles will be empty and
have a unit weight of approximately 10 , 000 pounds . The
trucks will be using the roadway and parking lot as a
training area and will not be parking on City Property .
Our concerns for this use of the parking lot and roadway are
as follows :
1 . When this type of vehicle turns for backing it can do
damage to asphalt paving .
2 . Use of the parking lot during freeze/thaw cycles can
cause damage to the pavement and base course .
3 . The edges of the pavement would be damaged by vehicles of
this size leaving the roadway or parking lot .
4 . The roadway and parking lot will have to be plowed .
If the City allows E . C . C . to utilize the roadway and parking
lot for truck driver training, then we would recommend the
following :
1 . A video tape be made of the existing condition of all
pavement and pavement edges .
2 . E . C . C . be required to clean all snow not normally plowed
• by the City .
3 . City staff inspect pavement during freeze/thaw cycles to
check for damage .
4 . The City and E . C . C . should enter into an agreement where
E . C . C . would replace to the City's satisfaction all
pavement damaged by this use of the City's facilities .
5 . Liability insurance should be provided by E . C.C.
